Telemarketer That Defrauded Missourians Through Robocalls Has Assets Frozen

Attorney General Jay Nixon on Thursday (Nov. 29,2007) obtained a court order freezing the assets of a San Francisco company that gave false information to Missourians in telemarketing calls selling credit card consolidation and credit counseling services. The order, signed by St. Louis City Circuit Judge John Garvey, was issued against Telelytics and its officer Scott Kaplan. Kaplan and Scott Olson, CEO of defendant Generations Direct, have been ordered to travel to St. Louis to give depositions regarding the false information.

Nixon previously obtained temporary restraining orders against Telelytics, along with Generations Direct and Vitelity Communications and their CEOs, in April and October. The April order was entered as a result of the defendants making telemarketing calls to Missourians on the No Call list, and the October order was due to allegations that the defendants were making fraudulent statements in those calls while attempting to make a sale.

Telelytics was making one million robocalls a week across the United States at one time, according to a deposition statement from Kaplan. According to Nixon, the defendants used automated calls to contact Missouri consumers and then told those consumers, among other things, that they had been approved to consolidate their credit cards down to as low as 1.5 percent interest; that the consumers had already been approved by a "certified non-profit agency"; that Debt Solutions was "dedicated to helping folks regain their financial freedom"; and that the consumer would be transferred to a "certified credit counselor right away." Consumers were told to call a specific person, "Karyn McCarthy," at an 800 number to receive more information.

Nixon says none of those statements made in the robocalls were true. Consumers who called back were eventually directed to representatives of a separate company who would try to sell debt consolidation and other services to them. "It was important to go to court while our lawsuit against these defendants is still pending and get an order freezing their assets to make sure Missouri consumers are protected," Nixon said.

According to Thursday's order, all assets and funds owned by the defendant Telelytics are frozen. Additionally, defendants Kaplan and Olson are ordered to travel to St. Louis at their own expense so that their depositions can be retaken in the case, and they also are ordered to reimburse the state for travel expenses incurred in taking the defendants' previous depositions. The depositions of Kaplan and Olson are to serve as a sworn accounting of the company's assets, including who invested in Telelytics, in what amount, the location of those funds and the uses to which the funds were put.

Karen is a bi***. Their company is so shady that NOBODY should give them any business. There was a case in the state of Washington against this company. A web search will provide you the link.

Yes, they only call me on a Mobile phone and yes I have been added to the national do not call registry. This company does not use this database, at least not for avoiding you. They should be made to pay civil fines for all of the people they annoy. I've received 5 calls a year for 2 years.

Just to be sure I will ask to be removed again, using the instructions found here on this page.

I receive the "Karen from Debt Solutions" recording at least twice a week -most recently 10 min ago. I have my calls forwarded to my current location which is out of state. As a result I have to pay for a long distance call to recevie the recorded message...

The problem with this plan is that sometimes these companies will use the fact that you called them as proof of an "existing relationship," and will continue to call you, or worse.

I got this call also. Here is a solution that we can all band together and use. Karen/Debt Solutions uses an 800 number for us to call back, this service isn't free for a company to have. Each call made to this 800 number does cost them money and if all of us call them, let their system answer, and hang up on them. Repeat 1,000 times. It will add up significantly. It will only cost us time because the number is free for us to call. Yeah, I know it is crazy, but if it ticks you off like it does me then I say let's do it!  Let's bombard this number with short calls to their 800 number (800-831-7668).  I like to see them try and write that off and get audited.

Hi everyone. My sentiments are with you on this number amongst others I have reported to this website.  Thank goodness we have this to vent our common frustrations.  Just FYI  there is a National Do Not Call Registry website whereby you can list your home#, Cell PH# and any other you want.  Just type the National Do not call registry in your search engine to ge to the site,  all the details are listed.  Best part is that it's good for 5 Years from date you sign up!  Remember too, that if you change your phone#  make sure you add the new one.  Hoe this helps everyone!!!

I received these calls also. Sometimes they ring twice, sometimes they leave a message. We are on the "opt out" call list for telemarketers. Apparently, nonprofit organizations can still call you even if you are signed up, but my bet they are just using that as a crutch and not legit. I am calling the Department of Commerce for my state to file a complaint on this number as we are on the "opt out" call list. There is a number most likely in your state that you can call to sign up for this. I called the Department of Commerce just now and they are not licensed in this state, so they are going to call to see if they can track them down and have them stop. I advise everyone to file complaints, as they are probably not licensed in your state either and probably fraudulent. The "do not call list" I believe may be a federally regulated deal also. I talked to the Attorney General and he said once you sign up it is good for 2 years, I believe, not sure if it was 2 or up to 5 years. Just a heads up, it might help eliminate these pests.

Answered this call to my CELLPHONE but there was no one on the other end. I dialed the number back on my VoIP line and got a recording from "Karen" saying she was not available (with a client or teaching a class) but option 1 would allow me to remove my number from their dialer. I went through the process so we'll see.

A friend keeps getting called by this number.  I did a reverse lookup on a whitepages.com and it came up with a VoIP company in Fishers Indiana.  A suburb of Indianapolis.  No one ever says anything and no background noises.  I'd really like to know how it seems that this number belongs to more than two companies.

I just received a call from Karen @ Debt Solutions. I call the 800 number out of curiosity, but it's just a recording for a school and how Debt Solutions isn't affiliated and they have no info about it.
Irritated, I hit *69 and it gives me the 317 number.  

So, I decide to call the 317 number. Indiana number. I get another recording. It's Karen! A different recording, gave me 3 options, 1 was if I got the call in error and I wanted off the list, thought I doubt anyone actually takes you off the list. 2 is to be connected to a consultant, 3 is if you aren't sure why they are calling and you want to know more. I chose 3. They said they are debt consolidation company, blah blah, non profit, blah, then it said to push 1 to talk to a rep. I did so. Silence for about 5 minutes and then it hung up on me.

If you push 2, Same recording as the first, but crappier sound. It put me on hold, played a little music. Then it gave me a LIVE person! I proceeded to let this person know of my experience on the phone and the hoops I jumped through to get to her.

Pretty much, they don't know you. It's an autodialer so even if you're number is not listed, it'll dial it anyways, since it's random! I gave her my phone number and she said she'd take it off the list. But, we'll see. Apparently, they have multiple 'call centers' across the country and maybe only that particular lady won't call me again. But, at least there's just ONE LESS. ^_^
