Debt Collector
Called about somebody I dated 20 years ago who apparently had a college loan debt. I guess they want to collect before she kicks the bucket lol! My number is unlisted and I assume my name was attached to her credit history or something. I'm glad I have no relationship with her.

This is a collection agency that also uses local numbers that you live in to make it seem like it is a local caller. They call back to back especially if you ignore their calls. They are rude and leave very unprofessional messages.

I have so far only received 2 phone calls, but knowing how debt collectors are I'm trying to nip this in the bud.  Neither of the people who called me and left a message could pronounce West Asset Management in a way I could understand it and I could only figure out who they were by searching with the phone number.  I have no outstanding debts that I'm not paying, so can't possibly be the person with the same name as me.

I too received a msg from a Mrs. Johnson? No company name given. Stated a returned call is needed? Ok why? Since i have no debt current or unpaid, nor have i applied for any credit why are you calling me????  And since you won't even state what company you are with, I will not acknowledge you.

You get their name and company's name. verify their address and first and last name. make sure you repeat it back to them. then let them know that all business matters pertaining should be Correspondence via mail. keep a record of the date and time. It is illegal to contact you again at your employment. Also file a complaint with FTC so it's on record outside of your records. If they call again that is a law suit.   Good luck on your job !

Leading Debt Collector Agrees to Pay Record $2.8 Million to Settle FTC Charges
A leading debt collection company has agreed to pay a civil penalty of $2.8 million to settle Federal Trade Commission charges that its aggressive collection techniques violated federal law. As part of its efforts to protect consumers affected by the struggling economy, the FTC alleged that West Asset Management, Inc. violated the FTC Act and Fair Debt Collection Practices Act.

According to the FTC?s complaint, thousands of consumer complaints have been filed against West Asset Management Inc., which employs 1,500 debt collectors in 13 states and one offshore location. West Asset Management debt collectors allegedly violated the Fair Debt Collection Practices Act by calling consumers multiple times each day, often regarding accounts that did not belong to them, and sometimes using rude and abusive language. The FTC further charged that West Asset Management also illegally disclosed the existence of consumers? debts to third parties and ignored consumers? written demands that West Asset Management stop calling them.

The company also allegedly withdrew funds from consumers? bank accounts or charged their credit cards without consent and falsely claimed that consumers would be sued, arrested, or have their property seized for nonpayment of their debt. In addition, the FTC alleged that West Asset Management falsely claimed that partial payments would be accepted as full settlement on accounts and that negative information would stay on consumers? credit reports until debts were paid. According to the complaint, West Asset Management has collected on more than 24 million accounts on behalf of clients in the healthcare, telecommunications, consumer credit, and government service industries.

The settlement imposes a $2.8 million civil penalty, which is the largest civil penalty obtained by the FTC in a debt collection case. The settlement order permanently prohibits West Asset from using false, deceptive or unfair debt collection tactics, including:

Misrepresenting itself as a law firm or that its collectors are attorneys;
Misrepresenting that debtors will be arrested or have their property seized if they don?t pay;
Threatening actions that would be illegal, or actions that the company has no intention of taking;
Making false statements to collect a debt or obtain information about a consumer;
Withdrawing funds from consumers? bank accounts or charging their credit cards without their consent;
Depositing postdated checks before the date on the check, or threatening to do so;
Revealing to third parties that a consumer owes a debt;
Asking a third party for a consumer?s location information more than once without the third party?s consent or a reasonable belief that the person?s earlier response was wrong or incomplete and that the person now has correct location information;
Calling consumers before 8 a.m. or after 9 p.m., or at their workplace;
Communicating with a consumer after receiving written notice that the consumer refuses to pay or wants the collector to stop calling; and
Using obscene or profane language, or harassing consumers with repeated phone calls.
Click here for information about consumers? rights under the Fair Debt Collection Practices Act.

The Commission vote authorizing the staff to refer the complaint to the Department of Justice, and to approve the proposed consent order, was 5-0. The DOJ filed the complaint and proposed consent order on behalf of the Commission in U.S. District Court for the Northern District of Georgia, Atlanta Division on March 10, 2011. The consent order was entered by the court on March 15, 2011.

This is a collection agency violating federal law.  Get their address and mail a letter and tell them to cease and desist.  It is illegal for them to contact anyone other than the person connected to the collection of debt even if they have erroneously targeted you for having the same name.  It is illegal.  You can also go online and get assistance from law firms that specialize in stopping these kind of calls, some charge only a small fee for their help.

I get calls from 315-627-7154 but they leave a message for me to call back on 888-872-0035.
And they say " you need to call as soon as you get this message "   Well....no I don't actually, I don't "NEED" to anything they say. If they want something that is important, send it to me in writting, so I can have evidence to submit in case it's a fraud.

I was given a message by my employer that I had two messages left for me.  I received the following message: 'call Shalonda @ 1-888-872-0035 ext 393' this was urgent business.  The second message read, "a personel business matter to call Shalonda @ 1-888-872-0035."  I just recently started this job and am subject to being terminated if this continues.  I was under the impression that debt collectors could not contact you at your place of business. Is that not true?  What can I do to stop this? This is an attempt to collect a debt of a student loan.

Apparently they didn't have MY number so they were calling my parents at all times of the day...6am, 10am, 4pm, 6pm, 10pm... Needless to say my mother who has a 16 year old daughter and is also taking care of her 96 year old father in law was LESS than happy. She gave me a number and an extension. I called...a lady answered and I asked for to be transferred to the extension I had. She refused, saying she could assist me. Fine, whatever. I talked to her and resolved the issue she was calling about. Or so I thought. The next day, a day I was finally going to get to sleep in before work and class started, my mother calls me saying West Asset Management called her. I was NOT happy since I had just "settled" everything the day before. I called back and this time demanded to be transferred to the extension I had. I proceeded to explain to the gentleman that I had spoken with someone the previous day and taken care of everything. He told me I hadn't. I was extremely irate at this point and he eventually realized that as always, the customer is always right.
