I have gotten may calls from this number about Sears Master Card.  I have caught up and have not been late in three months, but I still gets calls from them.  The calls come in a series.  It doesn't matter if I answer the phone, because sometimes I am told no one is available to talk to me.  This is really discusting that debt collectors and act this way and there is nothing that can be done about it.

This machine calls me and says they trying to collect money.  They say that what I say will be used to collect the debt.  I wait while this call transfers me to some operator who says I own money because I am late on my car payment.  I am 78 years old and I don't drive nor do I own a car.  It doesn't matter this machine just calls me and calls not every day but certainly several times a week.  When I talk to the operator they tell me that their records show I owe them money.  This has gone on for a very long time.

Here's how to stop them:

Per the FDCPA (Fair Debt Collection Practices Act), they have to prove that you owe the debt they claim you owe or they get NOTHING. Don't let them tell you otherwise. This is the LAW. Once you send them this letter VIA certified mail with return receipt requested, they have five days to respond. If they don't and continue to harass you or file a lawsuit, you can sue them for statuatory damages:

(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state)
Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.
you do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA;
Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

I have been getting calls regularly.  They say they are trying to collect a debt in regards to my Sears Credit Card.  I don't owe any money on my Sears Credit.  No matter what I say, they do not stop calling.
I wish I knew what to do about this.
