I ordered the acai berry supplement trial offer  $1... was billed 29.95 for a trainer and then 89.31 was billed to my credit card.  I did call them talked to a "Michael" and cancelled any future shipments but was told the 89.31 was not refundable.  What a rip off!  I was told I was supposed to cal before the 14 day free trial was up  -  I just received the pills today and the amount was on my credit card.  I haven't even had a chance to try the free trial and I'm screwed!!!!!

This is unbelievable! I have called them 3x and they tell me they have no record of my account (which they charged $90). When I call, the supervisor is 'not there today', 'in a meeting', or 'cannot find anyone so you have to call some other time.' If I do not get refunded, they will continue to charge me. Personally, I'm going to start calling Oprah.

Just thought I would share with everyone that my bank refunded my money!! Yeah!! They considered it a forced debit and they will prosecute the company! So maybe if everyone turns this over to their banks they will be put out of business, this is the biggest scam. I contacted Oprah and Rachell Rays shows and told them they were using them for advertisment and they are also going to check into them!!

i'm still upset with myself falling into this "free" trail offer - def. not free - very costly lesson - they charged almost $90 - i immed. closed my checking account back in nov. and followed their directions to return the product - they closed the account but have not refunded my $$ - they even went as far as to give a confirmation # - i just called, they show rec. my return but no record of ever charging me 89.31 and refuse a refund - enough, i called my bank to report a fraudalt/theft charge and filed a claim - my bank is giving a temp. credit back and are going to investagate - beware - if you have not closed the acct. that $$ was stolen from, do it now!!

I called my credit card company and put in a dispute (citicards is great for this) I have also block future charges with this company.

I heard about Acia Berry on the Rachel Ray show it has now cost me a total of $210.00 everytime I call I feel like I have woke someone up, and they won't let me talk to a supervisor, my bank is investigating them and I had to get a new debit card. I never even saw the terms and conditions but if it will help I will stay on line for 45 minutes if they will refund my money.

WOW! Glad I am not the only one. I keep getting told that I should have read the terms of agreement better because it "clearly states that there is a 15 day trial period after which there is a no refund policy". I of course reply "how can I trial something I have not received?" called 3 times this morning and the plan is canceled but they don't want to give me my money back, and they won't put a supervisor on the phone. Apparently they are in a 3-4 hour long meeting and can't be interrupted. I bet its to cover how they are going to handle all these irate customers who keep demanding thier money back since they aren't even getting the initial product before being charged almost $100. I want to tell everyone I know about their little scam. I wonder if Oprah knows her name is being used in connection to this scam?

I always thought I was smarter than this!!! I, too, responded to the Acai trial offer and was charged the $89.  I didn't know it till I saw it on my account. It had been so long since I ordered it, I'd forgotten about the sample! I discontinued my debit card and have spoken to someone at this number 3 times.  I've been given a "confirmation" number to get a credit of the money.  To date (since 11/18) I have seen nothing.  Tonight I was told I'd see it by Monday.  We'll see.  I've assured them I WILL continue to call.  Pearl is the last one I talked to tonight. Wish I'd known about this website before today.

I have had the same problem as all of you and was able to get someone on the line concerning the $90 charge.  I was given a confirmation number and told that my account would be erased from their records and that I would receive my refund within 7-14 days.  Have any of you received your refund?

Final update/resolution - I did get the extra product in the mail that they advised me while in transit.  I sent the extra product and the actual trial supplement I ordered back via fed-ex, called the company w/ the tracking # and was advised they would refund my money.  I received a confirmation number from them regarding this.  I called my bank (HSBC - so fabulous) and gave the investigator an update to which he replied he was glad that it was resolved; however, he would continue checking into it because the charge was unauthorized.  Good luck to the rest of you!  I've learned my lesson.

Just had the same problem myself. I have called 4 times and I am receiving one refund for $89.31. I have another charge for $90.02 that I am having to deal with because the reps at 888-771-7026 say they have not record of this amount although it has the same info on my bank statement that the $89.31 has. I am going to do everything it takes to get my money back. To everyone that is having this problem, DO NOT BACK DOWN!!! Keep going till you get back what is yours.

As an update...I called the 888 phone number again and waited on hold for approximately 20 minutes or so before speaking with a rep.  I explained to him that although I know he has a script to following I wasn't interested in receiving any other products.  I explained that I've been out of the country for the past two weeks (which I was) and just noticed the charge to my account.  He advised me that the company had a no refund policy and then I proceeded to tell him that I have read several negative reviews regarding this same situation and was going to file a police report citing his name as well as the company for stealing from me.  I asked him to please resolve the situation or have a supervisor resolve it for me.  I advised him that I was willing to send back the products or do whatever necessary but needed this charge removed.  He indicated that the additional supplement was in transit and so what I needed to do was send it back and call the company w/in 24 hours of sending it back and they would refund the $90 to me.  I advised him that I had no way to confirm if this would actually happen.  He then advised me of his agent ID # as well as a confirmation# which would confirm that he agreed to refund the money to me upon receipt of the additional products shipped.  I'm crossing my fingers that this is legit and that when I call again I can get this resolved for good.

I have had the same issues as the others indicate.  I did not authorize any additional charges other than the initial Acai Berry trial supplement.  I was able to get the Fit Factory membership charge removed; however, have had a lot of trouble reaching the party responsible for charging me $90.00 without my consent.  I called my bank and reported the charge which has caused me the inconvenience of having my card shut down and a new one is being sent which means 7-10 days with no debit card.  I called the 888-771-7026 and got hold music but no rep ever came on the line.  I called the Fit Factory people again and told them the situation and was given ph: 801-528-1391 to call.  I called that phone number, rec'd an automated recording and then nothing - no hold music and no rep so I have no clue what is going on with that phone number.  I am going to file a police report as well.  I can't believe I got caught up in this - never again!  Beware!!

Same thing happened to me! 90.00 stolen from my account! I filed a claim with my bank and police report. No, you cannot and probably WILL NOT get ahold of anyone. All you get is music. FRAUD FRAUD FRAUD!!!

We have also been charged for a product we did not order. We did ask for a 1 mo. trial offer of the Acai berry for 3.95 . This was stemmed from an advertisement on the Oprah show. So far we have received nothing but a charge of almost 90.00 on our bank statement. If this is not corrected we will seek restitution through any source necessary. We have advised our bank to deny any further debits to this company and to stop this payment also. I have found other complaints of this nature linked to 888-771-7026

This number seems to stem from the Acai berry company. This number appears on the bank statement. They billed for a product we didn't order.
888-771-7026. If we don't get it correct, we'll file a complaint with the Federal trade commission.
