According to federal and most state fair debt collection acts, it is ILLEGAL for lenders and collection agencies, and anyone working for or on their behalf, to tell you that you will be arrested for this or any other debt, even if you actually owe the money.  They will claim that they are about to or have filed check fraud or hot check charges against you; I have researched this matter thoroughly ( I am a non-practicing attorney - however, the info I am giving is not legal advice; it is based on research done as a common citizen consumer; you can do the same research easily on the internet).  Only a district attorney or court clerk can file a criminal hot check charge or criminal fraud charge against you; the company cannot.  They have to go through the DA or Court, and you will receive written notice first before they file.  However, No district attorney or court has or is going to accept and file a hot check or check fraud charge against someone for non-payment of a payday loan.  Remember, one of the reasons we had the revolution against the English is because we wanted to guarantee that no American citizen would ever go to jail based on a debt (debtor's prison as it was called).  These payday loan collection companies will insinuate that you are being brought up on fraud charges, which is another lie.  They could sue you civilly for fraud, however, please note that they are after money, and it would cost so much money in court costs and attorney's fees to sue you, obtain a judgement and then go after your assets to seize by the judgement, that they usually won't sue someone unless (1) they owe more than $5000 to $10000 and MOST IMPORTANTLY (2) the person has assets to seize.  It would be a total waste of money to sue someone and obtain a judgement when the person has no assets, and probably never will, for them to seize.  Further, a person is allowed a certain amount of real and personal property to keep as exempt assets, depending on the state and the type of debt (IRS, child support, local government taxes, etc. can maybe latch onto these otherwise exempt assets), however, a judgement for a payday loan cannot seize exempt assets (again, do the research, it depends on the state you live in).  These people will claim that they are going to come and serve you - let them.  Even if they do show up, they are not showing up to arrest you and secondly, they would have to file a lawsuit to serve you with the pleadings, otherwise, what they are doing is merely giving you a letter, which means nothing.  Keep it so you can possibly use it as evidence when you sue them for violating the fair debt collection act.  If you are getting calls threatening you with criminal action, please go to or call you attorney general's office in your state and ask to file a claim with their consumer affairs division.  If they don't take such complaints, they will direct you to the agency that does.  Also, contact you local and state representatives and senators as well as your US Congressman or woman and US Senator.  They have a staff of assistants whose sole job is to help their consituents, like you, against such unscrupulous companies.  Remember, the collction agencies want to scare you, however, their bark is much bigger than their bite.  You don't have to answer their calls, and write to them and ask them not to contact you at work, not to contact your boss, and to only correspond with you in writing.  File a complaint, remember, politicians and the public hate payday loan lenders.  The power is on your side!

Here's what I've found sometimes helps deter scammers and/or debt collectors who call and leave a message without saying anything (which they do deliberately to increase the annoyance):

If you get a call from their number when you're available to answer the phone, answer it. Then immediately mute the call, put the phone down, and wait until they hang up. That way you annoy them right back, they don't get to leave a voice mail, and it increases the time (and therefore money) they have to spend on you without even getting to talk to you.

You can try variations, such as asking who they want to talk to, telling them you'll go get that person (even if it's you, and even if it's your cell phone - they don't know that), then leaving them on hold indefinitely. If they hang up and call again, just answer, mute it, and lay the phone aside.

If they're going to play games with you, you can play games right back - and win!

I am called daily by this number at home on my cell phone as well as on my business phone claiming that I owe 500 on a payday loan.  Even awaken by them while resting as well.  I am so sick and tired of it!

Keep calling my work for someone. Never leave a message or anything. I called them back to today at the number, both the people I talked to sounded high as all hell. just tell them there is no way for them to get in contact, you'll leave a contact number for the person they are trying to reach (even if that is you) They will take you off their list. Did this today, praying it works :) they normally call up to 5-6 times a day :/
Just lie and tell them you never heard of that person and you would gladly like it if they would stop harassing you and your business (even if its your phone number, tell them its a professional business)

i received calls from this number also and I don't answer because I don't recognize the number. The calls start around 8:30 am and continue througout the day, each time no message is left.

This number always calls me bewteen 11am and 12 noon every single day. I don't answer and they never leave a voicemail. I would think if its something that is really serious or important, they would leave a message. If no message is left, I take it as not important!

I kept receiving calls from this number looking for someone I dont know as well.  I finally called back the phone number that they left on my voicemail, which is 1-800-639-0767.  I explained that I did not know this person.  The lady I spoke with was very nice, and only asked if I knew the person and could get a message to them.  I told her I couldnt.  She apologized for the calls and told me they wouldnt call my number back.  I havent heard from them since.

These forums are so helpful.  I've been a victim of these calls for weeks now.  It's always confusing and a little scary to be harassed by people who know too much about you.  Through helpful posts like these, I have become aware of my rights, and demanded they send me written proof of a debt or stop calling me.  They always say "I'm sorry, I can't help you then."  GOOD. Be on your toes, and never give them any information!  Most legitimate companies will not operate this way, and will almost always send you written proof of a debt before they start calling.  Thank you, everyone!

This number continues to call my place of business and hang up, all day long.  I have spoken to someone, and it is in regards to someone that does not work here.  Her name was Stephanie and said she could not guarantee to take us off her calling list. Why? Where is it going to get them calling us for something we do not have.

This number calls every day for an employee of ours, and when we politely inform them, "Sorry, our employees don't accept calls at work," they quickly retort, "I'll leave a message then."  We have to inform them that we do not take messages for our employees, either.  They will need to reach the employee at home.  Then the sarcasm comes out.  "Great."  "Fantastic."  "Whatever.  Thanks."  I understand these people are doing their jobs (whatever it may be because they do not ever identify themselves), but our employees are doing theirs, too, and they cannot be interrupted.  When the number called today, I immediately asked to speak to a supervisor.  The caller asked, "Why?" and I replied, "Well, as I have told your company every day this week, our employees do not accept calls at work, and we will not take messages.  This is now bordering on harrassment.  I'd like to speak to your supervisor because maybe he or she will understand it since obviously the other employees do not."  I was very firm and kept my tone even.  The caller stated he would try to find one but came back moments later saying he couldn't.  He did say, however, that he would note it in the "file" and he was very apologetic.  I got his name, thanked him for noting the information, and told him to have a good day.  I would like to file a complaint with the FTC but the website is down.

This company is a joke. They have been calling my work phone for over a year. Sometimes they don't say anything and just hang up. Other times they ask for a guy who hasn't worked here in over two years. We tell them that everytime and they still keep calling. What part of "in over two years" don't they understand?? There needs to be some Congressional action taken on these annoying and stupid people. If anyone gets an address for this Company and/or a name please post for everyone to see.

They call once a day, they and two other agencies from the same california bank entered our bank  account and ruined us financially. They all three are being investigated by the US and Indiana State Attorney generals office for wire fraud, harassment etc. please send any info to skycity2012@aol.com and I will shut them  down once I get the physical  adress in Tulsa Ok.
