Got a call from them posing as a process server (usual routine) for illegal collection agencies these days.  After dealing with the "being served" routine and can make amends by calling the original "claimant" I had contacted the court system in my state.  They advised they are getting so many calls about fake lawsuits and fake process servers they advised filing criminal charges for impersonation of a government official to the FBI.  So everytime I get an voicemail or call from these guys I file another report with the FBI.  I hope that maybe a few of these guys going to jail will finally get them to play by the rules and get bonded as they are supposed to in many states.

I just filed a police report and a complaint with the state and also filed civil charges for the many Federal violations this company committed against me. They are also not licensed to collect anything in any state. So, they talk about morals, but maybe looking in the mirror for them might be the best option. See you in court Mr. David Max Lerner.

IMPORTANT INFORMATION posted on 4 May 2011 "This office is a 3rd party that represents an array of Lending Institutions who have retained our skill set to provide a Full Service Recovery Process" which means this collector must obey the Federal Debt Collection Practices Act http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf despite Eric's alleged ignorance of the law.

"bloggers trying to avoid paying their bills" is a false assertion. Nobody is saying debtors should avoid paying their bills but we are saying collectors should obey the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf and must tell debtors at initial contact, or send paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold the debt),
3. a statement that that debt will be assumed to be valid unless the debtor dispute in writing within 30 days,
4. a statement that that if the debtor does dispute in writing within 30 days, the collector must mail the debtor written verification of the debt,
5. a statement that if the debtor asks the collector in writing within 30 days, the collector must send the debtor the name and address of the original creditor if it's different from the current creditor.

ALWAYSr ecord every conversation with debt collectors. Inform them that you are recording., if they don't like it they can hang up and stop calling. Force them to abide by the FDCPA. Demand a letter of validation for any alleged debt. Refuse to pay any debt that is past the statute of limitation. If no debt is legally owned send certified letter to cease and desist contacting you. Research the FDCPA. File complaints against them with your state attorney and their state attorney, file complaints with the FTC. Sue for any violation of the FDCPA. Lawyers will take these cases on commission.

Follow the law. Provide validation of the debt. Don't violate the FDCPA. Record every conversation with them, if they object they can end the conversation themselves. If they violate the law sue them for every violation.

They just did the same. I actually called them back 3 times trying to get info for a complaint. Evasive about the name of the business. Said they dont have to identify themselves as debt collectors because they are attorney liasions and a summons would be delivered to me by 4:30. Original caller called back in succession three times and at one point told me to "shut my face". Credit card had a very low limit and was charged off 6 years ago. Now these crooks want me to pay almost $2,000. I think they gave me 3 different names for the company.

"Be Responsible"

Debt Collector
Same thing has happened to me. It is a credit card that I had over 6 years ago. I tried settling with the credit card company and then they stopped sending me bills. I received a collections notice 2 years ago and I contacted them to set up payment. They wanted half the money up front and then they would break up the remaining amt in 2 or 3 payments..(sure.. I have over 650 in the bank to pay you now and then pay the rest in 2 weeks..REALLY). Now this group Financial Assets Security is saying "be responsible and pay what you owe". I haven't received any paperwork or letters from this office and they are wanting my checking account/debit information. They also said that they will contact the attorney's office to serve my court papers that I needed to be home between the hours of 9-4pm on any given day to receive these papers...ok let me call my boss and tell them that I can't come to work because I'm waiting on court papers any day now..ROFL!! The person I spoke with was friendly but got tired of him saying, "I understand you want to be responsible and take care of this". I guess I will have to wait and see if they do decide to serve me court papers that my county has had for over 2 weeks now. Maybe then I will get some true help. Whatever you do..DO NOT GIVE ANYONE YOUR ACCOUNT INFORMATION WITHOUT DOCUMENTATION FIRST even if they threaten with a lawsuit!!

You are a collection agency, not an Attny's office. It is illegal for you to threaten people that you are taking them to court, if it is not really your intention. It is illegal for you to threaten people that you are taking them to court on a debt that is out of statute of limitations. It is illegal for you to contact my FAMILY and disclose private information. ALL of these things have been done to me and the proper documentations have been mailed.

Either all that is just fiction, or you just illegally disclosed a consumer debt to a third party, violating FDCPA.

More likely it's just fiction, posted to discredit a consumer complaint.

What you are describing is known as a "Corona collections scam".

It starts with calling and threatening relatives, pretending some lawsuit was being filed, to avoid providing validation as required by law.  This is a tactic used to shakedown or extort consumers by coercing payment without any proof any debt is owed to them.  The alleged debts may be past SOL (in which case they cannot legally sue), or may be entirely fake.

FTC just sued a bunch of collection agencies in the Corona area pulling the same scam.
This operation, in the same area, may be one they overlooked.

NO WAY am I giving this to you! He hung up on me. I know the laws so try someone else. This is a credit card I had 11 years ago. You cannot take me to court on this so go to he**.

This agency has called me repeatedly.  They call me at work and on my cell phone, and when I don't answer, they call my 14 year old son and threaten him.  The main guy who calls me is JP Furmis, and despite him telling me he can take everything I own and put me in jail, and telling my son that I was a deadbeat, a liar, worthless, and a criminal, I still don't even know to whom I actually owe this debt and how much it is.  When I ask, they just tell me to get my checkbook and pay.

I got a call from this company.  When I quoted the FDCPA the director, named Eric, said he did not even know what the FDCPA is.  FOR REAL!  You are a debt collector and do not know what the FDCPA is?  Also when I asked what the debt was for, cause I would have been happy to pay it, he said that he did not have to tell me that I am going to be served papers at my home or place of business.

The call that I had got was from a blocked number and the message that they left on my phone was very rude, just like the reps where when I called in to see what was going on.  The third rep that I talked to said that there are over a thousand employees and that there was no way that I would not get transfered back to "Eric".  Amazingly I did and not only that but he is such a professional that he was talking to me on speaker phone!!!

So who ever Eric is go ahead and serve me because I have no clue who you are and as you stated in the last quotes you have to give the person a chance to set up arangements to pay the bill.  Funny how you could not even tell me what the bill was for!
