Debt Collector
I have never had and pay day loan, I have never got any type of loan in my life. These people keep calling my house every day, I can't wait for them to come to my job, but I know that they can't because they don't know were I work, cause I think this is my ex-husband giving them my name and number, because every since he got out of jail, he has been giving everyone my number for and contact.

If they will just send me anything in the mail, talking about summons me in any way, they will be paying me.

I work for an law firm.

what really kills me about these posts is that if you google any collection agency in the country there are these posts about people calling collection agencies scams.what is even funnier is that YOU people all expect to get away with not paying there bills.so when these bills arent paid there is a ton of debt that is just sitting there that is uncollectable because YOU people are bums.unemployed welfare collecting bums.mcdonalds is usually hiring and 7.25/hr is better than 0.oh but wait its better to have the tax payers pay for ur dope cars and kids??the taxpayers are the true victims out of it all.

I received a call from one of their representatives following the same scheme as the ones stated above. I spoke with my lawyer regarding what happened and she stated that you can not have criminal charges filed against you for consumer debt. they can file suit against you in court to garnish your wages, or sue you for the money, but it is illegal and against the Fair Debt collection practices act for them to falsly accuse you of committing a crime, threaten you with jail time, state that you have broken a law, deny you legal council, as my representative did when he told me that I did not have time to call my lawyer. They also said that they represented a governement agency (sherrifs dept, or atty generals office) and since I had filed bankruptcy on my debt a year ago, they broke the law by contacting me and trying to collect a debt that was included in the bankruptcy...I suggest contacting an attorney if these calls persist. They are illegal and I hope that each one of you reports this collection agency to the Better Business Bureau (they also have an address on file for this company) and also report them to the FCC...the governent agency who monitors these companies.
If they continue with their blatantly illegal collection practices it is well within your rights to sue them.
Please become informed with the Fair debt collection practices act and know your rights.

This number called an uncle that has no idea of whats going on with me nor my debts. This is a total hoax. I do not write checks and the last name they gave him was a maiden name from 15 yrs ago. I know everyone is wondering whether or not this is a legit company. I received a call from them with the same exact tactics that everyone is reporting. I too freaked out and provided my bank account information after being threatened to be served at my place of employment. I mean come on how embarrising is that. I was too nervous at the time to try to find out if this company was legit before giving them my bank account information. During the time I gave them the information I asked them would I receive something in the mail cofirming they represented check and go and regarding our payment arrangements. I never did. They did take the money I agreed to from my bank account inspite of me receiving any written communication from them. So I called them and asked for the paperwork. I was placed on hold for them to confirm if they indeed mailed them out only to find out they never did. So I requested they fax them to me. They faxed a damn letter I could have typed up myself the same day that I called to find out why I didn't receive anything prior. I was pissed, so I called check n go myself to complain and spoke with their collections department. They looked up my account with them and confirmed that they did give my specific account to these bogus a** collectors who definately disregard ALL the FAIR DEBT COLLECTION PRACTICES ACTS to get the debt paid. They are a legitimate company as confirmed by check n go so if you owe check n go it's best to pay them. They do use bogus schemes such as jail threats, warrant threats and fake names representing county officials to get you to pay off your check n go pay day loan debt.

I too recieved a call from these people, they told me I owed an old pay day loan which I was aware of, it had been reported on my credit report. But the amount reported on my credit report and the amount they told me I owed was double! I called the actual payday loan company and they connected me to the debt collectors that were handling my loan and I set up a payment arrangment for the amount due (actually about a hundred dollars less) and they were very professional. I then called the "Check Resolution" people back and told them what I did and they said they would have their finance manager call to verify and it would be all taken care of. I really feel that this Check Resolution company is up to something fish and just trying to make money off the loans. I would suggest to everyone to first contact the loan provider or whom ever you wrote a bad check to first and try to handle directly through them rather than through Check Resolutions.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

They use illegal tactics because that is all they have.... a cival law suit is possible but very rare as it is expensive for them and they dont normally get what they want. If they serve you a legal summons or writ of garnishment the court will give you a chance to represent yourself..no worries

back in oct 2009 i received a call from a man claiming his name was seth and that he was a sherriff officer from check resolution service, inc and that a summons and warrant for my arrest has been issued for check fraud from a payday loan i got from 2 years ago,,so he said in order for the warrant/summons to be stopped i had to pay what i owed..he said i had to pay it in full and of course i didnt have the funds to pay in full..so i asked about payment arrangement of course cause i was scared..so i wanted to take care of this debt. so he requested my bank debit # or credit card # and i told him i dont have either one..so he said that i can go get a pre-paid debit card and call him back with the card # to give payment..so i asked about payment arrangement cause i didnt have the whole amount. so he said he'd have to ask his boss and the bank..so he placed me on hold, then came back and said the bank ok'd payment arrangement so i told him id call him back about 4 pm to make the first payment in the amount of $30.00 then every 2 weeks thereafter id call to make a $100.00 payment. so he said ok..so since this time ive kept my promise making all these payments..and recently i found out that this company doesnt even exist..so i dont know where my money is going..i thought i was paying off my debt..this company is on ripoffreport..the company name nor address exist when you try to google it..so now i had to cancel my prepaid debit card#, and i have to attempt to dispute all these payments ive been making to this so called company who i thought was legit..

its funny that you willfully take a loan outthen dont pay it back. if you were of such upstanding moral character and believed in do the right thing why have you made zero attempt to payback your loans! be real, im sure the tactic they use are questionable,but i guess reyling on you as to pay back your debt like an responisble adult is even more questionable. people do what they need to do in order to getthings done. the fact that you ccount is in collections says one thing you are a theif!! im sure the company that issued your pay day loan gave you ample opportunitty to work something out before they gave up on you and sold your account to collections. do not come on here crying about  they scared me, theyre so evil and unjust! pay your debt, show some accountability. i hope to god your not raising your children like that. as a matter of fact go to your kid and say "son/daughter, its completley acceptable to borrow money from a copmany and not pay it back, you do not have to own up to your actions, so next time you do something and no one see you do it, if your ever questions just deny it and hope it goes away!" im sure that the type of lessons you teach your children. i have debt like most other american but im paying it back! as much as i can, because i have some honor and my word is everything to me! we all go thru hard times, but when you borrow something you must pay it back!!

I got a call last week and now today. I wasn't avilable so they left a message saying the same thing as everyone else hase. Frist they left a message then my mother-in-law answered the call and got there information. She said a guy of the name Paul Richardson called from CRS.

Afer reading everyone's post these guys are really about to piss me off. I do write bad check and even if I did I would know it. ( not going to share becuase they may be monitoring this site). I already called to confimr that this is bugus.

I rec'd a voicemail from a "Patrick Bateman" claiming that he had an affadvit for a summons and to contact 888-995-0615 to see if we could get matters resolved. Mr. Bateman contacted my husband's job and left a similar messages with a co-worker. My husband then contacted this Mr. Bateman back and he claimed that he was calling from the county sheriff's dept to let him know he would be getting served today as a courtesy call. But he could try to call 888-995-0615 to see if it could be resolved. My husband then called and spoke with some "Ms. Potter" from Chk Resolutions and told him that he had to pay the $200 TODAY bc they couldn't stop the papers for him to get served bc they'd already been faxed. WTF!!! I used to work at an attorney's office and this is so bogus bc the process service don't call to give you the heads up.

I got a call from a guy "Jerry Shaw" from "check resolution services. I initially said "No thanks" when he spoke about the summons. Then he called back. In the couple of minutes between calls I googled them and found all of the info on this and other pages. I told him that I knew it was a scam and that if he called me again I was calling the attorney general and the police. He hasn't called again.

There was a msg on my home number about this same thing.  She indicated there was an affidavit issued, and even referenced a citation number and charges were attempt to defraud a banking institution!!!  Yikes! She didn't leave her name, but left this 888 toll-free number.  I've yet to call this number, but will call 'em back to see what the hell they're talking about because i sure as heck don't know.

My friend is recieving these calls but the thing is they are for me. They are telling her that she will be held crimally liable for any actions because she was a refence. They are giving out personal information about the account that is "owed" which is illgeal in the state of texas. If this was a collection agency they would not opperate this way. I txt my dad who owns a collection agency to ask about this he has yet to txt me back yet. Also when you google the name nothing comes up...HMMM makes you wonder bc most agencies you can google their name and find info about the company.

I received a message from Howard Goldman stating there were several charges pending against me for "passing of bad checks" and that I would need to call Check Resolutions immediately to avoid the matter being filed with the county.  He didn't state which county and he called from an anonymous number.  I was suspicious when he didn't mention the county name and then realized that the county constable never calls to "warn" you of an arrest that I am aware of....I would call this a serious case of false representation and I plan to pursue any legal action I can against the company responsible for the harrassing phone calls to my job and personal cell phone.
