Are you serious --- a "dangerous" job?  What about law enforcement, judges, attorneys working in family law, and child protection services.  Funny, they have physical addresses.  And I might add that most collection agencies (love em or hate em) provide a physical address

Guess thats all you have to bash them with. And I may be wrong but that does not prove they are a scam. Hhmmm. Its wrong to confuse the public and convince them of a scam outfit if they are really not, just saying you should be sure before directing traffic the wrong way! Collections gig is dangerous I dont blame them for keeping physical address secret.  They have already given us all the information we requested. My brothers a lawyer and spoke to them and their lawyer. He told me to pay the balance $900. I almost did not because of this site. They had no problem giving my brother their address. I dont get it guys if you need their address just ask for it. Lol

All of our letters and Attorney's letters that we utilize as debt collectors are completely compliant with FDCPA and California's Rosenthal act. I am afraid you may be confused or mistaken and any issue that need clarification may be addressed directly with our primary attorney Edward Weber with the law offices of Edward T. Weber via email.

What I know from attorneys representing creditors, is that you are claiming there is an outstanding debt, therefore, YOU have to provide proof of such debt.  If you cannot, the debt is not owed by the alleged debtor.

Address
P.O. Box 332.
Upland, CA 91786

Most likely a mall rat/kitchen table debt collector.  No physical address.   PO Box only.  Which means most likely they're working out of a run-down house  somewhere near Upland California.    I doubt if they associate with any attorneys.

Dear Mr. Martinez, I have clients that have showed me letters received from your office.  Too bad it was not compliant with the FDCPA or California's Rosenthal Act.  I question your utilization of a public forum to solicit communications regarding a debt.  Will see you in court.

*Please note that this is an attempt to sue a debt collector and any information obtained will be used for that purpose.*

If they do, they should pay it.. to who they really owe. But never to extortion scamming made up debts ever or to a company that has no title and does not actually own the actual real debt ! DC's must provide debt validation as per the FDCPA laws. No exception.  And if they are legit, they should not have any problem giving a legal verifiable street address and legitimate information.

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

OMG! This company called me at my place of employment, left a message, called me twice on my cell phone, called my mother in TEXAS! Irony of this is I have no idea how they got her telephone# it is fairly new. At any rate I called them to get the information that they claimed to have sent me. His response was we sent it as a courtesy and don't have to re-send it again. He also said that I will be getting sued and getting served next week at my place of employment. They wanted my fax# I told them to send it to me again, he refused. I told them I was filing a BK and he said a BK wouldn't do anything to stop this because it's already been submitted to my employer for a wage garnishment. Come to find out it was about an old Credit Card from Orchard Bank. I don't recall ever having a credit card from Orchard bank and if I did, again it was possibly 5-7 years ago. Amount due now they state is $1100.00! Completely ridiculous.

They called me today over a pre-paid credit card I had with Wells Fargo 4-5 years ago. I pre paid an amount of $800, used it for awhile, paying the total off every month then had no more use for it when I got laid off (I still have a Wells Fargo checking and savings account). I used my money for bills and never looked back. These fine upstanding pillars of the community began to inform me that I owed them (I forgot the exact amount, but around) $1300.00 for the credit card and another $1200.00 for their fees. I might have started with a chuckle or maybe it was the tone in my voice but after he told me they would garnish my wages and take my property (I have a hard time taking these people seriously) he hung up on me. I wasn't done. See, you've already interrupted the pulmonology paper I was writing on restrictive diseases. I call back and he starts his little "all the legal ramifications" ect. When he's done I told him I was recording the conversation..."well none of that can be used in a court of law" (obviously a guilty response) I simply responded with, "I know, I just wanted to see what kind of establishment I was dealing with".
P.S. I am posses at Wells Fargo for this as well.

They called me at work. got my information from secretary. They threatened me with using words like "sue" "court" "judgment" then started to speak very aggressively. then I told them that it's illegal for them to do that, and they can not call a place of office and discuss my information with other people. he replied to me "we can, and we will do whatever we want to do". Then I told him not to call back! He threatened me by saying "do you want us to come after you?" I told them that if they call again, I will sue them. He slammed the phone.

Tam. was kind enough to pass your message on to me. I will NOT be e-mailing anyone! For more than obvious reasons.
This thread more than exposes the bottom-feeders using this number. Read T.s response & look through the links that she has provided. The knowledge of your rights is your most powerful weapon when dealing with smoke-blowing Junk Debt Buyers & their minions. Hot air & BS are the fraudulent/ bogus debt collectors only tool.
If you choose to speak with these SOBs again, tell them that all your calls and VMS will now be recorded & passed on to a consumer attorney. DEMAND a notice of validation be mailed to you. NOT e-mail or fax! DEMAND their actual physical location. NOT their PO box! When they refuse to comply, tell them that their refusal has been recorded & that the recording will also be forwarded to your attorney.
By all means, record any calls from these cretins. To avoid any legal entanglement, immediately tell them you are doing so upon answering the call. I'd say that it is a 99% probability that they will immediately hang-up. Which will be proof positive that these cubicle-clowns are nothing more than fraudulent and/or bogus debt collectors attempting to collect on an invalid, time-barred or purely fictitious debt.
Be Safe. Be Aware.

Hey Gunnar- I got a notice about 2 weeks ago from this Law Offices of Edward Weber, supposidly representing this debt collection called Western Portfolio assets, Inc.  I had a card from Orchard bank, approx 4 yrs ago, the limit was only $300. I get this letter that states its $737.00.  If I dont contact them, legal action will take place.  During this time, I was contacted by my step daughter informing me that this law office called her and left a voice mail looking for me!! She saved it and sent it right to me.  Then, my distant brother of mine contacted me and said that this law office was looking for me as well!! This is not good....I never, never gave out anyone's phone number....im assuming they are pulling up all the last names I have and just random calling those.  I did call them back, totally against my better judgement and was told, "well, your notice says its for $737.00, but its not $1,092.00!! We tacted on another $350 for filing and processing"  Inorder to stop the attorney from filing a judgement against you, you will have to pay 1/3 of this to show good faith, which will be $364.00!! I was literally exploding inside....he then said, "well, I can give you til 3pm today to call me back to let me know what your going to do".  um, that was only 1.5 hours to come up with all that money??!  now, first of all, I have NO signed agreement with any third party!!! It was Orchard bank that chose to "sell off" my $300 debt.  Getting threated with lawsuits and judgements and Bill Taylor (name of man I was talking to...well, he was talking at me) informing me that I will also have to pay all the court costs and attorney fees......I am literally pissed.  I am wanting to have a consumer attorney look at this issue I am dealing with.  1. Contacting members of my family looking for me and informing my family members they are a law office looking for me.  2.  Bill Taylor telling me that i have to pay $364 to stop any filing or any judgements against me,  3.  informing me that I will end up paying for all the attorney fee's and court costs and that I will have a judgement against me.

Gunnar....any assistance will be great....email me at fxy71@yahoo.com to any help or ideas.  I will not allow this to go on any further....I know that this Bill Taylor has broken the law along with those in the office contacting family and non family members.

Ok, so I too have received a letter from some Law Offices of Edward Weber stating their client is Western Portfolio assets, Inc.  This is an old debt from Orchard Bank, approx 4-5 yrs back. It was for $300.  Then I get see this amount of $736.98. I was in the hospital dealing with breast cancer, opened up this letter and it states "you are indebted in the amount of $736.98" Geesh, I never signed a contract with them!!  Then the letter states, "Please be aware that in our capacity as attorney for Western Portfolio Assets, we are a debt collector attempting to collect a debt. the law gives you 30 days after you receive this letter to dispute that validity of this debt or any part of it. if you do not dispute it within a period of time, we will assume that this debt is owed. If you dispute it by notifiying us in the same period, you request in writing the name and address of the original creditor, if the original creditor is different from the current creditor, we will furnish that info to you as well."  If you would like to discuss settlement of this matter, dont hesitate to contact us..

So, i call yesterday.....I was told by some idiot that now that amount owed is $1,092.00!! They tacked on another $350 for "processing" and "filing".....he then informed me that I had until 3pm, which was less than 2 hours to call him back to pay up 1/3 of the money which came out to $364.00 to "show good faith"....what the hell???  I was also told that a lawsuit was to be filed and then I would encurr all the court costs and attorney fees....

That makes this even worse....apparently, my step daughter got called looking for me and telling her "this is the law offices of Edward Weber, we are looking for Kristi Ricks"..... she didn't answer of course, though she sent it via cell phone on a recording.  Then my distant brother informs me that he also got called April 24th looking for me.....totally different last name....

In California, i believe there is a time limit of 4 yrs from time of old debt.....i know my $300 debt has been sold off a couple of times.....

any advice from anyone out there???
