Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

I Just got a call from Stan Bronstein stating that the call is regarding a summons that was sent to my home or work. (neither happened) and that it is going to result in my bank account being frozen for 6 to 8 weeks. No company name, no ID# no nothing. He gave a return number of 888-978-2620. I called the number back and someone answered stating Sam Bronson. Then called again and a "Chris" answered

Thanks for listing what happened to you, it's helpful when getting close to the same thing left on my answering machine. If you confirm your address then he now has your current address; he doesn't yet know it until you tell him. 2ndly, mailing Certified letters with confirmed mailing and even who signs for receiving your letter will document you telling him to quit any communications except via us mails. No calls, period. Keep a copy for your files. And list when , time of day, what post office you used to mail it out. List the time of future calls, names listed, brief message, date of calls. All this works to prove they are not following the Fed. and State laws when you write them to quit all communications except written via the US Mails. If they continue after you get the Certified confirmation card back, document all, and turn in to the State Attorney General; as they are suppose to prosecute this kind of thing.

Received call from this number. Stan Bronstein @ 888-978-2620; stating a Summons has  been sent to my residence and my work-[ no summons received at home yet, checking w/ work today]. Concerns my bankaccount will be frozen for next 6 to 8 weeks, so please call.  How come no company name, agent or rep ID #, or even what debt I owe to what named company? Collectors name all of these three areas. Doing a Google search now, might call from a pay phone and use another name to see what's said. Definitely asking who this 'debt' is connected to what specific company, their address, tele. and what his company's name, address, tele. is. And sending a certified Cease/Desist letter of no contact via my phones, only mailed contact. Recording all calls after this, and any contact beyond regular mail. Documented proof of their violating my Cease/Desist letter is enough to sue/ show the State Attorney General their behavior beyond the law. Even If I did owe a debt that quit calling me letter is enough to legally stop the phone calls.

I got one of these calls as well.  The number they called from was 877-762-4559 but the number they said to call back was 888-978-2620 and even gave me a file #.   This is a total SCAM!!  They said some documents were returned to them as undeliverable.   WHich is total BS because i get all the rest of my mail!  These people call with different scams every few days or so.  I never fall for them!  Unfortunately some people do!  These people should be beaten down and forced to get real jobs!!

message left on my phone yesterday, that it was in the best interest that they get a call back to tell them where to deliver paper work to and the name of an employer. Alright first of all who are you since you did not care to leave your company name. And who are you calling for since there are 4 other people who receive messages at this number. If you are a legit company you have both  the name of the person you are calling for you should know the name of the employer. I refuse to call them back and give them this information. If you are legit look it up and go ahead and deliver the paper work for the person you are looking for.

I had the same experience...getting all kinds of calls with my new number. This one sounded serious, so I thought I'd call to tell them that they had the wrong number.  The guy was VERY RUDE!!

I have been receiving threatening/intimidating calls from the number 888-978-2620 for over a week.  They leave various messages on my voice mail (I do not answer phone numbers I do not recognize).  They want me to call back 855-793-3214, which I have no intention of doing.  They indicate they are M&S and I need to call them to verify my address.  They indicate they are Sam Weinstein, and my current banking account will be compromised.  Today, I was so fed up, it was another "person" with a different message, but I just deleted the message.  They have called me at work also.  I blocked the phone number on my home phone today, but do not know what I can do about work.

I have taken out online loans, and my info is out there (unfortunately).  I have previously received calls from India (persons with American names)...and they had all my information.  So this is my own fault, and I am being careful going forward.  I have changed my banking info.  Unfortunately it is all very upsetting and wrong that these people can call and harrass you with lies about who they are, and what they can do to you.

I tried to make a complaint via the BBB today, but was unable to find the company M & S, that you indicated I should file a complaint against.  I will try again.

This automated service called this morning at 9:48 1-888-978-2620 leaving a message from Suzanne Lee about an arrest warrant and that she was from the state attorney generals office.  I called the number back and when I did a guy named Mike Wilson immediately said what number did they call, wanted to verify my name was I gave the number, then proceeded to ask me for the last four digits of my SS#.  When I refuse to give the last four digits of my SS# he immediately went into saying in a very nasty way "IT IS GUARANTEED YOU DID IT" when I ask what and what was the name of the company he began to cut me off.  Reading from some script that we can go back and forth when I only ask him two questions and being very rude when I said that as a consumer I had the right to ask these questions but he kept cutting me off.

Bottom line - any "company" who refuses to MAIL you (not email or fax) a debt validation letter proving you owe this debt to them is a scammer.  Report the call to the FTC, the FBI and your state's Attorney General.  Let the guy know when he calls back that per your attorney (even if you don't have one), you're recording all calls he makes to you for multiple violations of the FDCPA.

Wow... I get a phone call with an automated message saying I need to call this number back or I will be sued without having representation. I call the 888-978-2620 from a different line and the man that answers asks me what number his service called. I told him I didn't feel comfortable giving information over the phone without knowing who he is or what business the company did. Then he begins yelling and telling me how big his company is and all 15,000 of the people working with him can come down on me so if I know what's good for me I'll cooperate. I tell him if he will just give me the name of his company I will do some research and call him back. He screams a little more and spouts out a company that I couldn't understand and hung up.

they lie all the time state they are serving papers went online and no papers are on file and besides they would never be able to deliver paper to my work any way.  there is nothing listed on my credit report regarding this and I have submitted a report to bbb and to the the state attorney general for illegal collection practice

Just got a recorded message from someone claiming he is Sam Bronstein and needed to speak to me regarding paperwork that was signed for at my residence or my job (did he not know where these papers were sent?).  Said it would be in my best interest to contact him back or the result would be that my bank accounts would be frozen for minimum of 6 - 8 weeks. He never left the name of the company he supposedly represents. Get these types of calls all the time but first time I have been threatened with having my bank account frozen.  Never answer them
