My son and myself which I am his mother received this call saying my son had a loan from 2011 he had not paid harassing us and saying if we did not pay we would have allegation. The company is BOR.  They said they were not a collection agent just trying to help him pay this payday loan without further problems.  Is this a scam?  My son does not remember a loan from 2011 and they would not send anything except me something by email.  I think we have been scammed and I thought I was pretty good to know when there is a scam.

Called my office and cell 3 or 4 times a day stating that a claim against me come across their desk they needed to serve me some papers . sounds like harassment etc totally against the law.

Well that's the thing with "locators" - they "locate" the person their client is looking for and advise the client.  They DO NOT call the located person and ask them to speak to someone.  Your caller is a scammer, or junk debt buyer who can't prove you owe any money.

Have your employer read up and refuse the calls. Maybe he can get his phone service provider to block them also! He can also file complaints with the FTC, FCC, CFB, FBI and State Attorney General as should you also do! You can also print this out and take it to your employer so they can read for themselves.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Your caller sounds like a scammer: per the FDCPA, you should NOT pay any caller who refuses to MAIL - do not accept email or fax - a debt validation letter showing that you owe a debt and that your caller has the legal right to collect that debt.  Refusal to mail this DV letter within five days of their first call is a violation of federal law.  More info. here - it relates to payday loans but has good advice which applies to all debt collection calls:

Yes you are right. I spoke with this guys who keeps calling me here at work and I asked him what company is he representing and he said he is working alone. Mr. Alonzo told me that he received a UPS mail asking him to locate me. He wants me to hold on and will transfer me to another person. Then I asked him again what is his name and he said his name is Mr. Christian, then I hang up the phone and got another call. :(

Mention these calls to your employer.  It is illegal to discuss your perceived problem with a third party.  Calls are NOT an official form of notification.  IF there was a claim, you would receive something in writing delivered by mail or a server.

Mr. Alonso called several times today here at work. Left a message in my voice mail, left a message in different department and left a message to our branch manager. This guy told them that there's a claim against me and I will be served. I finally spoke with him and he is trying to intimidate me. I asked him what company is he representing and he said he is working alone. He wants me to hold on so he can transfer me to another person. I hang up. Then called the other department because he doesn't know what department I am working at. I googled this number and there were no positive post about it. It all says SCAM!!! What do I need to do? It's embarrassing me here at work.

Really?  According to other posters, they're being called by a company who won't disclose their name and physical address - a violation of federal law - as well as refuse to mail a debt validation letter showing they owe money and the caller has the legal right to collect that debt - another violation of federal law.  In other words, you're a shill.

i called and found out i have an outstanding loan in pre-litigation. i've been waiting for someone to call me on this cause the original lender was no where to be found--- they offered a settlement of just over what i borrowed and gave me a payment plan. instead of going thru a debt -consolidation i took care of it myself. they helped a lot

Caller ID had the number as unknown... woman identified herself as Becca Fox and left a message for a Gluteneo Borjas (not me); said there was a claim against him and he needed to contact 844-647-7514. Claim number the caller left was 1946696. This is clearly someone phishing. If you know your financials; dont even bother calling back; that's how the scammers figure out your number is a valid number and start selling it around to other scammers.

These people call me daily , multiple times daily. They say there is a lawsuit against me. I told them I need their fax number to send them a cease and desist letter. They refused! I told them they need to send me documents in the mail or hand deliver them to me if there is such a case, and stop calling me and my husband!! This is clearly a scam.

This number called my house twice in two day claiming that a claim has been filied against me and i need to contact then because i was going to be served with some paper. They then called mu job with the same information.  Something needs to be done about this. People could lose their job over this nonsense.  Just another way to scam people out of some money. Shame
