I got a call from this number and they threatened to arrest me for cash advance. They have my Ssn and checking account info. I told them that I was a lawyer and in America unlke India people don't get arrested for not paying their bills unless you owe the IRS I also informed them that the american fraud agencies would pay them a visit in a couple of weeks in India since we have managed to trace the calls and that they should continue their scam that way we will hve a stronger case against them. The phone was immediately hung up

I have been getting the same call over and over again and they leave the same message with saying "good luck" at the end. I do have other legitimate creditors calling me and they do not speak like that. I received an email from a Elaine George as well with an attachment that looked like anyone could have created it- it was not official or anything. The people I was talking to had really weird names too like Christopher Chris, Dennis Daniel, and so forth. They said the name of their Company was ACS, Inc, located in California. Yeah right, they were fron India or some middle Eastern country. It was very difficult to hear them speaking. They too said I had taken out a payday loan in the amount of $350 and I owed on that loan. They said it was wired into my account with MetaBank. I told the representative on the phone that I never received these funds, nor have any account with Metabank.

Do not trust these people, and make sure you take the necessary actions to report them and block them from calling you.

I to got this call a cpl days ago.. Same long drawn out thing about an afidavid filed in my name.. She said her name was sherry snyder from Financial law division.. her client mark brown would file charges against me.. Wanted to know how i was going to pay the 783$ i supposidly owed.. Wanted my debit card number over the phone.. No way.. She said type this letter that says i authorize such and such to take this amount out of me account and include my card # and copy of my drivers license by end of day or my work would be notified.. didn't send the letter.  Called me yesterday on my cell and work.. left a messege.. i read on here and was ready.. I called her back and i layed into them..  I told her the following... I have retained an attorney.  I will not provide any info to you or your company without written confirmation of debt and confirmation of alleged lawsuit.. I have reported you and your company to the Internet Crime Complaint Center.. (which i did) and about that time she hung up on me!  Have not received anymore calls so far! Fingers Crossed

this is a faurd call that is getting in the way of work. I would like to know who asks for my attorney without telling me whats going on. Im sick of these companies that in the past when they took money out of my account my bank saw who it was and gave me my money back. I have been receiving the exact same type of calls. At first I was very nervous and thought the same thing. Elaine George was also her name. After reading this I called back and let them have it. All she kept saying is she wanted my attorneys name, out of the blue I came up with a name of an attorney that I know and she instantly hung up. I am also contacting my bank but how do I report it to the credit reporting companies?

I've been receiving calls from his number by a lady name with a heavy Middle Eastern accent name Elaine George. She had left a voicemail stating that there's a suit against me and if I didn't call back then "good luck". Ok, who as a debt collector would say that!?!? She had all my information so I thought the lawsuit she was referring against me was true. After several minutes on the phone with her, I became suspicious. She kept on telling me that I had to fax a Mark Brown a letter today to withdraw a large amount from my account on this date to settle out of court. I kept on asking her when did I take this supposedly loan out with Cash Advance America. She wouldn't give me any information and said she's only reading what is on my affidavit. She said according to the accusations, Cash Advance had been trying to contact me several times and failed and that is why I'm being sued in court. I asked her for a copy of my affidavit and she said she had to transfer me to her attorney that works in the office. She transferred me to a guy name Jose Sanders and he stated that they're license in New York and works for the Kings County Court House. I'm sitting here wondering why does a court house hire people to collect debt and they don't!! He kept on insisting that I hire an attorney and he would talk to them. I told him I didn't need to hire any attorney and I would like to get a copy of this affidavit. I stopped talking to these ridiculous people and put a fraud alert on all 3 credit report and reported it to my bank since they had all my information.  I have to add that these people are extremely rude.

I received 3 calls within 2 minutes from this number.  One call to my cell phone the other 2 on my work phone.  No message left from any of the calls.  Hoping the calls either stop or they leave a message so I can find out who they are and what they want.

I received a call from this number on my company cell.  The lady on the other end had a heave middle eastern accent. She claimed there was/is a lawsuit pending against me for a Cash Advance loan taken some time ago ( I couldn't understand what she said). She had my social, however, I didn't verify it. She wanted my attorneys information. I asked her her name, Elaine George is what she told me. She also claimed to be an attorney. The lawsuit she claimed has been filed in the Brooklyn County Court in New York and she needs my attorney to call her today because it the case will be downloaded today.  I'm not only calling my attorney but also confirming with the court.

I continue to get calls from this number on almost a daily basis.  I received 2 calls just today.  A message was left the first time, however, I believe my voicemail cut them off in the middle of it.  The 2nd time a message was left by a woman with a heavy middle-eastern accent who indicated a lawsuit for fraud had been filed on my SSN.  I deleted the message but called back asking why I continued to get calls from this company/number.  I was told there was a lawsuit for fraud filed against me and that they needed to obtain my attorney's information if I had one.  I advised the woman that I indeed had an attorney but would not provide any information to her or anyone from her company without written confirmation of the supposed debt to Cash Advance America and confirmation of the alleged lawsuit.  The woman promptly said, "Okay, goodbye then."  Really?  I would imagine that if there really were a suit against me, they would have notified by some other means than a vague phone call.  And they most certainly would not have had a problem providing me with documentation regarding the lawsuit if it were legitimate.  Ridiculous!  I'm hoping the calls will stop at some point.

For at least the last four years, possibly longer, a group has been calling former payday loan applicants advising them that they have defrauded a bank and are now being sued for non-payment of a loan.  The callers will claim to be calling on behalf of an attorney's office (name varies), the Dept. of Law and Investigation, ACS, or other similar combinations below:

United Legal Processing Division
Midline Marketing
Crime Monitoring Services
Monetary Crime Division
U.S. National Bank
Attorney General?s Office (usually in California)
American Legal Services
Affidavit Consolidation Services (ACS)

You will be threatened with arrest, a costly trial and possibly worse.  In no shape, way or form can you be arrested for non-payment on a consumer debt.  Do not believe these threats, as they are without merit and cannot be carried out in the manner they allege.  

Who are they?

In the past when pressed by law enforcement for an address, the callers have provided the following information:

They have been previously fined over $1.3 million for various violations.  They have been known to use phone banks in India to make their calls, which more or less coincides with the difficult to understand accent many of us detect when we are contacted.

On July 15th, 2010 a Public Awareness Bulletin was sent out by Missouri Information Analysis Center.  

"..received reports from individuals in Ohio and Illinois reference suspicious telephone calls they received. In both instances, the callers are reporting that a voicemail is received from a man, with a Middle Eastern accent, identifying himself as an officer working with the Financial Crimes Unit.  The message indicates that the reason for the call concerns a loan made by the receiver or someone in the receiver's family. The voicemail requests that a return call be made and a telephone number is provided. When a return call is made, the caller is asked to provide personal identifying information such as their date of birth and social security number.

Reports indicate that the calls are frequent and persistent and that they even threaten arrest or legal action if information or money is not provided. It appears that the individuals making these calls may have access to some records connecting individuals and their relatives.  Missouri does not have a Financial Crimes Unit and all indications are that this is a fictitious agency. If you receive a similar phone call, please be advised that it is a scam and please contact your local law enforcement agency or the Missouri Information Analysis Center at 866-362-6422."

Bottom line:

Do not supply the callers with any additional information.  Inform them you have reported them to law enforcement and hang up.  If you haven't already, go ahead and report the calls to local law enforcement, your state's Attorney General and beyond.  Look up the local Secret Service branch's information in your area and get in contact with an agent there.  

If you ever applied for a cash advance online, your information is out there.  
Possible sources for the breach of your privacy are:

* The scammers obtained your information from Teletrack - a reporting agency used by many cash advance lenders to determine their risk lending to you.  The service is able to tell cash advance lenders if you have existing loans with other companies, for example.  Many state laws prohibit borrowers from having more than two cash advances out at the same time.

* The scammers created their own fake payday loan application site.  People looking for a cash advance went to the site and applied, thus freely providing the scammers with their information for malicious use at a later time.  

* The scammers were able to get into the database(s) of cash advance lenders - probable targets being Sonic Payday and Cashnet USA.  


How to protect yourself:

* Inform your employer.  You are likely getting calls at home and/or at work, so make sure your employer is aware the calls are part of a scam and to not take them seriously.  Advise the callers that they are no longer allowed to call you at work.  If they continue to call, document the date and time of the calls you received.  Save voice mails left if at all possible.  

* Change your number(s).  For some this may not be an option, for others a one-time number change can be done free of charge.

Be advised - any references you listed on your payday loan application will be contacted.  Let those people know that this is a scam, and they can disregard.

* Use Google Voice.  Google Voice is a great replacement voice mail system for just about any phone number you use.  Messages can be transcribed and voice mail recordings can be saved as mp3 files.  

Pro Tip - call the scammers with a Google Voice number before turning off your old phone numbers.  Make sure when you call you identify yourself so they can start up their script.  At any point after they have your information pulled up just hang up.  They will then start religiously calling your Google Voice number.  At this point, you are free to change your regular phone number(s) and enjoy not having these people ever call you again.  (And laugh at the fact these people are basically talking to a brick wall several times a day)

The scammers change their numbers frequently.  Law enforcement used to think it was because the callers ran out of minutes on their prepaid wireless accounts or they were shuttered due to fraud, but now they understand it's simply to evade detection by savvy consumers online.  With the proliferation of VoIP, it's even easier for the crooks to stay a couple of steps ahead of law enforcement.  Below is just a sampling of the 30+ numbers that have been used in recent memory.

So can they really do anything to you?

It's not a simple yes or no answer.  Logic dictates that, if they really wanted to take you for a ride and drain your bank accounts, they already would have.  

So, why haven't they?  

Authorization.  

Why do you think you are being called so much?  Perhaps it is because they like the sound of your voice?  No, they have to have your authorization to take any form of payment from you, period.  The callers know their audience, and that audience is typically a bunch of people that have applied for payday loans in the past.  Most of those people they call couldn't afford an attorney if they wanted one, and are so used to receiving collections calls that so long as they sound like a real collector, they will likely be perceived as one.

Furthermore, they don't even really want to talk to your attorney - that just sounds official and scary enough.  A real attorney would take the callers to task and write them off as two-bit con artists.  The callers need you, in writing, to authorize payment against the fictitious debt they claim you owe.  Go ahead, ask them for proof you owe the debt - more commonly known as verification of debt.  See what they say.  A phone authorization carries very little weight, so if they have something signed by you on file, you are done for - and the callers know that.  That authorization is the only thing these callers are doing by the book, and for good reason.  If they just went all willy nilly and made an ACH debit from your checking account, without your written approval, you could in turn report the transaction as fraudulent to your financial institution.  In about 7-10 business days, you would get the funds returned to your account.  Then the scammers would be up against a bank and their team of lawyers and investigators.  

Bottom line:

If you haven't paid the callers a dime, don't.  If you planned on paying them to shut them up, just don't.  Remember - you are not being contacted by a legally licensed, ethically owned and operated collector.  Read up on the FDCPA - http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf - and know your rights.

The exact same thing happened to me, today January 10, 2011 is the most recent call. The lady (heavy indian accent) states this is from an unpaid loan given to me by Cash Advance America and charges have been filed in the Brooklyn County Courthouse.  All lies- don't fall for it!!  The number they're using when calling me is 347-416-5110.

I got a voicemail from this number as well.  I could not understand him too well for his accent.  He says his name is Atty William Jones which does not sound like one and said I didn't respond to them so many times which I do not recall any other calls from them.  They said that I will be arrested and such if I didn't call them back. If I didn't call them back was for not ignoring the matter and didn't want it to be resolved.

As of Thursday, December 16, 2010, I have been receiving a phone call at my job and my cell stating they are attorney. When I ask what this is about they state to me about cash payday loan which has not been paid and you owe $686.50 if you do not pay it now you can go to court, you will be charged with Check Fraud, Company Fraud and all the person has my wrong email address and I had said it and now she tries to used that one and than states if I want to take it to court or not. Than read the affadavit to me and all the information was so false. She stated it is Cash Advance America which I have no clue who this person is at all. I am at lost. They are harrassing me. I had asked to send me information stated she cannot do so and they been sending me emails. It was lies after lies. She has my last four digits of my ssn and my bank account number from what I know of. Please help me.

I took down as much information as I could and forwarded on this information to the FTC Bureau of Consumer Protection.  Debt wasn't legitimate as everyone has noted here.  Get their full name, company name, address, phone number, bar roll number if they identify themselves as an attorney from that state.  You can also verify online with that particular state if the bar roll number is legitimate or not.
