yes it is a scam it happened to me a couple months ago. i filed a formal complaint through the Better Business Bureau.

Thick Indian accent guy just called my work number and said he was calling from a law firm in California and asked if I had my info ready to give him.  He said there was legal action being taken against me this afternoon. I told him I was not giving him any information.  Thankfully after searching the phone number on Google I see many others have been called by this scamming group.  They new my name and my direct work phone number - that is down right scary.

Consumer Alert: Attorney General warns Kansans of debt collection scam

January 29, 2010 -- Attorney General Steve Six is cautioning Kansas consumers about telephone calls from apparent fake debt collectors who are impersonating law enforcement officers in an effort to extort money from consumers.   Consumers are warned to not submit payments to these fraudulent debt collectors.

When calling, the scammers most often state they are attempting to collect a debt related to an internet payday loan obtained by the consumer, but which the consumer never repaid.  Consumers state they have never obtained such a loan or paid off the loan years ago.  The scam artists have most recently identified themselves as ACS, National Affidavit Processing Department and United Financial Crime Division, but may use additional phony names.  It appears the phone numbers used by the scammers are ?spoofed? numbers, so that the number appearing on a consumer?s caller ID is not the actual number of where the call originated. It appears the calls in question may be originating from outside the United States.

When questioned, the individual calling refuses to disclose the full name or address of the collection agency they claim to represent.  These scammers have been able to provide consumers with identifying information, such as the consumer?s social security number, home address, e-mail address, names of family members and the consumer?s computer IP address.  Since the callers are able to provide valid personal information, consumers may become confused and believe they are being contacted in regard to a legitimate debt.

If the initial debt collection scam is unsuccessful, consumers have been re-contacted months later with the scammers posing as law enforcement officers or officers of the court.  Typically, the consumer is threatened with arrest for fraud or some other fictitious crime unless the consumer agrees to immediately wire money via Western Union.  The fictitious officers strive to frighten and confuse consumers into compliance by using legal sounding terms such as ?We?re filing an affidavit against you? or by stating a lawsuit has been or is in the process of being filed against the consumer.

A hallmark of each scam has been calling consumers repeatedly at their place of employment.  This scam hit home when an employee of the Kansas Attorney General?s Office was repeatedly called both on her cell phone and at work.  Despite the employee?s repeated verbal disputes, the caller refused to provide any identifying information to allow her to send a written dispute. The scammer also continued to call her numerous times a day regarding a payday loan she denied obtaining. Two months later, she was again contacted by telephone by an individual identifying himself as an ?officer?.

?I denied owing the debt and refused to pay without being provided validation of the debt. I was then told, ?If that?s the case, I will have local law enforcement come to your place of business and drag you out kicking and screaming?,? stated the employee.

?It is important for consumers to know their rights under the law,? Attorney General Six said. ?If a consumer is receiving calls from a debt collection company and believe it is a scam, I encourage them to contact our office immediately.?

Under the Fair Debt Collection Practices Act (FDCPA), collectors are required to send consumers a written notice within five days of the initial contact.  The notification should contain  information such as the amount of the debt, the name of the creditor to whom the debt is owed and a statement informing the consumer they have thirty days to contact the debtor in writing to dispute the debt or request validation of the debt. In addition, legitimate debt collectors are prohibited by the FDCPA from making false or misleading representations, such as the consumer has committed a crime, implying nonpayment will result in the consumer?s arrest, or using the threat of violence.

**UPDATE** For those of you upset or frightened by a rude, harrassing call you received from 949-544-2835 like I was. !! DO NOT WORRY !! It is a SCAM. A FRAUD. I called CashNetUSA.com directly and their fraud department is investigating this scam. Furthermore I called the San Diego PD (where they said they are from)& the Irvine PD (where I live) and both stated it was a scam. I also checked both of their websites for any open warrants against myself, just to see, and there was nothing. THIS IS A SCAM...A FRAUD...and they are the ones who have performed an illegal act. They left the exact same message on my voicemail at my office, which is also illegal. DO NOT FALL FOR THIS. DO NOT VOLUNTARILY PROVIDE ANY INFO AND DO NOT ANSWER THEIR QUESTIONS!!!HANG UP, but keep the # in your "received calls" if you wish to file a complaint.

UPDATE!! ..see info below I found. Response to Can I be arrested not paying back a payday loan?:

I was the regional manager of a check cashing payday advance store, and I can assure you there are no precautions to not paying it back. The only thing they can do is stalk you and your references until you cave. They can't even send it into collections, check the law!

You cannot be arrested!

2/15/10 1:40 pm. Just now got off the phone with a man speaking in a thick India accent. Had difficulty understanding him although I did get that he said I would be arrested at work tomorrow. He screamed at me. I informed him I was on a TracFone & my minutes were be running out. (True) With my voice echoing in the phone & his thick accent I had a lot of trouble comprehending the call. But got that he was from San Diego Cyber Crime Division. Wouldn't tell me what company he was representing. Could hear other callers in background raising their voices at the people they were speaking to. Told me I would be arrested AS AN EXAMPLE to others. He told me that my "references" would also be arrested. Mentioned Cashnet. That IS an online payday loan company & I had received a loan from them months ago and it was paid the very next payday. I live in Irvine, CA.

Same thing happened to me, no one spoke english.  Spoke with a Kevin Foster, said if I could pay $800+ today I could prevent myself from being arrested.  First I had heard of this debt, if it is actually debt. Called the local police department, explained what happened and the officer there said it was the new Nigerian scheme/scam.  Was threatened that he would call my work and tell my supervisor what I did....super worried that a cop is now going to show up to my work and arrest me, he kept saying by 2 PM my time.  Can anyone tell me if they ever had a cop show up?  What happened beyond the phone call?  I am 99.99% sure that this debt is not real, but worried I somehow missed a bill somewhere and it is....HELP!  (Also when I asked for the law offices name, that's where he said he was calling from, all he kept saying was that they were in San Diego County)...said the debt is to a cashnet.com or maybe it was netcash.com)

Got thru to the number and asked for Ms. Davis' supervisor. She came on the phone flipping out so I kept calling back until I got another person. This person claimed to be her supervisor and was just as bad as she was with the abusive language and threatening to have the cops arrest me immediately. Neither one would give me their address or the full name of the company so they are definitely frauds and they kept hanging up on me. For those that do not know, it is illegal for a debt collector to threaten imprisonment and they violate the Fair Debt Collection Practices Act by using abusive and threatening language. Problem is nothing can be done when I can't even find out where these people are.

Same number called my home and my job and the female, Jennifer Davis threatened me, kept telling me to shut up, and told me she was having me arrested. I flipped out on her and told her I was calling the police. I called back 10 minutes later and the phone number was not working.

A man contacted me from this number claiming that I owed money to a pay day loan provider.  I had never heard of nor done business with the organization that he gave me the name of.  He informed me that if I did not give him a payment of some sorts that I would be arrested later this afternoon.
