Keeps calling my number for a person who does not live with me and whom I do NOT know.  Have called repeatedly over the past year and a half to make them stop.  Today rep called me a liar and got real nasty.  Sorry, I PAY my bills and this is NOT my problem.

I have had calls daily from these people for the past two months.  I am soooo tired of it.  When I called them they were very rude to me as well.  They are looking for information about my sister-in-law, and though I asked them to take me off their call list, they have continued to harass me.

a man who was very rude called me threatening prosecution and accusing me of fraud in obtaining a loan. He gave me some information which belongs to my son. I told him that i was not who he was looking for and he became more rude when i would not give out any personal info on my son.

Finally, here's someone with the right advice and answer.  Know the law, do your research.  No one can sue you without proving the debt or without you being properly served.  And for the person whose wages are garnished, call the court and ask to see the judge and prove that you cannot live with the garnishment.  I did this and won, the garnishment was removed and I was reimbursed for the money taken prior to that point AND the judgement was vacated!
You ALWAYS have rights and appeals.  RESEARCH and investigate and keep fighting!!

I had the same thing happen but they did send me an email with an account that showed a different balance than what I owed. I called them back and gave the account # and the girl said that it was some other person's  account. Do they know how illegal that is to give someone a false document like that? Let alone, some other person's information? Who really wants to do business with a company that can't keep it together? Not to mention the horrible attitudes they all have.

The can't touch your money without a court order, and that takes a successful lawsuit.  Dispute everything.  Send them a cease communications order.  If they actually do decide to sue you it will be the judge who decides what a fair settlement is, not them.  Just don't blow off court.

It looks to me like there are a lot of collector trolls in this particular thread trying to frighten uninformed people.  The antidote to that is to inform yourself.  Read up on the FDCPA to find out what your rights are.  They MUST prove the debt is valid and that they have the right to collect it.  Until they do that, tell them to pound sand.

You should not have had a judgment placed against you, they can't prove you were ever served.  A decent lawyer should be able to get this overturned, if it really happened.

Your right they cant get your money from your account now. Now you have defaulted on an agreement with that office. If need be they can garnish your wages up to 25% depending on the state that you live in . It is not a scam. You owed the money and your just making matters worse by not paying. Yes you may have to pay extra fees yes it doesn't seem fair but what a lot of people don't understand is that any one who recieves a loan or credit card agrees to the terms when they sign the contract and a lot o people don't read them carefully.

Well why would you have not answered the phone calls to begin with? You are in an bad situation. A lot of people that owe money assume that it will just go away and it doesn't.People are also under the assumption that collection agencies are filled with horriable people but there not. When I cleaned up my debt last year I dealt with quite a few agencies and out of all of them I only had one mean rep on the phone the rest of them were willing to work with me. Your example is a perfect one . You ignored the calls and are now being garnished. It is a harsh step but it would have been easier for you to just answer the phone and see how they could have helped you out in this situation and now your being garnished. And yes they can do this and yes they probably will continue to garnish peoples wages for not paying what they owe. And unforunately for you you tried to contact that company after they already attached a garnishment wages and honestly why should they be willing to help you now. You didn't want to hear what they had to say to begin with. I would have to say the best thing to do with any collection agency is answer there calls see what you owe and try to work something out.

So I still have not received my email with all of the details of this matter. i called the guy and he said that it was confirmed it went through. Then he went on to try and rearrange the whole settlement. If I do this then he will send out another email. To me this sounds like a scam. I've been reading many different posts of people who have dealt with them and it's nothing good. I gave them my bank info so I hurried up and closed that account. Now they can't get my money. It just doesn't make sense to pay thousands more than the original balance. I've dealt with creditors before and they usually want to work with you, not dig deeper into your pockets.

I got a call from them last week due to an unpaid balance from 2005. I was willing to work with them right away because I'm tring to clean up my credit. Because I was willing, the guy waived a bunch of fees and made a settlement offer. It's double what I originally owed but what else can I do. I'm trying to figure out if it's a scam, being the holidays and all. If anyone knows anything, that would be helpful. My payment will automatically withdraw next week.

Well I consulted my attorney and he said I'm pretty much screwed.My mortgage is already 2 months behind and now with them garnishing 25% of my wages it will most likely fall farther behind.

I dont see how they will expect me to make a court appearance. I'm in the military and am stationed in Arizona. This happened back in Kentucky. I have free legal help. Can a lawyer do anything about this

Yeah, I was in a similar situation. If you DON'T show up for court, (like you) then they automatically win the case against you and can freeze your bank account. The reason why they want so much more money than what you borrowed is because everytime you don't pay them, they can and will add fees to the total amount.

They called me also. Said i owed a bank 371.11 and now i have to pay 1,874 bucks. They said they would garnish my wages and freeze my bank accounts if i don't pay. I have till the end of the month to pay it off or i go into the checks system. It sounds like bad news!! I wanna settle for a smaller amount but they wont let me. Or Payments!!!

I had recieved numerous nasty calls from this numbeer which I ignored.I googled the company name on the internet and found all these nasty things written about the company so I continued to ignor the calls.So on October 3rd i came home to find a summons to appear in court taped to my door.I thought a process server had to serve me in person so I thought this was just a scare tactic by the company and thought nothing of it.I should have been more proactive in this situation ,I got my paycheck yesterday and they are garnishing my wages.But i didnt even go to court? I called the county court house civil process division and found out that a default judgement was entered against me on 10/28 which i failed to appear the worst part is that the judgement is for $1956.75 on a cashnet account where I only borrowed $450.How can this happen.I finally called TRI-Financial and they are unwilling to make payment arraingements.If anyone knows how i can get out of this please post....HELP!!!
