Just retrieving my messages and what do I hear this Middle-eastern guy telling me there is a legal or enforcement action against me and proceeds to say who I have the legal action with. Can not understand the name of the person that has the legal action against me. (of course)  When he called his accent was different both times.  I knew it was a scam from the beginning A 469 area code which is Texas and then a cell number New York. Scam, Scam. Not everyone knows and sends money. He said his name is Alex but can't understand his last name.  When I called the 347 number it does say a law fimr so I can see how people can get caught up in this scam.  I tried calling to report this but no luck.  I will read the above post and se where I also can report this.

I keep getting very aggressive phone calls, same ploys as above on answering machine. Going to be arrested, subpoena out, etc... that they hope we will make the right choice and call back. We have never taken out any loans, aside from our actual bank. How do we get this to stop?

I called towelhead back over 100 times thru the day, i hate thieves and man, he hated me after that.  I tormented the living crap out of him.  I am sure he didn't make a dime that day.
I told him if he wants to scam Americans he needs to learn proper english to do so, how can he run a scam when he sounds like he just fell off the boat?
I asked him for his social security number over and over, also about him sending me money, that if he didnt pay i was coming to his door with the police.
I talked about his country and how they crap in a hole...
Then when he would cuss back i would say, "i cant understand you" over and over, i would say are you saying F*** You?  Lets sound that out, i would talk about vowels, forming words, then he would hang up, and i would call him back, he would take his phone off the hook for a bit, by the time he put it back, i was calling again, i had other people calling him to...we would use different voices, all pretending we were scared of the IRS and how can we pay our bill, that they had called us, i kept giving him fake credit card numbers and info, i kept saying i was scared and that i was forgetting my credit card numbers, he would try and help me to remember, and just when he thought he had a real fish, BAM!  We would start laughing at him. Howling!

It was hilarious!  I had a blast and me and my friends were laughing so hard, we were crying!
Great times!

This is some coward hiding behind a magicJack device plugged in at some God-forsaken corner of the world where there is Internet service.  He's no better than a common criminal using a magicJack device and your fear the same way a common thief uses a toy pistol hidden in the pocket of his overcoat to make a bulge that looks like a real gun.

From phonevalidator.com :

Phone Number:    347-832-4519
Date of this Report:    April 28, 2014
Phone Line Type:    LANDLINE
Phone Company:    YMAX CORP -- POSSIBLE MAGICJACK VOIP

Phonevalidator.com does not keep track of numbers ported into and out of the various blocks administered by each phone company.  The most accurate information is only available to the phone companies, and you aren't going to be able to access this information.  For example, it is possible for someone to port their home phone number to a magicJack number without phonevalidator.com knowing about that.

However, there is reason to believe that this is a number originally assigned to a magicJack device:

(1) YMAX Corp. is a wholly owned subsidiary of magicJack, and assigns numbers to their devices.  magicJack makes almost all of their money selling these devices and the phone service that goes with these devices.

(2) Although it is theoretically possible to assign a number out of a YMAX Corp. block of numbers, it seems very unlikely that anyone ever does this, because the cost of using a magicJack is so low that it would be uneconomical to do so.

(3) In theory, at least, in some states it may be possible to get a YMAX Corp. number without using a magicJack device, it seems very unlikely that anyone would actually do so, because they may use a proprietary protocol for their service, and interconnections to the nationwide telephone system may not be perfectly reliable or even available in some cases.

On the other hand, a magicJack device is very convenient for scammers, especially those from overseas:

(1) They can access the United States and Canada without paying overseas calling fees from anywhere there is Internet service.  This means that the incremental cost per call, incoming or outgoing, is zero or close to zero.

(2) They are assigned a U.S. or Canadian number from YMAX Corp., so the person being called cannot know where the scammer is actually calling from.

(3) MagicJack devices can easily be obtained overseas and appear to come with a "free registration" (i.e., a free number) that you can use for a period of time after the device is purchased, usually at a very low cost to the scammer.

(4) The audio quality is very good, and can be used to give the impression of a busy call center by playing recordings of people taking or making calls in the background, even if the scammer has only one device.

In addition to the regular reporting channels, e.g., the Department of the Treasury, the FTC, and your local state attorney general's office, you might also report the abuse to YMAX Corp.  I have seen reports that they are pretty good at responding to complaints and may be able to permanently shut off a magicJack device, if necessary, so that it can never be used again.

The YMAX Corp. main web page is at:
http://www.ymaxcorp.com
and their site giving information on how to lodge a complaint is at:
http://www.ymaxcorp.com/contact.html

Note that the "contact" website gives a clickable link to a "live chat" where you can make your complaint.

Middle Eastern man told me to call this number and speak to Anthony Davis employee id 10036 concerning legal action against me from the US Treasury department. I called and Anthony Davis was another middle eastern man very difficult to understand. He said that I should have received an affidavit from the IRS for legal action against me. I told him to explain it to me and I put him on speaker phone. He asked me to take him off speaker phone and I said no. Then he hung up!

Same here. Allegedly named Mike Franklin. When the threats began I got tricky with him. I said that if he really was an Agent of the U.S. Treasury then I would cooperate only with a visit from an agent with proper ID accompanied by a uniformed local or state police officer. This flustered him a lot. He got mean. I told him that impersonating federal agents had serious charges and that I was going to immediately contact the Treasury with all the details of the call, including his name, number and location once I traced the call. Which I then did. I included a basic transcript of the conversation too. He freaked out and began yapping to someone in the background in a foreign language. I hung up......... I win. As the number traces to NYC, I recommend you also contact NYPD, which a cop family member of mine helped me do. Someone posted a great bunch of links on the first comment page with resources to educate and protect yourself from this predatory scum.

I also received a phone call from this low life asking for my incapacitated husband stating that he was from the Department of legal affairs from the US Treasury dept.   He stated that someone was suing my husband and he needed information.  At that point I told him that his mother should be ashamed,  that her son was such a bad con artist and hung up.  I was totally amazed that this oaf actually called back and told me that I better take the call seriously and told me to get a pen to take down a phone number.  I held on and just listened to thin air for a few minutes as his blood pressure started rise.  He then told me if I didn't take him seriously he was going to call the cops.  That just cracked me up....  I told him to have them stop and get me a coffee and donuts and I'd be waiting for him.  Amazingly he hung up.  And I'm still waiting for my coffee and donuts. I'm only sorry that there are some older folks that don't realize that these cretins belong back under a rock.

Got an annoyance phone call today Saturday 4-5-14 from David Brown at 1-347-832-4519, I think he is the same guy that called us several times last Friday 3-30-14, we kept hanging up on him and he would call right back, until we would not answer our phone. Last Friday he said his name was Charles Hedricks at 1-512-547-1244. Both times he threatened legal acting if we did not call him back at the numbers listed above. We have not called him back and nothing has happened yet. Must be some kind of a SCAM. I am going to report these annoying calls to the Ohio Attorney General and the FBI so they can stop this bad boy(s). It should be easy to catch them being they are so brazen.

Prank Call
A man with a think foreign accent has left multiple messages on my answering machine informing me that I MUST call him back or else become involved in some huge "legal mess". It is clearly a scam. I've reported it to the Federal Trade Commission and the PA State Attorney General's Office.  I am on the "Do Not Call" List, yet every day I receive upwards of 6 or 8 nuisance or prank calls!  I've stopped answering my phone.

John Smith with a Middle Eastern accent called my wife's phone and left a message saying if she or her attorney of record did not contact him as soon as she got the message, there would be consequences.  I called 347-832-4519 back and asked for John Smith.  He asked me if this was "Tina" and I said, "No, this is her attorney."  He said, "Thank you."
and hung up on me.  We get these on occasion and find that if you call them back repeatedly, they will stop calling and block your number.

I keep receiving calls from this number at my former place of employment. I am friends with the employee that is using my old work phone number. I was able to listen to the voicemail and the guy went on a 45 second spill about how he is representing a law firm and he has been trying to get in touch with me so I must be avoiding his call. And if I don't call him back it will result in legal action and would be very costly to me. The guy has a very thick eastern indian accent and said his name was John Smith...yeah ok :-/ THIS IS A TOTAL SCAM!

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I received several calls from this person, threatening me with having not paid back a "payday" loan (which I never took out). I asked him to tell me when I had taken out the loan and when it had been placed into my account he gave me a run around and finally came up with some off the wall number, I asked him to send me an email with something that I had signed or where I had agreed to pay this amount and if it was legitimate then I would be more than happy to pay it, he hung up on me. I was told that the bank had already written off the amount and I was going to be brought up on multiple charges and they would be filing an arrest warrant and the police will meet me at my place of employment. I guess I'll see what happens tomorrow. I've already pulled up my bank statements as proof that no money for that amount was never deposited into my account.

Came home after a long day and long drive, only to see these idiots had called me.  I called the number back, and got the usual crap--foreign-sounding male voice, barely comprehensible, identifying the number as some kind of "law firm."  Told them my usual answer: "GO TO HELL!"  Then...did what I usually do: hung up.  I don't think there is any way to stop these creeps, and going through the hassle of changing your phone number is a waste of time: they'll just track you down under the new number.  The "Do Not Call" list is a huge joke.  Just wanted to vent.

I was called by this number twice yesterday, and both times it was a middle eastern man that I could not understand. I hung up and he called the second time, pleasing for me to not hang up; that he would get his supervisor who spoke better English. By this point I was freaking aggravated and wanted to tell this "supervisor" where to put it. Once he got on the line, it was another middle eastern man who began threatening me. Said I had a loan that was delinquent and if I didn't listen to him and pay him the (undisclosed) amount if said loan, that the police would be at my door to arrest me. Beware. Threatening middle eastern lowlives can access your home address and cell phone numbers!!!
