I suggest you get a confirmation of the bill.Be nice polite and get the info you need.Find out first if you are even connected to the debt in any legal form.In the event you do see your name on it[from what you said you shouldn't]don't make the mistake thinking your ex is in on it.She may be just as surprised as you.This actually may an indication someone has commited ID Theft.How you could handle it depends on what it is presented to you.I do suggest that if anything looks off that you report it.Also you may want to register your response with your local courts.Don't know if your state allows that,mine does.

These people have also been bothering and harrassing me saying I owe them 800.00 dollars for a check I didn't pay in 2008 at ACE Cash Express. They want give me an address but I could take care of it by phone on a credit card or debit card. These people are breaking the law. Something has to be done.

Kde fraud dept from Florida has been calling  not only me ... But my mother over the past few years ... I never had any reason for them
To call me . My ex wife ( divorced over 20 years ago ... And she is re Married)  and her husband defaulted on a loan  5 years ago .. And now they are threatening my mother and I for obstruction of justice ... And keep telling me I'm going to jail ... What can I do ? ... It's probly a scam ... But I want to help make them stop . The callers name is Scott Nichols ... And very rude .. Abusive and needs to be stopped  calls from # 561 922 7304

I have been receiving the same calls. I contacted Ace and I am paid in full have been for 3 years. I even have the letter handy for instances like this. I received a call 2 years ago the same way. When I spoke to Ace's home office they said they have never heard of them but it seems to me their files may have breached. I have told Mr. David Miller from KDE to file charges that we would square it away in court then. I paid my debt and have someone with my social security number out there threatening to throw me in jail. Yes I was late paying my debt but I paid it. You can't go after someone and get them to paid twice for something. If Ace is sending people after people who have already paid in full then they should have a lawsuit too. I will be filing with the appropriate people about KDE and their practices.

?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

THEY STOPPED CALLING ME AFTER I SENT THEM THIS LETTER:


To Whom It May Concern,

I just spoke with ACE Corporate Office and they said that you can call their Payday/Check Collection Department at 888-753-3100 to confirm that I do NOT and have NEVER owed them anything. ACE stated that they show NO record that they have ever sold any account to Collections for me because I am and have been in good standing with them. If you insist that I owe this debt, please provide a copy of the original written agreement between myself and ACE, such as the loan note signed by me. If the account has been sold to you by another creditor, please provide proof that the debt was assigned to you (i.e. a bill of sale, an ?assignment?, or a receipt between the last creditor holding the debt and KDE Recovery LLC). ACE also stated that the Account Number provide is not an ACE Account Number.

Pursuant to the Fair Debt Collection Practices Act and Fair Credit Reporting Act, found under section 1292(c), I am writing this letter requesting KDE Recovery LLC, Eric Mosley, Lisa Brooks and all others to cease further communication with me by phone.

DO NOT communicate further with me with respect to this account by phone.

You are harassing me and my family by calling us numerous times and leaving messages continuously and repeatedly. I am keeping a record of each call.

You are threatening me with legal action, stating that you will sign-off on the recommendation to have a bench warrant issued for my arrest.

Has called me numerous times acting like a private investigator trying to threaten me into paying for a bounced check to check in go. Problem is I'm not the person they are looking for.  They don't believe me and wont give me an address to prove it. They call from many different numbers including Florida Washington and Texas.  I think that they are using a call spoofing service because the same person called me from Florida and then Texas 15 min apart.  So I subscribe to mr number now. Its great it blocks all of their harassing phone calls. Does anyone have their address?  And they do havea facebook  page.

A call from "Miss Hutchison" to my mother's house. Caregiver said mom could not come to the phone and that Hutchison should call the daughter (me). Left a number of 904-404-8537 x1013. I called her back and the first thing she wanted was for me to confirm the last 4 digits of my mother's social security number. I refused. She then demanded just the last 2 digits of the social security number. I again refused. She said that if I did not cooperate she would have to "have the warrants sent out". I said okay, and hung up on her. A few minutes later "David Fleming" called me wanting the same information. I laughed. He said it was a check fraud matter. My mother has written checks in about 2 years! I laughed at him and asked him "what are you really about?" and hung up. He then called again and I let it go to voicemail. What a scam.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Contact a Consumer Represented by an Attorney
