its the time of the year again that these scam people starts calling me trying to harass me or try to threaten me. Put an end to this please!

I too got the same message from ms Jones on 6/25/2013. I am a debt collector, have been for 15yrs. 1st, what the hell is the name of the company she works for, LLA? No list for that. I did have a debt for paday loan and settled it out with Ms Jones in December 2012. This message she left recently was for the written off balance of the debt. What people need to do is contact their states attorney general, consumer protection department (they are all on the AG's web site) and file a formal complaint. Here are the violations in general:
1. The only message that can be left on a consumer voice mail is one of the Foti message (s)
all 'foti's' have to state:
a. the full name of the party they are trying to reach
b. if this is not the correct party, hang up or disconnect
c. the name of the person calling along with the full name of the company they are calling from
d. the mini-miranda "this is an attempt to collect a debt, any information collected will be used for that purpose"
e. phone number of business.
***they can never leave any kind of personal info or specific info for the debt-could be 3rd party disclosure
2. Ms Jones states that ..."she has a claim in her office" that it is for 'depository fraud'?
a. "Claim" refers to a legal preceding-unless Ms Jones is a legal collector for a litigating attorney/collection agency, and by legal collector I mean she has the legal power to request and file a lawsuit against a debtor. The company and Ms Jones will also have to be licensed to practice law in the state that the consumer resides.
b. "depository fraud"? The truth be told is that you did not have the funds to cover a payment. Depository fraud refers to and insinuates a person who intentionally/knowingly defrauded a bank or financial institution (ie, ID theft, forgery, fraudulent schemes, etc).
******She and or the company she represents are not litigating attorneys, nor do they have law practicing licenses in the state of AZ or any other. Stating that you are committing a "criminal action" i also illegal. A collection agent and or company cannot threaten anything or insinuate they can escalate any collection when it is not in their legal power to do so.
3. "You have till 12noon Friday (and the date) to call back and handle this matter voluntarily..."
a. Or what????
b. The normal/average placement for new debts in a 'contingency agreed collection' (the original creditor or new holding creditor actually owns the debt and can recall it) will be 3-6months. Yes you need to resolve asap-if it is your debt! (Mine was already paid in settlement with Ms Jones 6months earlier-there was no debt).
c. 'volantarily' it would have to be, Ms Jones and LLA or what ever the company name is (it was TR) have no litigating ability nor are they able to do anything 'involantarily'. And FYI-no collection agency or payday loan lender (with thwe exception of federal lenders (ie Dept of Education, IRS, etc) can just attach a wage assignment without going to court and getting a judgement to do so. And even then it is only up to 25% of your paycheck. She cannot levy your wages or bank accounts!!!

Got a call and a message saying there were some legal proceedings from a loan, didnt even get my name right. Sounds like a scam.

I just got the same message left on my work phone. I don't have a loan out and Ms Jones even told me the name of my bank. Funny, I wonder if she knows that online payday loans are not legal for court actions.

A black woman who called herself mrs. Jones, she said that she had me for committing depository check fraud, hogwash this woman used scare tactics to try and scare me, it did'nt work she left me a voice mail that i saved. I called the number she left no answer. My message to her was NO WEAPON FORMED AGAINST ME SHALL PROSPER. MY LAWYER IS JESUS CHRIST AND HE'S NEVER LOST A CASE!!!!!! I can't wait to talk to mrs. Jones tommorrow, have i got a word for her BEWARE OF THIS NUMBER, STAND UP TO THIS BLACK WOMAN BY THE WAY IM BLACK TOO!!!!!!!!!!!!!!!
