I used to work as a collector, so here is the inside scoop on these guys; they are clowns. Collectors will intimidate and threaten legal action, but if your amount owing is small i.e. a few hundred dollars, nobody will take you to court. Think about it, it would cost them more to just hire a lawyer, let alone drag through the court proceedings.

If your debt is large, like a business closure, then you're probably safe under bankruptcy, and your personal assets like house or car cannot be seized. If it's money that you personally owe and not in the name of a business, they CAN garnish your wages, but that requires a long legal process and they only do it if the party demanding money from you gets a court order, which means going to court after hiring an expensive lawyer. So we're talking a large amount, does not happen in most cases.

They can however (and do) report you to the credit bureau, which will tarnish your credit rating for atleast 7 years before it is removed from your file (not a good idea if you're planning on buying a house or applying for a job where they do credit checks). If you're an existing home owner, your rates will go up when renewing your mortgage.

If you're trying to settle your debt and absolutely fed-up with the harrasment, the magic words are, "Don't call me again or I will report you to the Better Business Bureau" Calls will stop before you even hang-up.

My advice; reach a settlement or negotiate a monthly payment. This will atleast save your credit rating. You might not think you need it today, but you will need it tomorrow.

Good luck! (P.S. I lasted only 3 months in the job, I found the whole experience of harrasing decent people caught in debt traps to be a terrible thing)

Debt Collector
My boyfriend has been sent to Pomer and Boccia by Canadian Tire  (NOT ME), and I'm the one that is being harassed by them. They do have his cell phone number but they only use our home phone number as that's the one he used when he applied for the credit card, and since he lives out of the city during the week, I'm the one that gets these calls.  Rena... one of their collection agents has given me all the details about his debt (which is illegal and none of my business) has also passed this information on to a house guest who answered the phone one time, has left 2 detailed messages regarding his debt and payment arrangements on my voice mail... also has called me back after I've hung up on her cursing and swearing at me (again also illegal), They have threatened to contact my boyfriends employer to inform them that he's avoiding paying his debt (which again is illegal)   I've contacted the Ministry of Consumer Services was advise that Yes Pomer and Boccia are a law office, but they also have a debt recovery department that is actually a registered Collection Agent, which means they HAVE to obey the rule and regulations that everyone else has to follow.  I was also advised that I should file a formal complaint with the president of the company as well as the Ministry... which I have just done so.  So for anyone out there being harassed like this... just take note... how they are trying to recover the debt is wrong.  Learn your rights!!!

Hello all,

This is Bryson, if you look up 2 posts you will see that I wrote on here exactly 1 year and 1 day ago.

I want to just update you and say that I have never received any kind of contact from these clowns at Pomer and Boccia.

They threatened me with a few letters over a year ago; I never called them back or acknowledge any of those letters. I just read them and threw it in the trash. I will add that each letter was more and more aggressive and said that they will be looking at seizing my assets and a bunch of other nonsense like. THEY WERE LYING.

If you ever get contacted by these guys...IGNORE THEM AND DO NOTHING. They can't do anything to you. THE ONLY THING THEY CAN DO IS INTIMIDATE AND SCARE YOU.
Like I said before, WHY WOULD THE CREDIT CARD COMPANY GIVE UP ON YOU AND HAND YOUR FILE TO THIS TWO BIT COMPANY??? You know why? LEGALLY THEY CAN'T DO A THING.

One final time, IGNORE THEM.

Cheers,
Bryson

These a**holes just rang my number twice. I wouldn't answer. They didn't leave a message the first time and I hung up the second time after two rings. Never heard of them and do not have any issues with any payments or loans. I've just reported them to the rcmp and the canadian do not call list.

I have been called several times by an 'Emily Barnett,' If that is her real name? I have asked them to deal with my lawyer who is taking care of all debts left by a business closure. She says "they can't, for privacy reasons." and refuses to deal with my lawyer or even send an email to her outlining details. Fyi. I lost my home my car my family. Palmer and botchup can't do much more to me.  They buy your debt for 20- 30 - 40 cents on the dollar and then try to squeeze what they can out of you. The balance is their profit. If you can get the protection of a lawyer. It scares them off because it is then too expensive for them to make much profit.

Yes, I can confirm the are a collection agency.  I just settled a debt with them.. total jerks. First they wouldn't send me a settlement letter so I refused to make a payment until I got one.  Finally got one, made the payments, but they repeatedly called me three times a week to ensure I was going to make my payments on the date agreed.  I didn't miss a payment, so they shouldn't have been calling me.  Now that it's paid, I have left four messages trying to get a release letter from them but they won't call me back.  I finally called Visa directly and they will send me the release letter.  Total jerks - avoid at all costs.

I want to know if anyone can give me information about how I can get this guy in trouble for violation of Privacy, Because I do know that they can't come to your home and speak to people about you. And does anyone know Are these people for real..Any information would be great..I am doing some research on this also..and I will post anything that I find out..thanks

Lady called giving me my address from 5 years ago. She they were a Law Firm (Palmer and Botcha??) and they needed my new address to send me something. I asked what, and she said that she did not know and would ask. She came back to the phone and said everyone had left for the day, so she could not tell me what it was about. When I called the number that showed up, it said Palmer and Botcha Professional Corporation, it did not say they were a law office.

I have repeatedly received messages and calls from this company looking for a John Smith. 3 months ago I called back and told them to stop harassing me as I had my phone number from December 2007 and on and did not know a John Smith. I spoke with a Mr. Sabi (jack***) who proceeded to hit on me. He had stopped calling until about a month ago and now he is leaving obnoxious messages again... I am going to call back again and tell them if it does not stop I will be charging them with harassment. Which I will.

I just received several harassing phone calls from this number within 20 minutes... the call was for a coworker who isn't in the office not for me... but the guy proceeded to harass me and when I hung up he would call right back... So I Googled them and found that this is their "approach" - "Pomer & Boccia has a well-defined approach to ensure that the collection activity on accounts placed for recoveries are handled in an optimal fashion that uses a psychosocial methodology." So basically they terrorize people until they get their money...

They keep leaving recording telling me to call 1-888-858-5529 during regular business hours. (not sure about you but I work regular business hours). I know for a fact that I don"t owe anything to collections so I am more annoyed than confused.  I wish they would just screw off.

A "Mrs. Ann Bellisario" called me in Vancouver, purportedly from Palmer and Boccia (she spelled Boccia for me, but I didn't double-check re Palmer, so could be Pomer as others have it) in Toronto, looking to reach a friend of mine. She wouldn't say what it was about, but DID describe the company as "a law office" and later said it involved "a legal matter." She said she was not a lawyer but "had been asked" to track down my friend (who as far as I know ain't missing...). Fortunately I gave her no contact info, simply because I didn't connect my friend with any legit legal matter in Toronto. Bellisario offered to mail something to me for forwarding to my friend, but I said I'd contact my friend first. Thank goodness I've first checked online and found this site to share.

Bellisario was persistent but didn't harass me, but then again, I'm not easily intimidated and I asked lots of questions (though received no satisfactory explanations), and maybe their "psychosocial" training teaches them the difference!!!! Lol. I feel very sorry for all of you who've had the nasty version of their approach.

Okay, last post on the subject. The British Columbia Better Business Bureau lists
Pomer & Boccia
212 4000 Steeles Ave W
Woodbridge, ON L4L1A6

Funny, that same street address for them seems to apply to Woodbridge ON, Thornhill ON, or Vaughan ON, or so various websites indicate. I also found sites listing a company named Pomer & Boccia, Barristers and Solicitors, so who knows; maybe they have a separate collections agency, maybe they don't. Canpages lists a Pomer & Boccia online at this address in Woodbridge (but postal code L4L4V9), in the LAWYERS category.

They have been bugging me for quite a few monthes, but I sent a letter to them by fax and by snail mail in the first week of july, and in the 2nd week of august I got a letter from them stating they have not heard from me and that they we're proceeding with garnishing my wages. Uh hello, I have a paper trail proving that they did make contact with me. I will seek legal advice if they are not actually lawyers from the address listed on their envelope, which might even lead to court proceeding for them.

Harrassed me for ages.  There a law firm that works as a collection agency.  A lawyer named David Boccia is one of the guys that own this company.   I settled because of how nasty they were.  Sent me a staitment of claim.   Wouldn't negotiate.  Very nasty people.

Their full company name is Pomer and Boccia Professional Group.

This Company harrasses phone numbers they have on file!!!

These people have been calling us for three years looking for someone we do not know.
We have repeatedly told them that we do not know of the person in question.
We have repeatedly asked them to update thier files to reflect this information and not to call back.
We had mentioned that this phone number has been in our name since moving into this location several years ago.
AND we do expect to hear from them again!

I will return the favor by listing their number(s) in all reverse look-up databases and search engines I can find... as time permits.

Skype call-back shows thier phone service defaults to USA.

Thanks to all, the webmaster and google for this thread, the net is such a nasty tool.., YES!

I was just doing some searches on youtube and came across this ontario lawyers website - his name is Mark Anthony Silverthorn , very imformative and I suggest you really look through it thoroughly, especially the website.

http://www.youtube.com/watch?v=313pF_wiVUg (youtube)

Lawyers website http://www.collection-calls.ca/

Q.Is it possible to avoid paying a debt due to the passage of time?

A.It might be possible to avoid paying a consumer debt, but not a debt owed to the government, in circumstances where the relevant limitation period on your debt has expired prior to your creditor commencing a lawsuit against you. Each province in Canada has a limitation period which forces creditors to sue individuals on consumer debts within a certain number of years. As a practical matter, once the limitation period on your consumer debt has expired it is very difficult for a creditor to successfully recover a debt from you unless you pay it voluntarily. Failure to pay a debt will likely have negative consequences for you in the future.

Each province in Canada has a limitation period for consumer debts. Limitation periods are not consistent in each province ranging from two years to six years. It is possible for a consumer to restart the clock on a limitation period by either making a partial payment or making a written acknowledgement of the debt to the creditor or the creditor's collection agent.

Each year collection agencies collect tens of thousands of consumer accounts in circumstances where the relevant limitation period has expired and the consumer is no longer legally responsible to pay the debt. Depending upon the age of your consumer debt and the province you live in it may be illegal for a collection agency to attempt to collect a particular account from you where the limitation period has expired.

If you want to learn more about limitation periods you might want to speak to Mark Silverthorn or buy a copy of this e-book titled A How-to Guide for Dealing with Collection Agencies in Canada .
