Missed call from this number at 2:38am.  I was asleep and never heard it.  I did not bother to try to call this number back.

I continue to get calls from this number.  When I return it via AT&T landline, it rings a fast busy signal.  I tried it on my cellphone and got a little tinkling noise.  Next step - calling AT&A to report.

Rcvd a call approx 1 pm from this number on my ATT cell.  Cannot call back - says wrong number. This guy needs to be stopped.

Called at 5:35 PM on 6/12- I didn't answer and they didn't leave a message.  I have Sprint.

I've received calls from that number today on three different cell phones on our family plan.  All three came in between 2 and 4.

Got a call from this number on June 11 at 442PM. I am with Verizon, so I don't think it is exclusive to Cingular customers.

i got a 'congratulations texas resident' before my cell dropped the call. telemarketing calls on my cell really hack me off.

On Sprint PCS, received first call from this # Sunday at 7pm.  This # has been on Do Not Call list for about two years now.  They're probably sequentially dialing.

Called at 11pm and left message about Vegas timeshare (ie. free trip to Vegas).  I get enough junk calls during the allowed hours!

I got a missed call from this number today (06/06/07)  -- if this is a telemarketer,then i'm lucky to not have answered my celfone! Did not even leave a voice message.

ive gotten this call 3 times while i was at school and i got my phone taken twice im so pissed and im like im not married i dont make money i dont wanna go to vegas and i dont make 45. he leaves voice mail messages too he called me at 157 pm today

I just got another call from the same guy but did not answer.  All I can say is "QUIT WHINNING" and do something about it.  I called the District Attorney's office and was told they couldn't do anything about it.  Maybe if 15,000 people called their office they would "rather" do something to stop it.  Also if you are on the "Do Not Call" list and you are called you have grounds for a lawsuit.  Put the JERK in jail.

I'm with Sprint and I got this phone call around noon and I didn't get a message. When I tried to call it back, I got the recording "The number or code you've dialed in incorrect."

called 3:30 AM. This is not the first time this happened. When i pick up, no one answers, or when i try to call back the number is not working.

I just got off the phone from Cingular to add another line to my plan. And I get a call from this number an hour later. I didnt answer it.

I keep getting calls from this number, on my AT&T internet line. When I
first got the line, I never got calls from 214-254-3095,602-624-4851,
602-624-0560, or 800-301-0117, etc. on this line. Then, AT&T and Cingular merged and everything changed. Go figure! What do the rest of you think? Think there's a connection? --- To the person doing this, if you're reading

seems this guy has my company's cingular account listings.  he's going through all the cell phone numbers on our account, in order, soliciting time shares.

In most of the instances reported on this thread, the caller violated Federal Law and the recipient of the call can sue for a minimum of $500 in damages.  This post discusses the party who I have reasonable belief is responsible and the law providing for recourse.

I received a call from 214-254-3095 on 3/11/07 for 18 seconds on my 800 #.  On 3/26/07 I received a call from 214-421-4196 for 36 seconds on my 800# which left a message on my voicemail.  The message provided, in part, that the caller, or party servicing the call, was digitalNRG, that its website is www.digitalnrg.com, and provided the following return telephone # 214-224-0770.  214-224-0770 connects to digitalNRG although digitalNRG now has a different telephone # listed on its "contact us" webpage and seems to change the "contact us" number routinely (confirmed through archiving websites).  

My 800 # records indicate that the location of these calls were Dallas, TX - also the location of digitalNRG.

Further research indicates that digitalNRG is a provider of....drumroll....autodialer services to, well, anyone.  

I spent time investigating this because I'm appalled that I PAID for an unsolicited telemarketting call.  When I received the message, I left a note for myself to check my 800 # statement to determine if the call came through that number.  All facts strongly indicate that I paid for 2 unsolocited telemarketing calls using autodialing services provided by digitalNRG for the profit of digitalNRG.

The calls to 800 #s are strictly prohibited by law and each violation entitles the recipient from $500 to $1500 per violation.  The Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, makes it unlawful for any person to make any call, without express permission, to any telephone number assigned to a "service for which the called party is charged for the call." 47 U.S.C. 227(b)(1)(A)(iii).  TCPA further provides that a person may bring an action based on a violation of the TCPA to recover for actual monetary loss from such a violation, or to receive $500 in damages for each such violation, whichever is greater.  47 U.S.C. 227(b)(3).  The damages awarded may be increased to three times the amount awarded if the court finds that the defendant willfully or knowingly violated the TCPA (not too difficult to demonstrate in this case).

As a plaintiffs attorney (class action litigation involving consumer rights and securities fraud), I thought this information would be of help.  There are a number of websites dedicated to providing individuals information on asserting claims against TCPA violators.  Without action, there is simply no reason for the wrongdoers to stop.  It's simply too profitable and a few single TCPA cases here and there is just a cost of doing business.  

These cases are typically brought individually in small claims court.  Class actions, a far greater threat to violators, are a hit or miss in these cases (depends on each state).  The two possible states in which I could assert a claim (the state in which the violator resides, here Texas, and the location of my firm which has the 800 #) routinely deny certification of TCPA claims (I initially intended to cause a class action to be filed).  However, some states have certified class actions asserting TCPA claims.

I will continue to monitor this board for further discussion.  I intend on filing an individual claim at a minimum.  My contact information is temporary5@yahoo.com
