The people who get payday loans, it?s not like people intentionally refuse to pay them back.  The fact is if you know the economy is bad such and we all are suffering some kind of economic status woe.  Then why would anyone give someone a loan if they know they can't pay it back.  95% of people who get a loan desire to pay them back.  There are times when people experience unexpected financial hardships.  

It is you and the loan companies who need to understand this.  Another issue is revolving loans that check your credit and see other revolving or loans on that report.  If they see this than why would they even give someone another loan?  I will answer that, it is greed and they suffer the consequences of not receiveing payments.  No one can pay off anything if a loan company constantly tacking on more money, such as late fees and over draft fees.  Since this is the case it's just as much as their fault as it is the borrower.  A lone company should have better policies, rules, and regulations than what they have.  

But again because of being greedy is reason they get themselves as well in jeopardy.  So don't blame the borrower because they hit a dead end street and can't pursue their payments.  Most of these companies will not even work with their borrowers.  Loan officers and companies are delighted to give anyone a loan.  Once the borrower fall behind or can?t make payments, these loan companies change from an enlighten one to a dragon.  One last issue, turning anything over to a collection agency is a bad idea.  Work a payment plan out with your customers (borrowers) and try and get your money back.

1.  What is a "BAHKING SCAM"?  Does it have something to do with the culinary arts?

Failure to pay back a loan does not constitute "check fraud".  Debt is civil, not criminal, so no, you are NOT going to jail.  Making threats like this is a violation of federal law.

Per the FDCPA (the Fair Debt Collection Practices Act) - you should NOT pay any caller who refuses to MAIL a debt validation letter showing that you owe a debt and that the caller has the legal right to collect said debt.  Refusal to mail this documentation within five days of the initial call is a violation of federal law.  In fact, you shouldn't take the word of ANY caller - make them MAIL you proof of debt/proof they can collect as is your right.  I would also question any collector who uses "extreme scare tactics" - that is illegal, per the FDCPA.  Debt collectors bear the burden of proof to show that you actually owe them money - you don't have to prove anything.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Same thing happened to me today. A lady by the name of Dana Clark from risk management called me. Said there is check fraud charges against me. A long time ago, I borrowed from a payday loan and never paid it back. She said I would go to jail if I did not take care of it today by 1:30. I was all for paying back my debt until she said I had to wire the money through money gram or through a bank. That was a huge red flag as I had borrowed from another payday loan place that I had forgotten about due to some personal issues. they read me the same riot act, but were willing to take payments from my debit card or cc card. I agreed and looked them up afterward. They were legit but used extreme scare tactics to get there money. It appeared on my bank statement as the name they had given with a phone number I called. All was right, but this lady did not know I went through it already. She did not even give me her company name. Other than the initials of a company I'd be sending the money to. When I googled it, there were complaints against it stating the exact same thing happened to them. I guess I will take my chances of something worse happening. I don't trust them.

A woman named Chelsey called asking for my husband. I told her he was very busy working (he was) and she proceeded to tell me that he has charges pending aginst him. I found this very interesting because he has never been in any trouble in all 43 years of his life. I googled this number and had to laugh because he has never as so much been through the state of Georgia let alone spent enough time there to aquire charges of any kind...Nice try I'm not Stupid!!!

Thank you so much Chief O'brien. I'm glad you were able to help me. I had a check that I forgot about that he investigated. I was able to take care of it through a company that I spoke with directly! This man was extremely nice and yes, I remembered writing it, with my bank confirming the transaction.
