Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. I get calls like this all the time from so many numbers that I can't keep track! I downloaded an app called Mr. Number. It's great! I block as many numbers as I want. I think I have close to 30 numbers blocked. These scammers have a way of altering the number that is displayed on the caller id. So they can just keep calling and calling with several different numbers. If I don't recognize it, I don't answer it. Then I google it and block it. They realized I started blocking them so they started calling from 'unknown' as well. Very irritating!

I got a call from this number and it was a lady who asked for me and I said what do I owe and she could not tell me and I called the 1888 number and they said I do not owe anything because I am not on their system

It is the Bureau of Collection Recovery.  A collection agency out of PA.  They call my house 2 or 3 times a week looking for my daughter's ex.

Me too call me 2 times a day once in am and once pm, never leave a messae and when i answer it is for some guy named george he owes over $30000 - law states if not person no financial info wish i could find george and let him know, since they told me the amount owed he could have it written off of his debt and filing with FTC for violation of privacy act.  I wish there was a way to stop this, since it is a computer that dials the number before transfering to a rep if answered you cant block it, at least that is what my phone carrier states, no can do - Government needs to do something about this seriously this is a violation of privacy especially if you have spoken to someone and have asked them to remove your number, If any of these officials running for office want my vote pass a law forcing companies to quit using automation on dialing numbers and enforcing removal if asked or requested, with fines and fees if abused!!!!!!!   If anyone out there ends up finding the solution, please let me know

I'm not sure who this company is, but when I told them they had the wrong number, a man told me that they did not have my number in their database. Funny, I still get a call from them at least once a day and when I pick up the phone, they hang up. I have told them around 15 times that they have the wrong number and to remove my number from their system. I hope others have better luck than I have had.

I just talked to these people. BCR VCR NCR whatever it changes every time I asked him what the name of the company was again. He insisted that my Walk all over ya account is now in DDR (whatever that means) as he says it will be taken out of my income taxes. He said that I had to pay it and I told him that I don't have to pay anything. I disputed the charges 5 years ago. Oh and don't forget that you need to check the VA law on STATUE OF LIMITATIONS they let it go for 5 years. I don't have to pay anything ever. Well he got irate and told me that I will pay this bill. And I told him to google my name and look at the law suit that I put on another collection agency. Well he called 5 minutes again cussing like a sailor. I think it is hilarious.

it,s some collection agency that buys credit write offs for pennies that then tries to collect an inflated amount of money from consumers who have had difficulty paying their bills and got behind (IGNORE) these people they are harmless vultures and have no power to discredit you.

Well guys it is a scam. Alot of it has to do with the fact people sell your information online. If you have recently applied for a loan online then you can bet you will be getting calls from all different types of numbers including this one. Make sure that you check the bottom of the online loan site to make sure it says not affillated with third party lenders. Since I have online loans i know about this. I have talked with these people alot and they almost got me the first time. Saying I owed on some past bills read me my last 4 of my ssn and address. They called my job and told my boss they were sending a police officer with a summons there. Very annoying and spoke with the FTC about it. They said it was a scam. From my experience it has to do with online loans and companies selling your info. Best bet is dont pick up or pick up and hang up immediately that way your number is cycled to the bottom and you wont get calls so often. Hope this helps someone because reading these posts when I first got calls definately saved me. BEWARE OF ONLINE LOANS PERIOD

Someone guy from this number just called and asked for my brother, all he would say was that it was a personal business matter.  I said he doesn't live here, so he asked if I had a number that he could be reached at, I said that I wasn't allowed to give it out, and asked for a number that I could give to him to have him call them back, but he just kept saying that they'd call back.  After I hung up, I called it back, and it went to a voicemail of a Rachel.

Have been receiving calls from them asking for my husband regarding an account that wasnt cleared, have had them hang up on me numerous times. They have been rude and disrespectful, wanting more money then I can pay and accusing myself of not caring about this 'account'.
Their so called customer service is ridiculous and even the Managers there seem like they have just been taken up off the street, given a desk and a title and told to seem like they know what they are doing...........
I want these calls to stop now.

I let this collection agency know if they called me back, I would file a harassment lawsuit for 500USD. They keep calling me and ask for someone that I have no idea who it is, and this is the FOURTH time they have called, and each time I told them that my number is a private line, and DO NOT CALL, but they insist on doing so... So, if they call again, I am filing suit against them...

There is no excuse for them to call me now that I have threatened them with filing suit against their collection agency.

Screw these scumbags.
