Received a call at work from investigator Kelly Kellie staing that she was about to go court on me for a loan for 790.00 from All American Lending which I googled and found out was an internet check advance company which I didn't get a loan from. She said after court cost and attorney fees had been added it totaled up to 1179.00 which over a thousand dollars and that was a felony and that if I didn't pay right now the police would be at my job within 15 min to pick me up. I called the number back and told she was at court

Sharon Jackson also called my home, but now she's using 404-991-6864.  She told me she didn't have to do me the favor of letting me know there was a warrant for my arrest, but that they had already picked up 24 others that day and I would be the 25th.  She said I had "someone" deposit money in my Chase account with no intent on ever paying the money back.  She wasn't very persistent, but she didn't get anywhere and finally said she would fill out an affidavit stating I was not the person they were looking for.

I just received a message fom this woman that was left yesterday.  Her message stated that she was Investigator Sharon Jackson and that it was 8:30am and that my file would be released at 9:45am.  She stated that I would need to call her back immediately.   I didn't get the message until 11:00am the next day.  I knew this sounded funny an Investigator would say "this is Investogator Sharon Jackson with the________________________ and then would state which law enforcement agency she was calling from".  I called her back but received a message.  I am not a fool and I have worked for atty for over 30 yrs. I found this site and now will be prepared when she calls back.  I am going to start the call saying that she is being recorded and I bet you that will shut her up.  This group also left me a message on Facebook, but I deleted them as a contact.  So put that in your piipe and smoke it Ms. Jackson!

She said that if she didn't pay the $1,111.03 that my sister owes, a warrant for her arrest would be issued by 10:00 this evening.  It wasn't until I typed in this number on a search engine that we found out the truth.  DO NOT LISTEN TO THEM!!  IT IS ILLEGAL WHAT THEY ARE DOING!

A amn named Tom currin called me and said I had one hour to go to Walmart and send money through moneygram for a payday loan from 2008. He said this was a courtesy call that they don't usually make but he was giving me the opportunity to pay this debt. He then went on to say that I had committed fraud and they were on their way yo arrest me. i have never been in trouble w/the law so naturally I was terrified. But then, he became rude when I started asking questions. He made me so mad I decided to investigate. Another man called me today at work with the same story. I called back and got the address, then a coworker in my office googled the number. Boy am I glad she was listening for a change. I will be filing a complaint--they said they were from the fraud dept of the US Attorney's office. What a crock. Thanks so much for the heads up.

Sharon Jackson Investigator 904-762-6423 called my work demanding to speak to my supervisor which happened to be out.  I contacted her back and she bluntly wanted to know why I took so long and I told her maybe because I was at work.  She pretended to go get a case file but could not tell me about it.  Claimed it was a a wire transfer to Nations Bank (which I have never had an account with) from 08'.  I asked if she could provide me the information but stated that was not her job.  So I asked was her job to call and harrass people when they questioned her.  She said she had been in court filing to have me picked up and I told her that is good since then they will give me the documentation she couldn't.  I also asked why is she claiming to be an investigator when she isn't.  She told me that was not her concern.  I told her she needed to be concerned when I was personally contacting to police station to let them know her tactics and what I have read online concerning her.  Then I asked her was she upset that she couldn't scam me into wiring her money and she hung up.  Never thought I could feel good but I did.

They just called me and threatened me with 2 felonies if I didn't pay them.  They really had me scared so I Googled them and got this site.  The next time they call they will get an earful.  The call came from Smith, Dean and Associates, the number was 940-855-8028.  Also, are they even allowed to call me on my cell phone?  I noticed someone in an earlier post said they aren't, but I live in Ky so I'm not sure.

For at least the last four years, possibly longer, a group has been calling former payday loan applicants advising them that they have defrauded a bank and are now being sued for non-payment of a loan.  The callers will claim to be calling on behalf of an attorney's office (name varies), the Dept. of Law and Investigation, ACS, or other similar combinations below:

You will be threatened with arrest, a costly trial and possibly worse.  In no shape, way or form can you be arrested for non-payment on a consumer debt.  Do not believe these threats, as they are without merit and cannot be carried out in the manner they allege.

They have been previously fined over $1.3 million for various violations.  They have been known to use phone banks in India to make their calls, which more or less coincides with the difficult to understand accent many of us detect when we are contacted.

On July 15th, 2010 a Public Awareness Bulletin was sent out by Missouri Information Analysis Center.  

"..received reports from individuals in Ohio and Illinois reference suspicious telephone calls they received. In both instances, the callers are reporting that a voicemail is received from a man, with a Middle Eastern accent, identifying himself as an officer working with the Financial Crimes Unit.  The message indicates that the reason for the call concerns a loan made by the receiver or someone in the receiver's family. The voicemail requests that a return call be made and a telephone number is provided. When a return call is made, the caller is asked to provide personal identifying information such as their date of birth and social security number.

Reports indicate that the calls are frequent and persistent and that they even threaten arrest or legal action if information or money is not provided. It appears that the individuals making these calls may have access to some records connecting individuals and their relatives.  Missouri does not have a Financial Crimes Unit and all indications are that this is a fictitious agency. If you receive a similar phone call, please be advised that it is a scam and please contact your local law enforcement agency or the Missouri Information Analysis Center at 866-362-6422."

Bottom line:

Do not supply the callers with any additional information.  Inform them you have reported them to law enforcement and hang up.  If you haven't already, go ahead and report the calls to local law enforcement, your state's Attorney General and beyond.  Look up the local Secret Service branch's information in your area and get in contact with an agent there.  

If you ever applied for a cash advance online, your information is out there.  
Possible sources for the breach of your privacy are:

* The scammers obtained your information from Teletrack - a reporting agency used by many cash advance lenders to determine their risk lending to you.  The service is able to tell cash advance lenders if you have existing loans with other companies, for example.  Many state laws prohibit borrowers from having more than two cash advances out at the same time.

* The scammers created their own fake payday loan application site.  People looking for a cash advance went to the site and applied, thus freely providing the scammers with their information for malicious use at a later time.  

* The scammers were able to get into the database(s) of cash advance lenders - probable targets being Sonic Payday and Cashnet USA.  


How to protect yourself:

* Inform your employer.  You are likely getting calls at home and/or at work, so make sure your employer is aware the calls are part of a scam and to not take them seriously.  Advise the callers that they are no longer allowed to call you at work.  If they continue to call, document the date and time of the calls you received.  Save voice mails left if at all possible.  

* Change your number(s).  For some this may not be an option, for others a one-time number change can be done free of charge.

Be advised - any references you listed on your payday loan application will be contacted.  Let those people know that this is a scam, and they can disregard.

* Use Google Voice.  Google Voice is a great replacement voice mail system for just about any phone number you use.  Messages can be transcribed and voice mail recordings can be saved as mp3 files.  

Pro Tip - call the scammers with a Google Voice number before turning off your old phone numbers.  Make sure when you call you identify yourself so they can start up their script.  At any point after they have your information pulled up just hang up.  They will then start religiously calling your Google Voice number.  At this point, you are free to change your regular phone number(s) and enjoy not having these people ever call you again.  (And laugh at the fact these people are basically talking to a brick wall several times a day)

The scammers change their numbers frequently.  Law enforcement used to think it was because the callers ran out of minutes on their prepaid wireless accounts or they were shuttered due to fraud, but now they understand it's simply to evade detection by savvy consumers online.  With the proliferation of VoIP, it's even easier for the crooks to stay a couple of steps ahead of law enforcement.  Below is just a sampling of the 30+ numbers that have been used in recent memory.

So can they really do anything to you?

It's not a simple yes or no answer.  Logic dictates that, if they really wanted to take you for a ride and drain your bank accounts, they already would have.  

So, why haven't they?  

Authorization.  

Why do you think you are being called so much?  Perhaps it is because they like the sound of your voice?  No, they have to have your authorization to take any form of payment from you, period.  The callers know their audience, and that audience is typically a bunch of people that have applied for payday loans in the past.  Most of those people they call couldn't afford an attorney if they wanted one, and are so used to receiving collections calls that so long as they sound like a real collector, they will likely be perceived as one.

Furthermore, they don't even really want to talk to your attorney - that just sounds official and scary enough.  A real attorney would take the callers to task and write them off as two-bit con artists.  The callers need you, in writing, to authorize payment against the fictitious debt they claim you owe.  Go ahead, ask them for proof you owe the debt - more commonly known as verification of debt.  See what they say.  A phone authorization carries very little weight, so if they have something signed by you on file, you are done for - and the callers know that.  That authorization is the only thing these callers are doing by the book, and for good reason.  If they just went all willy nilly and made an ACH debit from your checking account, without your written approval, you could in turn report the transaction as fraudulent to your financial institution.  In about 7-10 business days, you would get the funds returned to your account.  Then the scammers would be up against a bank and their team of lawyers and investigators.  

Bottom line:

If you haven't paid the callers a dime, don't.  If you planned on paying them to shut them up, just don't.  Remember - you are not being contacted by a legally licensed, ethically owned and operated collector.  Read up on the FDCPA - http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf - and know your rights.

OMG! This company is calling me too. Saying I was given (by direct deposit) a payday loan and then when they went to withdraw the money from my checking account for repayment, there was insufficient funds. They are saying this happened in 2007! I've never borrowed the money they are claiming I owe! They are saying there is a court order against me and I need to provide my lawyer's information and that I owe over 10 times the original loan amount!  The man is rude and harassing and won't give out any information. The scary thing is, he has my work number and my mom and sister's number, info. that would've come from an online credit app, which IS something I would do on a secure site (or one I would believe would be secure like a big name company). He says his name is Eric Brown and he is from William and Scott Associates and the number to return is 213-985-4916. How do you get these people to quit calling? You can't even understand his foreign accent! Ugghh.

I received a similar type phone call, but from another number. The number that called me was 213-985-4916.  The man who called had a very foreign middle eastern accent.  He said he was with the law firm of Williams Scott and Association.  The reason why I'm writing is because I believe there is a connection here.  This guy threatened me with that I was going to be served papers tomorrow at work and be arrested.  He was trying to claim that I had criminal charges against me for getting a payday loan from a certain company.  I denied that I have got a payday loan from that company and asked why I have not been notified by u.s. mail or any other phone calls.  You could tell he was not calling from a law firm, that you could hear noise in the background like a tela marketing place or debt place.  This man went as far to say I was going to be fired from my job.  Well I got my local police on it right away and district attorneys office.  First the number the man gave is not associated with a Williams Scott and Association.  The number belongs to a company called Zero Communications Ink.  This man identified himself to me as Eddy Jones.  To the D.A.'s office gave a different name.  To a police officer, he got irrate and also began to threaten him as well and said he would be arressted too.

The reason why I am letting everyone know, is to watch out for a call from 213-985-4916 or any person claiming to be with a lawfirm of Williams Scott and Association.  They all have a middle eastern accent.

The number was on my cell and I returned the call and was verbally abused by a man calling himself TOM CURRIN, claiming to be going to court in an  hour and was trying to be nice and give me one hour to pay up or face a class 2 felony in Ms. I don't live in  Ms. but own  property there. However he said he  was an Investagator for a Fraud Div. and was very mean and when I stood up for my rights saying I would call the DA office to make arrangements on the  chance I owed a bill or check, He really got mean and nasty. He called Husband employer and they called me telling me to take these people to court cuase he tried to tell them he was a court officer trying serve us.

These people called me and my oldest daughter today from three different numbers, looking for my youngest daughter,  stated they were investigators and that we needed to tell my youngest daughter to call them,  they also called me back and asked for my oldest daughter, stated they needed to talk to her about my youngest daughter and her husband.  I just took a msg.  I didn't know what they are about, but the next time they call, they will get an earfull, as I have worked for a collection agency and know the FDCPA rules.  If they break them i will file a compliant.  I am in TN.

They called my oldest daughter on her cell ph, and this in itself is illegal according to the FDCPA.  I advised her the next time they call to tell them this is a  cell ph and to stop calling, if they do not then they are breaking the rule.  

According to the FDCPA, they cannot present themselves as attorn or law offices, they can in no way threaten u in anyway, including to sue u, are not supposed to call u at work if told not to, are not supposed to tell anyone but u what the business is about, except ur spouse in some states not all.  I HATED it when i worked for a collection agency, but did learn some things.  I am waiting for them to call me back, so I can ask some questions and hope they break all the rules.

we received a call in the middle of the day from an "Investigator" (black female voice) named Sharon. (904)721-3708.She said "charges had been filed" and our party had to call back a.s.a.p. She even left an extension (207). My research led to this page. Pretty dumb criminals, as this is very tracable to Duval County Florida, and other information, from the number. Im in the process now, of having my son, who works for the DOD, trace these people down, we have access to a lot of resources. They called the wrong people this time.

This just happened to me, except This lady Sharon called my father's Job, becuase she couldnt get in touch with me. How she found  his info was the question?? but after i recieved the message I imediately contacted my Freind who happens to be the DA Of my City, he told me that there was no such thing as a search and recovery Warrant and it was a scam. i then called this lady "Sharon" Again and ask for her information and she refused to give it to me, i also ask if she was an attorney or some one who actually works for an attorney, she couldn't answer that either. So if you guys are getting these calls please contact your attorney and give he or she the phone number to call>>> after all its a crime to impersonate a law officer or even the county DA.. The caller, Shannon Black, called my cousin and said she needed me to call her within 15 mins or she was going to be in court against me on felony check charges. The only way to stop that was to call her by 230. She said that if I called her before that I could take care of this and it wouldn't be filed. When I tried to call the number back, I was told the number she left, 904-721-3708 x204, was not valid. I was freaking out trying to figure out what this might be until I decided to look it up online. Thank goodness for this site!

Threatening criminal charges to collect loans considered illegal

MARSHALL COUNTY, KY- Local authorities say an out of state collection agency is taking things too far.

Local 6 first got a phone call from a woman claiming her husband had been threatened with an arrest if he didn't pay off a debt he owes to a company called Cash Connections. We did some investigating and found out the agency, Smith, Dean and Associates in Florida, not only has the attention of people in debt, but also law enforcement who say their threats are illegal.

"He told me your butt better pay up." That quote is straight from a man calling himself an 'investigator' with Smith, Dean and Associates, a collection agency in Florida. The conversation was recorded by a man who owes money to a local loan agency in Marshall County.

More importantly, Byars says those threats are outside of what collection agencies can legally say to collect a debt.

The recorded conversation in question indirectly began at a Cash Advance in Benton, Kentucky. The company who runs the business, Cash Connection, is now using Florida based Smith, Dean and Associates as a collection agency. Sheriff Byars says it's a legitimate company that calls people who owe Cash Advance money, but the recorded conversation is something Sheriff Byars says is far from legitimate.

"I'm the one who signs papers to give them to the state of Kentucky, to have the state of Kentucky pick up charges against people," the collector says in the recording. "At that point, the state of Kentucky issues warrants."

The problem is that issues like debt collection are civil, not criminal.

"You can't be criminally prosecuted," Sheriff Byars said.

Sheriff Byars goes on to say the threats that the agency is making can result in charges. Criminal coercion is a misdemeanor in Kentucky, and so far five people in the past two weeks have contacted Sheriff Byars and County Attorney Jeff Edwards claiming they've been threatened with arrest and criminal charges.

Edwards called the collection agency. He says he was met with "adversity".

Edwards said of the conversation with Smith, Dean and Associates, "When I told him I did understand the law after having dealt with it over 20 years, he cursed at me and hung up on me."

Local 6 tried the same approach. When we called Smith, Dean and Associates, we got a different reaction.

The man we talked to said, "We do not operate like that. We don't believe in doing business like that.

"They (people in debt to Cash Connection) just don't have the money, so of course they're going to kick and scream and look for ways out and cause a raucous to try and get out of it."

Edwards noted that action against the collection agency has already been taken in Illinois. Smith, Dean, and Associates is currently barred from collecting in that state. For every phone call they make to people in debt, a $50,000 fine follows. Based on the recent actions of the past two weeks, a case is now being built against the company in Kentucky as well.

"Using this company that is using these strong arm tactics, that's just not a practice that I want to see here in Marshall County, or in the state of Kentucky," Sheriff Byars says.

Sheriff Byars and County Attorney Edwards believe these threats extend beyond Marshall County. They're planning on contacting the Kentucky Attorney General's Office to possibly have Smith, Dean, and Associates barred from collecting in Kentucky, as they are in Illinois.

They say if you've been threatened with arrest or criminal charges by this group, you need to call your local sheriff's department.

"That's not something that we need here," Marshall County Sheriff Kevin Byars said of the threat.

I got a call from a "Sharon Jackson, Investigator" on Friday. I called back this morning (after I checked the company out) and she was so abrassive that I still am shaking.  Mine was a check to one of those payday advances places in 2008.  She said I had a court date on Friday at 12:45 pm.  Then today she said she would release the paperwork to the county attorney for prosecution.  I am disabled and my husband is elderly and frail. My blood sugar shot through the roof and my bp is off the charts.  

I do background checks for a living so she or this company WILL NOT
get by with this.

No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

My sister recieved a call that I had one hour to contact detective Sharon Jackson about an investigation she was doing and that she was headed to court to sware a warrant on me and have me arrested.  My sister was so upset that she had to go to the emergency room with chest pains thinking her brother was in serious legal trouble.
When I called the number Sharon Jackson answered the phone extremly rude, and told me i needed to find GOD and get saved.  This whole experience was aweful!!!

I received a call from a Sharon Jackson claiming to be an investigator and that she was investigating a fraud case and I was due in court at 12:30 WTF?? She even called my employer and shared all my information with the RECEPTIONIST and when I called speak with her it was ALL BAD she was VERY RUDE. I asked to speak to a manager and got a Lisa Whitley and she called me all kinds of Home Depot hoes and I was a s**t and a bi*** too. then she hung up, I called back and ask for the owner  and got some old man and he told me Lisa was the owner. I plane to file a complaint what they are doing is illegal.
