MY DAUGHTER MADE THE SAME MISTAKE BEFORE..  AFTER SHE RECIEVES SO MANY HARRASSING CALLS FROM COLLECTORS, SHE AGREED TO PAY HALF AND BOTH PARTIES AGREED. AND SHE SENT THE MONEY. THEN THE LOAN GOT SOLD TO ANOTHER DEBT COLLECTOR. SAME RITUAL ALL OVER AGAIN. SHE HAVE CHANGED HER  PHONE SEVERAL TIMES. BUT THE THING IS THAT I  CO-SIGNED THAT LOAN. NOW I AM THE ONE BEING HARRASED AND I KNOW IT WAS PAID OFF. I TOLD THEM IT WAS PAID BUT WON'T LISTEN . SO I STOPPED ANSWERING. THAT WAS A COLLECTOR FROM LA , CALIF THEN. NOW ANOTHER IN GEORGIA.

MY DAUGHTERS MISTAKE:;;;;  WHEN YOU AGREE FOR A SETTLEMENT, TELL THEM TO SEND YOU A FINAL BILL.AND DON'T PAY TILL YOU GET THAT. OTHERWISE IT WILL GET SOLD OFF TO ANOTHER COLLECTOR AND THE SAME RITUAL AGAIN. REMEMBER TO ASK FOR A CLOSSING BILL/STATEMENT BEFORE YOU PAY IF YOU HAVE TO.

I continue to get calls from FIRST FINCL MGMT -- from 800-numbers and from 404-numbers;  they're not for ME, and may be for a female relative of my former roommate.
 I wont call them back and give them any satisfaction (and they dont leave a message anyway). They can't really hurt, since they're not looking for me personally.
When will they stop>  It's been 2 months of calls/hang-ups every other day.

First Financial Asset Management has shady business practices even for a collection agency. They are rude and scream and yell and even curse. I have not spoke with one person who I would ever deal with again. So I get this call from First Financial looking for a Vernita Davis...I told them in a very loud voice "I'M NOT VERNITA DAVIS" and they proceed to tell me "How do we know you aren't Vernita Davis? We don't know your relationship with her".  Told them I'm gonna call the cops and her boss if they keep harrassing me.  She hung up during my VERY loud rant.

I've receieved a call from 4045230411 over the past week, the individual was leaving a message for me to call their office, but not leaving any details about what it was. So I did a little research and found this site. Then yesterday I received a letter from this company claiming that I owed them money on an account that I had several years, however I immediately remembered that I had paid this account off over 4 months ago with Tate & Kirlin. So today, I called the number, and I found out that this company doesnt seem to like to talk to you when you tell them that they are trying to collect a debt that was paid off. When they picked up I was immediately greeted in a snobbish tone, and as I proceeded to tell the woman that they were in error, I was immediately placed on hold... every 30-45 seconds being greeted again and asked to hold for over 10 minutes, seemed no one wanted to talk to me since I didnt owe them money. After the game of hold-tag, I was then greeted by "andrew" who asked how he could help me, I told him about the hold-tag game then proceeded to tell him about the account, he then asked about a letter of zero balance, which I told him I had one on the way. Suddenly his tone changed with me and I was told "I dont know why your getting called, your account is closed". Shocking and surprising how quickly my account was closed and I should have never been getting phone calls about the account, one they should have never had. Sounds like a shady operation to me, one that preys on the uninformed. If you get a call from them, make sure you find out what account they are claiming you owe them and see if you have paided them off previously, else you might be paying more for an account you have settled a long time ago.

The lady was very rude and abrasive, I told her to stop calling me and she said "Uh uh, not until you give me the number of the person she was looking for" and then she hung up on me! as soon as I told her agian that once she was informed to stop calling this number it is the law that she has to stop.  I take this as harrasment and have to assume it is sanctioned by First Financial as ok for their employees to do.

You know what ? I hope that one day you don't have to be in today's economy and loose a job or have to sell a house and then find another one in another state and then on top of all that crap have to have these fools contact or rather harassing you without any PROOF of YOU owing anything.

You should be ashamed. While YOU MAY BE BIG AND BAD and have a car, house job kids (or not  ) wife or not ...be thankful that you you have all that. Many now adays can't get rid of a new home built in 2003 without anything wrong with it and a rejentrofied neighborhood and no one is helping .

So, BEFORE YOU SAY WAH WAH WAH.....Think about paying two mortgages a car payment so you can get to your job two sets of utilities and some other bills that you had intended on (if things -- economy)  weren't so screwed up paying.

So think about the other person. Quit being so rude. I would like you to come out of the bathroom and s*** out 5000 a month. go ahead try it oh right you have a money tree in yyour backyard.

People losing jobs, economy down and people being picky about housing market along with tons of short sales going on.

BE THANKFUL AND QUIT BEING SO HATEFUL...KARMA WILL KICK YOUR ARSH I AM TELLING YOU.

That's all I have to say...mr. "pay your bills"...with what if you don't have a job or have to pay on two homes and all that goes with it. Answer that one? You try it.

One more thing, NO LIFE DOESN'T WORK THAT WAY...LIFE NEVER WORKS THE WAY WE EXPECT...SOMETIMES LIFE IS EVEN STUPIDLY UNFAIR but you don't need to downbeat a person for speaking their mind either. Life ....is supporting each other and caring about people not being mean and hateful.  There are some ppeople that are dodging and very good at dodging the system however not EVERYONE is like this and you are very rude and disrespectful in  my opinion. No, I did't go to college to learn that either...that costs more money.

The own CREATOR ALSO SAID TO HELP YOUR NEIGHBOR WHEN THEY ARE DOWN AND OUT AND TO TREAT OTHERS AS YOU WOULD LIKE THEM TO BE TREATED .....ISN'T THAT A COMMANDMENT ON IT'S OWN? THOU SHALL LOVE THY NEIGHBOR AS THYSELF?

Thank you.

Veronica

p.s. I owe my famly money and they are not UP MY BUTT nor would I ...that's not what family shoudl do...some again do some don't ...I feel sorry for you if you expect that ...the old addage applies...dont' give out money unless you expect to never see it again.

Thanks

From Federal Trade Commission Website ? FAIR DEBT COLLECTION PRACTICES ACT
Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

Do any of you know about the FDCPA? You can search for it on google. It tells you what collectors can and can't do when they are trying to get money. They are not allowed to talk to anyone about the debt besides you or your spouse. Collectors can't even call the police or file charges about it or even put it on your credit report.  If they even swear at you, they are breaking the FDCPA. Attorneys can help if they are bothering you about debt 877-909-MARK for Mark Carey Law Office I didn?t Pay anything really He?s a good guy. Keep good records - every time they call, write it down. I received a call to my personal cellphone from this number, which I called back because I have family out of state, and you just never know.  When I called back, I got a pleasant enough girl, who quickly took my name and transferred me without another word to a man that was not so pleasant.  He said he could not find my name or number anywhere in the system, and that their company never called me.  I found that to be awfully strange since I just pushed send on my cell when accessing MISSED CALLS.

These morons keep calling for "Pol Pot"(The Killing Fields)-leader of the Khmer Rouge Cambodian Communist Party who exterminated 2 million plus people during his regime.I sent their corporate website an email with a history lesson attached that I hope got their attention so they stop calling my number and waking people up to answer ridiculously stupid phone calls.Must've been a real brain surgeon who gave credit to Pol Pot,and then the idiots who are wasting their time and resources to collect a debt from a dead war criminal.Besides the harrassment lawsuit that should be filed,I wonder if I should hire a collection agency for the history lesson and my time wasted online after being rudely and ridiculously awakened by their calls?P.S.> I DON'T OWE ANYONE SH*T,so comments by parasites like some of those posted above who obviously work for sleazeball outfits like that about how "whiners" should pay their bills should come to my door in person instead of hiding behind a telephone or keyboard like little,yellow worms to collect Pol Pots debt.If I'm mistaken in my assumption regarding his choice(or limitations)regarding his job title-then he must just be another trust fund baby with enough money and time on his hands to sit behind his computer commenting on other peoples misfortune to make himself feel better.In closing keep in mind that when you focus your comments towards those less fortunate than yourself in a vain attempt to take the attention off your many faults-"You might be wearing an Armani suit and silk underwear(or pink patent leather panties) and the people you put down might be wearing old ratty clothes and be waiting for the Sherriff to come and evict them-BUT YOU GOT THE SAME BROWN AND YELLOW STAIN IN YOUR DRAWERS!BUT WITH ALL THE S*IT YOU TALK THE WORLDS BETTER OFF YOU DO IT FROM BEHIND YOUR COMPUTER AND SPARE SOCIETY OF YOUR CHRONIC HALITOSIS ANYWAY!Smell ya' L8'er CHRUMP.
