Debt Collector
They have called me a couple times at work even though I have told them they could not.  Michael Rees  was the one that called and he said that since I  work for a public company they can call if they want.  He was very aggressive with me and when I argued that he was wrong he hung up on me only to call me back tonight and spoke to my boss.  He gave him all sorts of private information including who he was and why he was calling and that if I didn't call him back then he would turn it over to a judge and they would make a ruling without me being present ( all illegal) I  am contacting my states attorney general in the morning.

My employer got a call from someone claiming they were Anthony Martinez with Nationwide Litigation, and they wanted to know the policy on serving employees while at work.  My work did not confirm or deny that I was or was not an employee, and simply explained that our policy is to have matters like this handled at home, not at the work place.  I felt it odd that they would provide a toll free number to be contacted.  Usually if you're going to be served, they don't give you advance warning.  This guy even provided a case number.  I'm glad I looked up the number before I called them back.  I have since told my employer that if they are contacted again, to feel free to tell this man they are to cease contact at that number.   Ugh.

Debt Collector
I have been living outside of the USA for 16 years. My sister is being harrassed by these people for an apparent debt that is in my name. I have been advised not to pay anything, especially since there is no way  i ran up a debt when I was living in the USA 16 years ago.

These people called my place of employment saying they want to serve me "with papers".  I've gotten calls on my cell phone also with them threatening legal action if I don't pay them.  They never say for what the debt is, they just harrass with threatening to file against me.  Is this legal ?

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I received a call on VM that they are calling on behalf of a client and it would be in my best interest to call this 888-997-1223 before a warrant was issued and reference #32-00721. The person calling said her name was Olivia Clark.

And remember - the burden of proof is on the debt collector to show that you do owe a debt and that he can collect that debt.  Your caller is a scammer trying to scare people into paying bogus debts or debts already paid off.  NEVER pay a caller unless they mail - not email or fax - proof that the debt is yours and proof that they have the legal right to collect said debt.  Report your caller to the FTC, FBI, Dept of Justice and your state's Attorney General.

I just had a phone call from this number telling me that I owed 4 thousand dollars on a credit card that I had paid off 6 years ago. Never a bill, never a notice but they insisted that I was being sued and had until 5pm the following day to take care of this or they were going to put a lein on my house, garnish my wages, withdraw from my checking account, and other possible things were going to take place within 5 days. Whoever these people are, they need to be stopped.... I lost alot of sleep last night over this . Im just glad I thought to put this #no. in to see who it was

Some asshat named Michael Stone from a company called URG called my wife about a debt that is 14 years old. It is a credit card from before we even met. He was very rude and was threatening to garnish my wages. THis is BS for the following reasons.

1. It is illegal in the state of PA to garnish wages for credit card debt.

2. You cannot collect on a credit card debt that has been more than 4 years since the last charge

3. It is illegal for a debt collector to threaten with actions that they cannot follow up on, i.e. number 1 the list goes on and on. this is clearly a scam

They seem to be calling a lot of people here lately.  A friend who works at my bank called the number  to see if they were legit.  They got really indignant with her when she asked where they were located.  They would not give her any general info.  She hung up on them.

This number was given to me by David Levine with Nationwide Litigation Support. Mr. Levine does not exist in the area he told me he was operating from and Nationwide Litigation Support is a defunct company from California. The referral number, this one, led me to someone calling themselves URG. I think URG is legit, but the number on their website is not the number I was given. I called the URG number from the website and gave them the case number that Mr. Levine had provided. Guess what, it didn't exist. This is clearly a phishing scam. The rep I spoke to at URG, the real URG, told me they get this crap several times a week. Tell these jokers to go phish somewhere else.

They called and said they were going to issue a summons if I didn't call them back. They were trying to collect in a credit card I had 7 years ago. I disputed this and was told that verbal dispute wasn't good enough and they never received anything. The person I spoke with said I didn't need to send anything. They wouldn't give me an address and I asked he. To send documentation and asked for an address still waiting to get that information. They said I didn't have enough in my credit cards to work Luna deal. I said a deal for what?
