A message was left with my mother-in-law that this Susan Cohen ext 204 stating she was from Dunn County and that I was a person of interest. I called the 904-374-7445 and the person who answered said, "Processing", I ask for ext.204, the phone rang and rang. I called back to ask where it was I was calling, what business or agency or what, and the girl said she was just the answering service and Susan was gone for the day to call back tomorrow, and I ask her what the business or agency was and again, she said, "I am just the answering service" and I said, " Well, you should know what business you are answering for." She said, " Can't you just call back tomorrow?" and with that she said, "Have a nice day" and hung up.

Received a call from 1-904-253-3032. They left a message to call 1-904-374-7445 ext 20210. In the message it said it was a Madison Lewis calling and it was about Legal Service to process and I had a right to have an attorney present. Upon checking this number on the internet it gave a name of Ron Mosley in Jacksonville FL 32256-2961. Listed at this address are Baymeadows Apartment Movers, H A Yeargin & Assoc, Intergration Services Group and Stonebridge Village Masters. They left no name of a bussiness. I acan only assume that it is for Debt collection of which I don't have any outstanding debts. I am not calling any 900 number.

I've been waiting for the sheriff and I ain't seen him yet. Lol. I have filed a claim with the FTC and have contacted a lawyer to see about suing these outlaws. Just wondering though, what does this company do after they claim to take legal action against you? Do they still call? Anyone have them still harassing you after the "deadline"!??

I can totally relate to the emotional stress this company causes. I am disabled with three children. My family recieved calls from a Brian Thomas stated that I was a person of intrest in a criminal activity. When my step father asked for a company name and what this was about. After that Brian Thomas said if he was not going to help with this situation he would not give any information. He said how can I help her if I have no idea what I am helping her with. Then he was hung up on. I returned his call right away. When I got a call back from him. He said that I have a bad check. I told him I would love to resolve this matter. He told me I need to pay $1,000. by noon or I can enjoy my time in jail. I requested a bill, statement, and check number. He then told me that he is not sending me that information, it is my responsibility to handle my obligations not his. He was telling me that if I think I money difficulties just wait until I get out of jail and crimal charges aginst me. It was a long conversation. I began to cry and he started yelling telling me that I am pathetic and a bad example for my children. He tore me down then told me I was scum and hung up me. If I am responsible for this check I was more that happy to take care of it. He kept telling me I do not want to honor my check. I told him I did want to I just wanted a statement of some sort. I can not believe that a reputable company would behave in this manner. Also, to top it off he specificly said if I know anyones credit card number I could give that to him and he would hold it until I had time to notify them of the charge. And I am the one that should be ashamed of myself. He also said that the only thing that he would mail me was a refusal to settle letter.

This company caaled my parents home, my daughters place of business and my home threatening that they would arrest my daughter for not paying a bill.  First off, she has no debt, and secondly, the person who called was arrogant, abusive and very dififcult to understand.  If you get a call from these "flea bags", record the call and then present it to your local police, and file a complaint with the Better Business Bureau.  This nonsense has to stop!  The number is registered to a Ron Mosley in Jacksonville, Florida and the number is 904 374-7445.

Debt Collector
I am reporting this number to the Better Business Bureau and to my lawyer.  I, too, have received threatening calls at my work and messages have been left with co-workers that I am a person of interest for writing fraudulent checks and may face charges.  I spoke directly with a Sean Blackwell at this number and his supervisor, Brian.  I, too, was told I owed $783.26 and could pay this amount within 2 hours through moneygram or face charges and have to pay $1,700.  I advised this company to stop calling me at work and attempted to give them my lawyer's number to call.  They refused to even take down the number.  They say they are not a collection company and claim to be private investigators so they can say things on the phone and leave messages that would be illegal if they were debt collectors.  They have now contacted my daughter and told her they would be confiscating my property in Florida if I do not pay immediately.  I have never lived in Florida and do not own property there.  They are located in Florida from the phone trace I did.
This company appears to be a scam.  I asked them to either mail me or email me the details and they refused.  They just continued to threaten me.

This person by the name of Brian Thomas presented himself as a criminal investigator for the Bad check and fraud division that represented the state of Arizona. After further research I have discovered that he is a Debt collector from NCP (National Check Processing); not a Law Enforcement Criminal Investigator as he portrayed himself to be on a telephone message. I did contact this person Brian Thomas@(904)-374-7445 ext. 206 and proceded to ask him what organization he was from and what his message was in regard to. He would not give me any information and he began to ask for personal information from me without identifying himself. I find this person Brian Thomas' tactics to be quite disturbing, down right deceitful, and invasive. It is ironic how he represents himself to be from the fraud division. That is exactly the nature of his tactics fruadulent. Lucky for me I recorded his message and our conversation.

These collection tactics are HIGHLY ILLEGAL.  No debt collector can just call and demand you PAY NOW OR ELSE.

FROM FAIR DEBT COLLECTIONS PRACTICE ACT!

What practices are off limits for debt collectors?
False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives; (using the term Investigator)
    falsely claim that you have committed a crime;
     misrepresent the amount you owe;

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;

THEY ARE REQUIRED TO VALIDATE THE DEBT! Prove you owe it, and provide ALL information on the original creditor, balance due and HOW YOU CAN DISPUTE THE DEBT.

They use these ILLEGAL tactics because THEY CANNOT PROVE ANYTHING! - They want to SCARE you into PAYING THEM WITHOUT QUESTION and they do want you to DISPUTE IT

THE CORRECT WAY TO HANDLE COLLECTION CALLS AND ILLEGAL TACTICS
HANDLE IT CORRECTLY AND THEY WILL END UP PAYING YOU

From Federal Trade Commission Website ? FAIR DEBT COLLECTION PRACTICES ACT
Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

I got a phone call this morning at 7:30 a.m.  The message sounded very garbled (like a cell phone with a bad connection) but then the name and phone number was very clear; I was told to speak with "Officer Morgan" before 1:00 today.  I called and "Officer Morgan" told me that someone was being investigated for fraud and she named off several names, none of which I recognized.  The telephone call scared me. I thought a family member had been in an accident or something, receiving a phone call from an "Officer" at 7:30 in the morning.

Hello,
I received a called at work from NCP debt collector.  She began to tell me that I needed to pay $537.53 today before noon, and if I didn't pay before noon then I my file will be turned over to Harris County for internet and check fraud.  I explained to her that I did not have the money today however I am willing to make a payment tomorrow and set up payment arrangements at that time.  She told me that they can not go on my terms, the final terms stand as is. She advise me to ask a friend or family member to borrow the money, and ask my boss to take off so I can clear up the matter.  I explained to her that everyone I know is having hard times and can not afford to lend money, so the best thing I can do is make a payment tomorrow before noon and set up the arrangements.  She proceeded to tell me that my files will be turned over to Harris County and I will be arrested and lose my job.

There are no longer Debtors Prisons and they can't squeeze blood out of a turnip. If the company you owe wins a judgement in court, they have to work out a payment plan. If you have nothing they get nothing. But, you don't have to take abuse from anyone.

Had this company call the park manager's office where I live. The lady that called said she was Investigator Winchester. She proceeded to tell the manager that she was looking for my daughter-in-law as she was a person of interest. Acting like a police investigator. The park called me and left the number for me to call. I googled the number and found out it was this collection agency. Scared me and my family. I called them back and got voice mail. I told them on the voice mail to never, ever call this park or my residence again with the exception of having Investigator Winchester call me back so I can personally tell her that. They are just a collection agency using illegal scare tactic's. This is against the law. Report them to the Attorney General, The Better Business Bureau and, tell them to Cease and Dessist calling you. If they persist you can sue them. All these companies who you owe money can do is either sue you or turn the bill into the Credie Bureau's. You don't have to put up with this type of abuse.

I had a similar experience today.  They gave me two hours to make a payment or I would be processed.  Even claimed to be calling from my county's office and the paperwork was being filed.  That I committed internet fraud across state lines and some other charges.  Notified me that once I made a payment through money gram to call them back so that the legal paperwork could be sent to me via fax or mail.  If by mail I would have to sign for it personally and if I was not available would have to pick it up at my local post office.

If I did not make the payment they would track me down at my job and I would be processed.  The person who called me was Susan Cohen.

I am documenting everything they have said and will be contacting the appropriate complaint centers.
