These Herbacide Telemarketers are selling low quality products and has been a big issue in the Ag world for some time. They are getting your personal phone numbers and calling as early as 7am. Sometimes several times during the day. If you are willing to do the extra work, here is the best way to handle them if you want revenge. Talk to them as a buyer, ask them to explain their product. Keep notes on your conversation. Get the names of the Herbacides and any promises seller makes, such as "kills weeds for 5 years". Get their name (it will only be their phone name, not their real name) and tell them you need to prepare a large order, maybe up to $1000 or more. Hook them with a big sale. Now tell them you must get to work and since you can not receive calls at work, make sure they give you a contact number and extension. Don't let them offer to call you back tomorrow, tell them you are ready to buy big TODAY but you must get to work and you'll call them back in a short while. You MUST get their call back number. BE SURE to get their website and store location so you can study their products before you make the big buy. Be creative. The key is to get their WORKING phone number, store and address they are operating from. If you make the salesman hungry, he will be tempted to give you a working number. Once you have this info, call the salesman later with a question about the product, to verify the phone is working. Now turn this info over to your states Dept of Agriculture, your state Attorney General and the Federal Trade Commission. Make a report on harassing calls and calls before 8am. Next, call the company back and tell the salesman to put you on the "no call list". Then immediately write DMA below and have your number registered on the "no call list". If this company calls again after 31 days, you have a good case which could pocket you up to $500.00 for EACH call.

The Law

"A person who receives more than one telephone call within any 12 month period by or on behalf of the same company in violation of the regulations prescribed under this subsection may, if otherwise permitted by the laws or rules of court of a State bring in an appropriate court of that State:

A. an action based on a violation of the regulations prescribed under this subsection to enjoin such violation,

B. an action to recover for actual monetary loss from such a violation, or to receive up to $500 in damages for each such violation, whichever is greater, or

C. both such actions.

It shall be an affirmative defense in any action brought under this paragraph that the defendant has established and implemented, with due care, reasonable practices and procedures to effectively prevent telephone solicitations in violation of the regulations prescribed under this subsection. If the court finds that the defendant willingly or knowingly violated the regulations prescribed under this subsection, the court may, in its discretion, increase the amount of the award to an amount equal to not more than 3 times the amount available under subparagraph (B) of this paragraph."
