I get a call from A Nicholas Smith with a threatening call about a lawsuit against me. The voice was an electronic voice trying to sound human, but the message has been used so often that it can not mask the sound of an electronic voice. They called my step daughter as well. I do not know how they  associated me with her, as we don't communicate, and she lives in another state with a very different last name. This needs to end

This has gone on for three days now. NICHOLAS SMITH. HE JUST LEFT A NASTY MESSAGE
STATINGHE WAS GOING TO FILE CHARGES IN MY COUNTY FOR A payday loan. I have no idea what he is talking about. NC. Has laws against predatory lending in our state. So it's bogus. Just tired of the calls. Wondering how he got my work and cell phone numbers. And the last four of my social.

RECEIVED A CALL FROM THIS NUMBER LAST WEEK SAYING HIS NAME WAS NICHOLAS SMITH AND WAS WORKING WITH THE COUNTY IN WHICH I LIVE REGARDING CIV\IL/CRIMINALMATTERS THAT WERE VALID AGAINST ME. I LOOKED UP THE NUMBER AND FOUND THE SAME PERSON HAS CALL OTHER PEOPLE. I CALLED THE NUMBER AND IT WENT TO A RECORDING SAYING IT WOULD TRANSFER TO A NICOLAS SMITH. I FOUND IT INTERESTING THAT IT DIDN'T MENTION A COMPANY NAME. THE SAME NUMBER JUST CALLED ME ON MY CELL AND WORK PHONE BUT LEFT NO MESSAGE THIS TIME.

Caller claimed NOT to be a debt collector but wanted me to settle "out of court" for a bogus debt that I never heard of.  When I asked for his company name, it was "IBM & Associates", a company which apparently doesn't exist.  He wouldn't give me his business address either.  When asked if he is refusing to give me the mailing address, the reply was "absolutely".   He then said he'll send a court summons and hung up.  Which was interesting behavior for a company who supposedly was getting paid for "arbitration".

Same as above. Got a call from "Nicholas Smith" (fake name) this morning. Stand strong and resist giving in to these fraudsters! I know it's tough, and they're persistent because they want to seal your money, but if you give in, they win. Make sure you report these sorts of calls to your state's Attorney General's Office.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I got a call from this Nicolas Smith. he stated that i was being sued for a debt. he also saying he is working in conjunction with Madison County states attorneys office. he also had the last four numbers of my SS. everything I am reading he is a scam.

Nick has called my sister in law trying to get a hold of me, he has also called my old job and then finally he decided to call me yesterday. He left me a message stating that since I do not respond to him that he has no choice but pursue legal action, on what I have no idea and don't really care. He stated he is going to file the complaint with the courts in a county that I do not even reside in so hey let him have at it. I don't have time for stupid.

I got a call from Nicolas Smith saying that there's a criminal summons out against and I'm being investigated for fraud. on February 13, 2013 I took out money from a lender I never heard of Evergreen and I breached my deal with them. They threatened me continuously to get money out of me.
