One of your rights when dealing with Collections Agencies
Right off the bat

The first step a collection agency must take is to send you a written notice through the mail (email doesn?t count). This notice must include:

the name of the creditor (the person or business that says you owe them money)
the amount the creditor says you owe
the name of the collection agency and its authority to demand payment on behalf of the creditor.
After sending the notice, the agency must wait six days before it can contact you in person or by phone.

These guys call my cell phone every single day, sometimes 2 or 3 times a day. It only rings once so I don't get the opportunity to answer it, but I can see the calling number. They are also leaving me phonemail messages, but I don't use phonemail (I don't know how). So keep it up A***oles... I am now creating and submitting online formal complaints (every day) to the Canada Do Not Call List Website.  You call, I send a complaint about you.  What a pathetic game you are playing.  Funny thing is, I  just got this cell number, so you are looking for the person who had this number before me.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

I am really upset with this company or agency or whatever it is. For weeks they tried to get ahold of me through family, not directly, and now they are calling my ex boyfriends house trying to get ahold of me. ITS NOT OKAY. they never try my cell phone, the only way to reach me basically, and I DONT HAVE DEBT. I dont even own a car, let alone a credit card. ugh, and they gave my ex a reason to try to contact me. This is completely not okay.

This is Metropolitan Credit Collections. They are known for rude collectors with highly aggressive collecting. They are also known to buy old debts passed the Statue of Limitations and debts belonging to an deceased person. They will call your family, friends and even neighbours. If you owe a debt looks up your rights. You do not have to talk to them. You do not need to pick up their calls. However, the debt will always remain with you until it falls off your credit report. Do not ever admit to the debt or it will restart your SOL. Keep a records of how many times they call. They are only allow to call a certain number of times a week. You can also send them a cease and desist letter. Look up the laws of collecting in your city. If they over called and harassed you then you can sue them. Never trust a debt collector.

Statue of Limitations is up now (2 years from date of last payment). I sent all of their mail back saying that I no longer lived at the residence. I never answered their calls. I put a phoney address on my drivers licence. I waited them out and now legally there is nothing they can do. Sure they still call the house but it doesn't hold the drama like it use to. Not when there is only bark and no bite. They seemed to get the most aggressive when the two year mark was nearly done. They would call in excess of 6 times per day. I disconnected the answering machine over a year ago, about the same time I started sending their mail back. Don't ever, ever answer any telemarketing phone calls. These are tactics used by their agency to try and find evidence of where you live.
I truly could not pay my debt back. So I took the chance and the court summons never came. And even if it were to arrive now I would be able to beat it (and they know it).
So call all you want Met Credit and any other debt collection agency dumb enough to purchase this debt from them down the road. Time was on my side. I won.

Your friend is right. It is two years from the date of last payment (which would be the date you paid the $500). Hang in there. They love to play the bully. The specialize in getting into your head and making you so upset that you feel there is no other recourse. Don't answer the phone - I didn't for over two years. Once the two years is up you can tell them all to pound salt.

The fact your message was typed using all CAPS displays some lack of professionalism on your part.  Moving on; it is also obvious you are a Call Centre Collection agent. I don't think any so called reputable Collection Agency would spend any resources in delivering some unprofessional simple minded view via web.  More sounds like you are spewing some form of regurgitated training material they supplied you for product knowledge.  Using part of one of your points; What if it IS a wrong number?  Do you feel these people want to be harassed by some poorly - educated - trained - mannered and most likely poorly speaking agent working for some Collection Agency?

Hi Paul. Thanks for the info but I was told by a friend that all you have to wait is 2 years before they could no longer collect a debt.  I have a TD credit card debt which I could not pay because I lost my job 4 years ago because the company closed my department.  I was devastated because I am now 68 years old and no one will hire me for anything because of my age.  Metropolitan Credit started calling me and when I spoke to the man he told me to borrow money from friends, relatives or anyone that I could.  I told him my situation but he was so rude that I stopped answering the daily calls from him. I did make a $500.00 payment at the beginning to try to stop him but he then continued to harass me.  I have no money, I still have a mortgage on my house, my 73-year-old husband is starting to show signs of Alzheimer's symptoms and my 45-year-old son suffers from depression mixed in with schizophrenia. He is on a disability pension but I have to buy his clothes and help with his food.  On top of that we are basically raising our 12-year-old grandson from my youngest son who works shift work.  I have tried to keep it all together but I wish I could be told by my doctor that I have a disease which would end my life soon.  I never answer my phone anymore unless I know who it is calling and I am afraid to go to the mailbox. Living in fear every day is beyond horrible. When you indicated 6 years, I just sat and cried.

Don't ever answer calls from collections. That counts as contact in their books. It depends on province, but if an agency is trying to collect a private debt from you, all you have to do is wait six years, and then they have no legal ability to demand any money from you.
If you or someone in your house does screwup and answer, do two things:
1. deny that you are that person
2. deny that there is an actual debt owed - call it the the alleged debt

hi, i work for the mca....
and looking at some of this statements.. half of them are not true...  i believe that most of the agents just trying to help.. "yes, there are some bad apples" but we are just falling our orders...
i personalty try to do what i can... since i know how it feels having a bad debt... and if you think that the agent that you are talking to is being rood .. just ask them to transfer you to someone else..

the spelling doesn't matter in this job.. since all the notes you put down are for your own use.. like myself.. i am from a different country so my spelling is horrible... but it doesn't mean that i am stupid.

if they call you and don't actually have a debt or don't know the person who they are talking about.. tell them that... and they will remove your # and will not call you again..

if you already payed it.. and they got your file... just give them the receipt #... that means that the company they are calling you about maid a mistake.. and they will tell them that and will get rid of your file...

and they are a 3rd party... they don't buy out the debts...
and we are not commission freaks"".... i personally don't even get commission...

so don't ignore it.. maybe they can help you... :)

I had blocked this number as I do with alot of 1-888, then they started calling with a number that came up PRIVATE CALLER and leaving a message.  They are asking for a person that is unknown to me, I have returned the call leaving a message to extension 2444 stating the person they are looking for does not live here and is unknown to me.
The thing that really ticks me off is I have answered calls that state Private Caller as I have a family member who is ill that calls from a private number.  When I would answer these calls I would hear people talking in the back ground then I would hang up.
I had to make other arrangements to communicate with my brother as I stopped answering private numbers.
How irritating is this!!!!!!!!!
