Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Some fraudsters have instructed victims to fax a statement agreeing to pay a certain amount, on a specific date, via a pre-paid Visa card. The statement further declares the victim will never dispute the debt.

If you receive these calls, do not follow the caller?s instructions. Rather, you should:

?Notify your banking institutions.
?Contact the three major credit bureaus and request an alert be put on your file.
?Contact your local law enforcement agencies if you feel you are in immediate danger.
?File a complaint at www.IC3.gov.
Tips to avoid becoming a victim of this scam:

?Never give your Social Security number?or personal information of any kind?over the telephone or online unless you initiate the contact.
?Be suspicious of any e-mail with urgent requests for personal financial information. The e-mail may include upsetting or exciting but false statements to get you to react immediately.
?Avoid filling out forms in e-mail messages that request personal information.
?Ensure that your browser is up-to-date and security patches have been applied.
?Check your bank, credit, and debit card statements regularly to make sure that there are no unauthorized transactions. If anything looks suspicious, contact your bank and all card issuers.
?When you contact companies, use numbers provided on the back of cards or statements

These people called my cell phone and my work number. When speaking to them at my work I told them I would call them back. When I called them back, they said that they need the number of my lawyer as I have broken the law and will be prosecuted. When I asked them what  this in reference to they repeatedly called me a cyber criminal. Finally I was told it had to do with a payday loan through Cash Advance. When I told them I did not accept take out any loan with them they called me a scumbag and said that I should be ashamed of myself and that I was a cyber criminal. When I asked them to send me written verification of the debt they refused and told me that I needed to admit my debt and pay up. Fortunately I have saved the voice mail message that they left on my cell phone threatning me with jail time and will be filing a complaint with the Florida Department of Financial Services.

This is who they are.  They will tell you that you got money from Cash Advance USA for $300 and you did not pay Cash Advance USA back.  I never received this money.  They want you to get a Visa Cash Card and not to activate it and call them with the number.  Good Luck.  They will threaten you with going to jail and tell you they have a Docket No. for your arrest and someone will come to your place of business or home to arrest you.  They also say they will drag you and a manger out of your place of business and will be arrested.  They say they are calling from a law firm and the names they are using is Jack Daniels, Mr. Brown and sometimes a female who calls herself Kelly.  They have a heavy accent.  The last one, Mr. Brown, said he was calling from the state of California, but his phone number was listed out of NY, NY.  929-268-0229.  Jack Daniels 408-216-8931.  They have rattled off the last four digits of my bank account, I have since closed that account.  They also have my complete SS number.  If you ever apply for a cash advance, somehow they are getting this info.  Probably from an inside source.  I never received any money.  They will keep it up and keep it up.  Every time they call with a different telephone number I block their number *60 and follow through with the instructions.  You have to do this right after they call you, because it blocks the last number called.  Sometimes the call would come through as Sunrocket.  Also this Sunrocket will call and say you are approved for $1,000 or $1,500 even though you never applied.  The scam behind this is to entice you and then they will ask for your bank account number.  Somehow this must be stopped and not allowed to continue on.

My cousin, who is new in this country and who barely has any credit history, just got a call from this number telling her that she $350 for some loan she supposedly took out with a guy named "Sean"???  Of course being new here, she got extremely frustrated and worried because they tried to scare her with some government bureau crap.  AND I WORK FOR THE FEDERAL GOVERNMENT!

So I decided to give them a call to ask what they were calling my cousin about.  I first asked this guy "Mark Spencer" with a really thick Southeast Asian accent, to verify at least my cousin's street address he has on hand.  He couldn't even give me that.  Then he kept telling me that if she didn't pay he would have to report the non-payment to the Social Security Office.  I told him what the Social Security Office had to do with credit and loan issues.  At that point he was already trying to talk out of his a**.  He still kept insisting that she has a loan that needs to be paid off...and I told him that we had a copy of her credit history report from Experian in our hands at that moment (which we did, freshly obtained) and he still kept making inconsistent claims.  And then he tells me HE works for the federal government, while 7 mins prior he was telling me he worked for the American Law Firm Association???!!!! And when my cousin spoke to him, he said he was from the Payday Loans company.

Then I asked him where he and his company was located and asked if they were even legitimate company...and if they were even in this country.  He said they were in San Francisco.  So I asked for an address: 107 Ritch Street, San Francisco, CA.   As he gave me the address, I Googled it, and nothing turned up.  (Any legitimate address you Google usually pinpoints it on a map) .  This was when I started to frustrate him! LOL!  Then he started telling me that if my cousin doesn't pay, he will report it to the Court....and I asked, what court?? Do you even know what type of court? And I asked what court are you gonna report it to?  He said ORANGE COUNTY....which is 600 miles from where we are!

I wanted to reach into the phone receiver and wring this guy by the neck, just thinking about the innocent and naive people they scam out of money.  I hate the fact that they use the government agencies as their guise! That would scare anyone into paying any amount THAT THEY BOGUS-LY OWE!

Been getting calls from 929-268-0229, 408-900-9700 and 347-637-6480. They say there is a legal matter against my SSN and if I don?t cooperate I am in great danger and will be arrested. I got the local police involved and they called the numbers back. After a little back and forth talk they then put an ?FBI? agent on the phone. Funny because he could barely speak English. I then reported these numbers to the Federal Trade Commission (FTC) and the states Attorney General.

No need to be scared, they cannot harm you. You should take steps to protect yourself from ID theft (google it) but they cannot harm you at this point and they're just trying to scare you to pay them. Do not pay them. If you pay, they will just sell your info to the next scammer as someone who will pay up. It will never end. You must *never* pay. You can subscribe to *09 Selective Call Blocking/Reporting if it's offered in your area (will cost you $money) to block 929-268-0229 and to have the call analyzed for possible violations of phone regulations. Read about it here http://www.nanpa.com/number_resource_info/vsc_definitions.html (just search the page for "*09"). Alternatively, if you can assign a "no ring" ringtone to 929-268-0229, this will at least silence the call though it won't stop them. Best of luck.

This is an extortion scam. Scammers pretend to be law enforcement (police, sheriff, Feds, AG's Office, fake cop agencies with made-up names) and may be using bought/hacked/phished loan application data to extort money or personal info for fictitious crimes.
