I received a call from a Check Fraud Division saying that I need to call them ASAP to resolve this issue about a bad check that I wrote in 2009 which I didn't and that the amount is 625.00 to be paid or else someone will be coming to my job to serve me a warrant for my arrest, The number is 703-382-2027 Springfield Va.

Got a call yesterday at work demanding the same thing, settle now and pay the money or get arrested at work tomorrow! After contacting my local police department, county sheriffs office, and district court I was assured this is not their protocol and that they had no fraud charge pending against me. Please please please do the same if this happens to you, the depraved disregard these people have for you is only fueled by their ability to succeed!

I can't believe the scam that these people just tried to pull on me, same exact same thing as everyone on this site has been fed...  and they have the audacity to call my grandmother, freaked out this harmless and fragile old lady.  They're calling from the "Attorney Generals Office," they couldn't give her any information, but that they were going to place a warrant for my arrest in CA, but call my grandmother in AZ stating that I had used her as a reference (which I never have).  Said that they have been investigating me for a long time, and that I was in a lot of trouble and needed to resolve the issue immediately!  First off, I don't think that I have written a check in 6 years...  Freaked me out!  Screw these people, they need to go to jail for this!  Her name was Jessica Benson, 202-827-0654 was the number they asked that I call back at, case number L36856.  Can't believe there are people out there like this...  Even more obvious when you search the phone number, it doesn't go to some government building in DC, it's some house...  and why wouldn't it be from the attorney general in CA?  Such b***s***, I can't tell you how outraged I am about this right now.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."
****************************************
A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I NEED HELP PLEASE:

My family members and myself have been getting calls from a man that says his name is
Steven Frazier asking about a name that is similar to my son?s name. He calls and says he is with the department of fraud and worthless checks division.
I have told him I don?t know anyone by this name. He then left a message on my family members answering machine. Saying that he was needing to talk to this person (the same name he gave me) and it is very important to call this no.1-512-686-0310 and provide the case # he left on the message. If not there could be trouble. They tried calling back once and got an answering machine and left a message. Today I tried calling and it says this no. 1-512-686-0310 is no longer in service.
If you have had a call from this no. 1-512-686-0310 or can help in anyway on how to find out who this no. belongs to could you please email me at [removed]@gmail.com.

I want to thank everyone for taking time to read this. Also Thank you in advance for any and all help and information on this matter.

Thank you
June

If they won't give info out, they're not legit...

The calls seem to be coming from several different claimed companies including "ACR Processing", WCCI, Johnson and Johnson Mediations, and others.  Not sure if it's just one set of scammers or several, but they're running things up the flagpole with more people and more often.  One of the tactics is to get you to moneygram the money to them.

Names include Mark Sanders, David Coleman, and a whole host of others, based on trawls of the Internet.

Whatever in the hell you do, don't give them any info and for God's Sake, don't send them ANY money.

Heh...  A legitimate contact about the sorts of things these fraudsters pretending to be dealing with "check fraud" would be explicitly via certified mail, which constitutes a bona fide contact as far as the law is concerned.  Contacts by phone aren't legitimate and can't initiate a lawsuit or an arrest in a matter such as this.  It's a bit of VERY poorly executed con-artist work they're doing here.  Honest people tend to get panicky when confronted with all this blow and go they're using and they get money handed to them because the people sometimes get confused and they think they're being law abiding and comply with the ludicrous demands.

My Aunt (in a whole another state) received a call on July 30th from a Sean James ph# (404)236-8905 stating that I had written fraud checks and I was going to get arrested unless I money gram them $1,015 to VPS code:7031 They also will use the company NFIS I immediately called them and let them know that years ago someone stole my identity and created a fake bank account and I had already got that taken care of in 2008 I had my police report and the bank fraud specialist had closed and cleared everything from the fraud account years ago so its IMPOSSIBLE for this to occur. They told me I would still have to get arrested and go to court and await trial Unless I sent them the money through Money gram to VPS code:7031 then they would email me axhonotation papers and drop all charges. They had me Terrified! They even had their ph# show up as a local government police dept to scare me. IT WAS ALL PHONY I FOUND OUT IT WAS A SCAM I DID NOT SEND ANY MONEY BECAUSE I SPOKE WITH THE ATTORNEY GENERAL THE POLICE THE BBB THE FRAUD SPECIALIST FROM WHICH THEY SAID I OWED (which was a complete lie) and I even had the Atlanta police call the number and they told me that it was a scam they tried So hard to get me to send them some money by scaring me about having a felony on my record and getting arrested BUT NEXT TIME THEY CALLED ME I TOLD THEM I KNOW THIS IS A SCAM THEY HAVE BEEN REPORTED TO THE FBI AND TO NOT CALL ME ANYMORE, NEVER RECEIVED ANYMORE CALLS, NEVER SENT ANY MONEY BECAUSE IT WAS ALL A SCAM AND NOTHING EVER HAPPENED TO ME. The police and attorney general told me it was a scam because they gave me a p.o. box address (whichwas fake) and anybody calling asking for money via moneygram or western union or green dot is false espicially if they don't know ur address or ph# and couldn't provide you with any documentation. DO NOT SEND YOUR MONEY TO THESE SCAMMERS ITS ALL FAKE CONTACT YOUR LOCAL POLICE DEPT AND ATTORNEY GENERAL. I found out so much info about these scams and how they try to scare people into sending them Money

Got a call from an Ethan Riley with the number 214-731-4087 saying my brother has serious felony charges out of the county we live in for writing bad checks. I knew this punk was trying to scam me. My brother hasn't lived in my county for years and further more if he had written bad checks it doesn't take years to come up with a warrant. This dumb a** also had no idea I work for the sheriff's office in my county and I knew for a fact my brother has no pending felony charges. He got frustrated with me because I was being rude to him. His bi*** a** hunk up on me like a coward. I did call the police and made a report because what these liw lifes are doing is fraud. Hope you guy's also make reports and don't get scammed by these retards.

Oh, isn't this adorable? Weinberg Cochran Coulson and Irwin (aka WCCI) have changed their "firm's" name to Olden and Associates? For those people on here that are new to this scam/game; these people are FRAUDS. "Fraud and Worthless Check Division"?!?!?!?!?!?! There are a couple of reasons that this "division" is ridiculously fake:
1. No legitimate operation would EVER name a department the "Fraud and Worthless Check Division"
2. If you committed fraud or bounced a check; it is NOT for a debt collector to call you. Fraud and Larceny by Check are a CRIMINAL matter; therefore, the police would have been the ones doing the calling. I got calls from these a-holes about 4 years ago and they were pissing me off so, with the help of a fellow blogger; we uncovered some in depth information about the folks behind this group. I am going to post the address and the phone number of the "owner" and even her home address. I'm hoping perhaps someone on here will get angry enough to crank call her house.
Oh, and by the way, "Govern yourself accordingly" is a lawyer's phrase which most lawyers consider a three word oxymoron and a tired cliche'. Also, in regards to that phrase:
"To govern one's self is to control one's self, or monitor one's self. Therefore govern yourself accordingly means act as you see fit". So, in essence, if you're telling them you will NOT let them extort money from you; you ARE indeed acting as you see fit. LOL! Be back soon with all of that info!

I received a call from 513-276-4304 a Debra Adams.  She was claiming I she had a check that has not cleared the bank from 2009.  Gave me a company name that was the company that I committed fraud to and it was Ace Cash Express.  I have know idea who that is.  Gave me a case # and everything and said that I owe $600.00.  If I don't work something out I will owe much more and they will be sending someone over this afternoon to pick me up for questioning.  I could be facing jail time.  I said I have know idea.  They said they have a picture of me walking into the establishment and have finger prints the whole thing.  I said there is no such business in my area.  She said ok and I said I will give the information to my attorney and all my calls at work are recorded and I will pass our conversation on to him as well.  I am frustrated because they also called my son and told him they were going to issue a warrant our for my arrest. Gave them all the information she gave me.  Wow...   he was  so worried about me.  I told him next time they call to say he doesn't know who I am.  What can a person do about someone calling and harrassing like that.  Does anyone know how to stop it?  If I change my phone number they will just get it again.  And this time they called at my work.

It took me a while to Google info on the phone # 330-230-7745 and I came across this post. I got a call from them saying that it's a pending litigation from Cash Store. They kept pressuring me to "take down this information" as I have a pending suit in District 217- Fraud & Worthless Checks. NEVER told me WHAT county and when I asked, I got transferred to their " litigator" named Angela. She told me it was in Harris county and I probably had no idea about it. I said sure don't but what I DO know is that when you are pursuing litigation on someone, you never let them know.... She got irate ( NO SUPRRISE THERE) and I asked her point blank, are you a debt collector? I am recording this call so I want to know. She got upset AGAIN and said for me to figure it out with the judge and she WILL make a believer out of me when I get served. I am contacting Harris County as they are using them as a cover to bully people into paying without stating who they actually are except "Irwin & Associates". Such fraud. I wish they would call me again so I can play dumb,  catch them in MORE lies, and tell them how I've filed a complaint IN Harris County on THEM!

I was called by a miguel wiggins from the worthless fraud and check division. The number comes up from Texas as 806-513-2078. He says that someone with my last name owes money. It's a scam - any LEGITIMATE collection agency will send you a debt validation letter.  Also, legitimate collectors do NOT threaten you with jail (debt is a civil matter, not legal - so they can't arrest you and jail you for unpaid debt).

Wow. I can't believe all these post! I receiveda call today from a Brad Furgurson stating that I would be charged in the mornin for writing a worthless check and state to state bank fraud. He knew a lot of information about me, but old information like where I use to live and bank at. He told me I took out a loan from payday express and never paid it back so I was goin to be arrested and sent to the Brazoria County jail where I would have to make Bond and I would pay$4000 in restitution fees. I was freakin out!! I kept stating I don't remember this loan, I've made settlement agreements and paid off the old loans I had. I told him I was a nursing student and couldn't go to jail or have anything pending on hmy background. I almost fell for this scam!!  He told me the loan was for $600 and I had til 9a to pay. I took down all the info so I could "MoneyGram" the payment. I was so shook up about the thought of bein arrested and goin to jail I called in to work tonight (somethin I never do) I kept thinkin I have to take care of this I work at a Hospital what if they come to arrest me at work???As I'm gettin myself together to go make the payment my lil sis calls and I tell her what just happened. She was like don't send the money!!! She started tellin me how she read about somethin like this on the internet and it's a scam.... For the first time after I talked to that guy I started using my brain. I called back and he was gone so I spoke with a Alexis Smith whom I asked to send me some written documentatinon. She said she'd send it by email. I've called back 4X and still no email. Each time I got a different person and they answered the phone differently. He told me he was callin from the worthless check and fraud division, but I'm sending money to Johnson Mediation.. when I called back the lady that answer the phone said it was the law office of Cochran and associates. I called back again with a blocked# and she answeredas another business. I told her I wanted the address so I could come into their office. P she got frantic and said oh no u can't do that. I was like it's a law office. They stopped answering for me and let the vm pick up. I did a back trace on this # and it's a landline at a what looks to be someone's house. I thank god I spoke wit my sis before sending that money as a single nmom and college student I couldn't afford to pay the $820 but was goin to do it to avoid bein arrested... I can't wait for these little sceamers to call me in the mornin!!------ they called me from Mogadore, OH (330)-230-7745
