951-797-9546, Daniel Wilson is a fake call trying to scam you. He said something about a payday loan past due. He wanted $220.00 right now or he would have the police arrest me at work. I have never had a payday loan. They called back two times. He said I owed $490.00. He couldn't give me any dates. Beware they are using the name of State Attorney Law office.

They keep calling and telling my children and myself that if my husband doesn't pay them, that he will be going to jail by tomorrow morning. They want my husband to pay for a loan that was done on the internet. My husband told them that it was not him and that someone stolen his identity. And, yes my husband and I did file a police report. But, they are still threating him. Help us please.

They called me saying I had 30-45 mins to pay a unpaid debt that I'm trying to still there money!! That if I didn't pay I would be arrested right away and that I would do 6 months or more in Jail. That my license would be taken and my bank would be frozen...and soooo much more. I wasss soo scared.

They call me between 12-42 times a day.  They say I am under investigation for social security fraud.  I have been on social security since 2007, I am a very bad diabetic with nerological problem.  All proven by many doctors.  I just want it to stop.  Thank you

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. I have had two calls today from these morons. I have never had a payday loan in my life and I have never done any kind of banking or loans with telemarketers, for crying out loud!  I told the caller three things before I hung up:

If he expects to carry on a conversation with me, he damn well needs to lose the obvious Indian accent and speak REAL English!  Oh - he told me his name was Bob Adams - yeah, right and I'm Marilyn Monroe!

He told me I need a lawyer, so I informed him that I am married to a criminal prosecutor, so I have a great lawyer.

Finally told him that if he ever calls me again, I will report his number to the FTC.  I would be happy to report him.

We got a call from this number.  stating all the same crap, lawsuit, court, bs this bs that.  I called them back and realize that they are using the Magic Jack internet phone, which can be operated from anywhere with a US number.  I harassed the guy with questions, and he chickened out and hang up the phone.  Definitely a scam, however, why arent they asking for personal info?

I got a call from someone with a india accent. They left a message that they were calling from the state attorney general's office in California and that I needed to hire an attorney for not paying a debt to some payday phone company which I have never heard of. This is a complete scam. They are trying to get people to pay them money for nothing. Someone needs to contact the FBI and report this company.

I am receiving harassing phone calls at work from this number.  They are threatening me with legal actions and telling me to contact an attorney.  They repeatedly call my work number after being told to stop calling me at work.  I have no idea who these people are but if they have legal actions pending against me they should do whatever they need to do and stop calling me at work.  How can I stop these phone calls to my workplace?

This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information from unscrupulous websites like the one you may have filled out an application with, and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

I recieved a call from them today. A guy named Derek from " states attorneys office" left me a voicemail saying that there was a lawsuit out against me and that I needed to call them back or id go to court. So I did and "Derek" said that I took out a payday loan from Cash Advance USA and never  paid it back. He also said that they were charging me with deception and fraud. But when I called him out on it he got very ignorant and said that my info was confidental. He also claimed that he had all the paperwork in front of him stating otgerwise and that we was going to court. I still have the message saved

They just call me and they had left a voice message on my cell phone saying that I need to get a lawyer and have the lawyer to call them back up something about they about to take me to court but I remember there voice back a few months ago doing the samething toward me saying that I had ask for a payday loan and that I had gotten a payday loan and never pay back knowing that I NEVER gotten a payday loan funds from anyone at all. But I find is very fishy that they keep on saying that they prefer to talk to a lawyer that I have which most case's they do NOT even ask you point blank that they want to speak to your lawyer instead of you. If they here tring to collect a debt from you and you want to make some type of payment thing toward the debit then they wont be saying that they prefer to talk to your lawyer and that they taken you to court and the whole 9 yards.
