I just got a call called the number and asked what charged where pending against me and they said the sheriffs should have called me and I said no and if this was true they would have he said in sending sheriffs there now and hung up

A Richard Smith keeps calling me from different numbers. The first 15 were from Alvin Texas, then the next 10 were from Elk Grove, Ca. He threatens me with legal documents and then reads a big long spill about I'm going to be arrested. At one time he offered me to settle this for 486.00 on a green dot money pak card. He was asking me if my husband had knowledge of my criminal back ground and if I was still on probation and when was the last time I was arrested. I've never been arrested or had any run ins with the law or probation. It's scary and I'm tired of this person harassing me. I had to go to my doctor bc I had a panic attack which caused high blood pressure and I was so upset I wrecked my car. It's to the point of ruining my life and someone needs to stop this.

I got a call from this number 2 weeks ago stating he was Richard Smith and I owed charges that I was going to be served papers and go to jail. I was freaking out all the way up to the point where he put me on hold and offered me a deal for 486.00 but it had to be paid by a green dot money Pak. Ding ding the lights came on. It's a scam. Well they r trying again bc they called 6x today and I did a number search and they hacked these numbers 916-244-2083 916-244-1385. Be aware this is a huge scam. I asked them to fax me over something showing what I owed and the company and I was hung up on. It's scary but it's a scam....

I received a call on Thursday morning with the voice of an India gentlemen.  He asked me if I was the name and that something on my social security.  I said I could not talk now, but gave me this number.  I did say I would call in a hour.  However, I had an an important doctor appointment and I had to leave work, but I was very anxious.  This happened to me in July 2013 and I tried calling the number back.  I don't know who it is but they said some office and some last name by Belowski.

As like everyone else, I also get the same repeated harrassing phone calls over and over up to 20 times a day, even minute by minute, repeated numbers appearing on my msg. center.  From either "Brandon" or Richard Smith, calling from State Attorneys Gen. office...I've received at least 60+ calls this week alone, therefore, turning my phone off so as not to even hear it at this point. My grandma of 96 years died this past week, and not only coping with losing her, I'm now dealing with telephone 'freaks of nature'...with all the hackers out there, you'd think 'some brilliant mind' would come up with a solution to 'pinpoint' these BOTH phone/internet criminals, and maybe they might even earn a few bucks for it, but until then, reporting these numbers is about all we can do..I am on the "Do Not Call Registry List", however, that does not seem to stop these jerks from their attempts to ruin our lives...how miserably they must be to do what they do...

They have been calling and harrassing us for a week now! When you call back the number and block yours they do not answer. These people are ridiculous and they are the ones that should be arrested. Identity Theft people for sure! Trying to scam innocent people out of their lives and money...

Just got a call from Edward King Marshall from this # 916-469-8824 & 916-469-8829. Stating he was from State Attorney General Office and called  6 times. Saying that I needed to contact him as soon as possible. So I called back, he said  I have a law suit against me because my social security # had Federal fraud relate charges associated with it, He even gave me the last 4 digits of my social security #. He said that I had to either pay the amount due $2500 or I'll be arrested today. He even gave me the last 4 digits of my social security #.

This guy called me saying he was attorney general, and told me to shut my face and be ready to be arrested. I really couldnt understand him but he did state I would be arrested right now because of social security fraud. I told him stop calling but he won't! he calls my job and home constantly

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. Just got a call from Roy Miller from this # Stating he was from State Attorney's office and called my work 6 times saying i needed to contact him as soon as possible or i was going to have criminal charges pressed against me because my social security # had fraud relate charges associated with it and my name. i reported him to State Attorney's office who said that they have no one there by that name. this man needs to stop harassing me and my co-workers.
i wish someone could find these people and make them pay for the crap they pull.
