Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

I will admit Ive called these people over 100 times and 95% of what I have said has been very racist to indians, middle easterners, iraquies, arabs, and the aladdin franchise.. I just want to say these races arent all bad.. Dont hate them cause they are from india.. hate them cause they are scammers, rude, annoying, and racist towards americans, and sexist to women, and cause they talk sexual to 6 year olds.. Be racist to them but dont look at every brown skinned dot head like they are a telescammer or phone terrorist.. One of my good friends is from india and he hates these guys like the rest of us.. Hell where do you think I learned all my racial insults?? my indian friend.. so I admire your enthusiasm and your heart is in the right place,, but say more about them than they are indians cause thats not the issue..

You are a good person.. Im happy people like you exist.

These people called my wife 18 times before 7 am and about 50 times til 9pm.

I was disabled in a car accident so have nothing better to do than mess with these guys all day and record their fowl language and poor broken english insults and terrorism threats.

Ive told them Im recording every call.. The guy told me he was "agent james smith of the fbi" he also told me he was "911 emergency number",, He made 9-11 jokes.. He also said "you see news? we use chemical weapon on whole america next"

Later last night I tried to be friendly and give him a play by play of Big Brother.. He kept asking me to "go to a bathroom and get naked and kiss one girl"


Im on day two of bothering this jack***.. I keep blowing air horns when he call and doing electronic feed back.. it seems to be getting to him.. But the longer I stay on the phone the less he can bother all the innocent victims of these telephone terrorists.. Its not much but I hope what Im doing prevents these scammers from being able to call people

I WAS DESPERATE--

I applied for a loan online and I was contacted by the company who said that I was eligible for a loan from $500 to $5000 without a credit check. I accepted the $5000 loan amount because I was in debt to Philadelphia Gas Company, PECO, Landlord, and car loan payments due to back payments piling up after my  car accident injuries took me out of work. I tried to keep up but I could not catch up because STD decreased and there was not enough money in pay to cover all costs.

The company is called PAYDAYONE LLC on letterhead but the e-mail address goes to USAPAYDAYLOANS. MAIL.COM.

I was asked to send $201 for the first loan installment, which will prove to company that loan could be paid back through GREEN DOT MONEYPAK. Once the money was given I was told that I could not get the loan because I had to go back to Wal-Mart to obtain another GREEN DOT MONEYPAK in the amount of $359 to pay for the person-person loan between Bank of America and my bank Wells Fargo.

My daughter provided the finances for the 2nd payment and the Senior Finance Rep Manager, David Oscar advised that the IRS contacted them by e-mail and advised that I have to pay an additional fee which was requested by the IRS in the amount of $400 because of my credit score. I told the manager that I did not want to continue with the loan and want to withdraw my application and I was told that I could not get my money back because it was in process.

The money was taken from the GREEN DOT MONEY PAK within 15 minutes both times while I held on the phone because they were verifying my transaction. I was even sent an e-mail receipt advised that the funds were received and a balance due for $400.

The address for this company is supposed to be located at 4150 International Plaza, Suite 400, San Bernardino, CA 91335. #1 909-703-2000.

So I called them back and told them that my financial officer at my bank said to send the last installment by Cashier?s Check which just as good as cash and they told me that they could not accept that and asked me why did I want to change the rules. I said if you were legit than you can cash a cashier?s check; but because it is traceable they refused; I was told by ?Jason Hedges,  Senior Account Manager? that he could not help me and my money will be stuck until I paid the IRS fees in the amount of $400.

I was desperate for 5000 $ loan. I applied online for a loan. The next day they called me and confirmed the loan request. These mother f****rs Indians. I hate them. They made me believe on them and purchased 231$ as process fees. So I did send them the money through a green dot money pak. Then they said that they released the funds but my bank put it on hold, so I have to send them 299$ process fees. Thank god I did not do it. One of them is LUCK JOHNSON and the other one is MIKE PARKER. I learned my lesson too. Never trust anyone phone call again.

They was honsety people right  they just want your money. They go back Luke Johnson and Patrick i do not his last name. So they might change their name now. I have learn my lession.

I got 32 phone calls from that number yesterday. 32!  No messages though. I called the number and could not understand what the man who answered the phone said. I asked him to repeat himself and still didn't understand. So I hung up. I received 2 more phone calls today. No messages. Good to know it may be a scam.
