Bernardini Law is a real debt collections law firm. She is a licensed attorney in Massachusetts. Just letting you know. And no I do not work for her in any way, shape or form. I am also a licensed attorney in Mass and I do some debt collections. It's not a scam. If you don't owe the money then you just ask for validation. It's that simple. If you do owe the money then why report it's a scam?

I understand that debt collectors can be bothersome but we are literally just doing our job. Actually fulfilling our contractual duty.

I agree that some collectors conduct their business in inappropriate ways but I for one do not. Most of us understand the law and follow it. Not all debt collectors are attorneys. If you receive a call from an law firm just ask them to validate the debt either in writing or on the phone. An attorney will do that 100% of the time if they can.

I just returned the call to 978-278-5733. Talked with a Sean MacMahon (Shawn McMahon?) claiming to be a representative of said firm, Bernardini Law, P.C. Said they were calling in regards to a Felicia who I am not by the stretch of anyone's imagination.  

When I told him that I was reading about them online and the majority of the posters believe them to be running a scam, all he said was "Don't believe everything you read." That really calmed my suspicions. So, they may be legit and they may be scammers but if so, not only are they lunkheads but they are lunkheads who cannot even find the person who they want to scam.

Follow the above advice and listen politely to everything they say and then refuse to give any info over the phone until they send or email you all the paperwork listing your outstanding loan(s) with all the proper info regarding address, ss# and original lending institution.

They have called 5 times looking for a person that never lived at this address. But had a relative that use to live here. Told them don't know him, Never met him and to stop calling. And of course they are still calling its very quiet in the backround. This is harassment beyond its means.

Any time a debt collector claims they will bring "criminal charges" against you for not paying a supposed debt, it IS a scam. Debts are civil and NOT criminal matters.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

got a call from them today, told me I owe money from td bank all the info was legit, but told me I could only pay with a credit card or a pre paid credit card, and they cant with draw it from my bank account, sounds really fishy to me, they also said there were criminal charges from not paying

Allison from Bernadini Law has been calling since March looking to collect a debt that was for our sons medical expenses. When my husband and I at different times said we don't recognize the bill that was from 2009 she said she hears that a lot. We never received any collection letters prior to her call and asked for details in writing while we never got. One day she called on a Saturday night (which is odd in itself) she had him convinced that we owed this debt. He asked her to see if she could do something about the amount like 50 cents on the dollar. She said she'd see what she could do. Sure enough first thing Monday she left a message saying she had good news call back ASAP. I did call back. Allison said the company the debt was from agreed to settle for what we offered. She wanted me to pay right then over the phone going to their website and having her assist me with the payment information. I didn't feel comfortable with that so I said I'd call back. Later I spoke with my husband who said this s a scam we don't owe that money. I called place where supposed debt was from and they didn't show we owed anything. I googled their law firm name and found several sites. All they have on their home page is some info saying they are a debt recovery firm and a place to enter your credit card info. I also found this site that was listed under the phone number they were calling from. Over 800 comments on this being a scam!!!!! BEWARE!!! We almost fell for it. Once they had our credit card info who knows what would have happened!!! My next call is to the attorney generals office.

I did call them back cause I was in the mood for a fight today. The woman who called just 5 min. earlier answered the phone. I was waiting for her to ask my name and had no intention of giving it to her. Was just going to make her look it up by phone number since she had that anyway.She didnt ask for my name and went with phone number to look up....was looking for someone that I never heard of. I have had this number for 25 years. I told her that and she took me off their list. No fight today...I was really in the mood!!!

I too thought this could in fact be a scam, so for kicks I actually researched the company after reading this forum.  I had recieved a vague, generic message for a call back, and when I called back I learned they were calling about an old jewlery store bill I had neglected.  I told the woman I would have to speak to my wife, but in the meantime could she please send me a letter of representation with the original account #'s for the jewelry store, which she did as promised.  Still skeptical, I then called the jewelry store (who had sold the rights to the debt) and they pointed me in the direction of the company that purchased my debt.  I provided the debt-buyer with the original account info and they confirmed that the Bernardini Law Office was in fact a law firm they were handling the account.  Not that I enjoy getting these calls, nor do I condone the overzealous collection tactics that can come with the territory, but I have to say I was treated very fairly by the woman who helped me.

This is a Law firm specializing in collections.  http://bernardinilawoffice.com/  See their web site.  I don't owe anyone anything.  I get sick of these places calling too many times a day and NOT leaving a message.  I get collection calls for a Susan Harris.  My last name is Harris, but I am not Susan...cold calling like that is so annoying.  It doesn't matter if you tell them they have the wrong number, they keep calling.  Thank goodness for call blocking.

lucky me - i only got 2 calls from them! it's the same stupid message from either david or diane. "we have an issue to discuss with you". well, they can take their issue and stuff it, YOU KNOW WHERE!!! where the hell is the government doing about all this harassment??? it is rampant all over the country, for Gods sake. so many people have filed bankruptcy, etc. and  these people can torment all of us! WHY!!!!!! take free enterprise and stuff that too. lost my house in 1997! husband lost his job after 17 years at a bank due to downsizing! the hand writing was on the wall then, and no-one paid attention. these people should be flogged. sorry to vent so much but after all this time, i don't need this grief and i'm sure none of you do too.
