I was scared to death because they said I would go to jail! I got the exact same call. A lady named Lisa Fernandez said that she would work with me to handle the matter outside of court but when I asked her to tell me what company I owed she couldn't tell me and said it was against the law to fax or email me any documentation.

This is a criminal extortion scam operating out of India. They are making the calls utilizing VOIP and the names of legitimate firms to make it appear the calls are originating from within the US. There is NO "company" or "debt" and you will NOT be arrested. They are harvesting and/or buying consumers' personal identifying information and you need to do whatever you can to protect yourself. This includes: Notifying the FTC: https://www.ftccomplaintassistant.gov/, placing fraud alerts with all three credit bureaus, notifying your bank and employer and letting these criminals know you are aware they are attempting to extort money for a non-existent debt and have alerted the authorities.

Hundreds of thousands of cash-strapped Americans have been targeted by abusive debt collectors operating out of overseas call centers suspected of links to organized crime in India, law enforcement officials told ABC News.

The calls are part of a massive scam, one that appears to target struggling Americans -- especially those who have gone online to apply for payday loans. Armed with personal information from those pilfered applications, the threatening callers, who claim to be debt collectors poised to initiate legal action, have managed to pry loose millions of dollars from their victims -- even when the victims never owed money in the first place.

"This is what we call a phantom debt collection scam," said Jon Leibowitz, the chairman of the Federal Trade Commission. "It's a very pernicious and innovative new fraud."

Working through call centers in India, the commission estimates that the criminals have dialed at least 2.5 million calls, persuading already cash-strapped victims to send them more than $5 million. Some have reported receiving dozens of calls per hour. They are victims like Cindy Gervais, of New Orleans, who went online for a quick loan when her husband's car was hit by a driver who didn't have insurance.

Even though she paid the loan off, the so-called "phantom" debt collectors with Indian accents began calling to say she still owed money.

"He more or less told me that if I didn't pay, they were going to have someone on my doorstep to arrest me," she told ABC News. "And that they were going to contact my place of business, and tell them what kind of person I am."

At first, she said she resisted. Then the calls became more frequent, and started to ring on her cell phone, and at the grocery distribution company where she had worked for 27 years.

"I was more or less in panic mode because he told me there would be someone before noon at my place of business to arrest me and take me to jail," she said tearfully. "So I agreed to pay him."

After receiving scores of complaints, investigators with the FTC said they began tracking the calls, and following the payments. They alleged the payments led them to a California company run by an Indian-American named Kirit Patel, and that such scams would not be possible without American front men.

"I would say that all roads of this scam, or many of the roads of this scam, lead back to Mr. Patel," said the FTC's Leibowitz.

ABC News tracked Patel for weeks, from the suburbs of San Francisco to Austin, Texas.

Patel refused to talk. But his lawyer, Mark Ellis, said he believes it is far too early to pass judgment on his client. Ellis, a Sacramento-based attorney, told ABC News that Patel was hired for a nominal fee to set up an American shell company, and had no idea what the call centers in India were doing.

"I can tell you, he was as snookered by the people in India as anybody," Ellis said. "He's a 69-year-old man who is nearing his retirement who thought all he had to do was set up some corporations and everything was on the up and up. He's completely dismayed that he has become the lightning rod of this entire problem."

A close friend of Patel's also defended him in a brief interview at his home, saying Patel was not trying to defraud anyone -- he was just an unwitting, bit player in a larger scheme.

Good thing I decided to google this #. I as well got a call from this # and freaked out once they told me that I was being Sued for something that I didnt even kno. Tomorro I am definitely gonna report it to the police i couldnt do nothing about it today since I was stuck at work.

Same thing happened to me. Broken English speaking man left me a voicemail and told me he wished me luck if I dont call back with an attorney. People fall for stupid scams like this all the time! I called him back and told him to quit calling me they have the wrong number. He knew my name ( I said no I am not that person) but I am the person he asked for. He then giggled and said I will have them not call you anymore (yea right)

This company keeps calling me and saying that their company put money into my account.  but when i ask them what account they don't answer me.  this is so funny because my one account is closed from the bank and the other one was in a neg 4.00 balance for weeks until i sent 2 small amount of check that total 6.01 so now i have only 2.01 in there...

Your callers are foreign scammers trying to scare people into paying bogus debts.  In the US, debt is civil, not criminal, so you cannot be arrested for failure to pay back a loan.  Also, you should never pay any caller who refuses to mail proof that you owe a debt to them, per the FDCPA.  Please do report your callers to the FTC, FBI and your state's Attorney General.  Also print out this forum thread to give to your HR Dept and/or manager to alert them that you're being harassed by offshore scammers.

You already have your answer - the callers are scammers.  The only thing you can do to stop them calling is tell them you know they're frauds, you will not be paying them, and that you've reported them to the FTC, FBI and your state's Attorney General.  Please also advise them you're recording them every time they call - scammers usually hate to be recorded.  

You can block their number(s) too (ask your phone service provider to do so if you're not sure how) or assign their number(s) a no-ring tone so they go straight to voice mail.  Other than that, ignore.  If they're bothering you at work, please do print out this forum thread to give to your HR Dept and/or manager so they know you're being harassed by scammers.

I recevied a call today at 3:20 on my cell phone and my direct line at work. the women told me my identity had been stolen and they also had my SS#  told me i would be served papers tom. at work and taken to jail. my wadges at work would be garnished, they will contact my employer to tell them what kind of person i was.  They said i took out a loan for $8000.00  from US CASH and  If i did not want to spend Christmas is jail i needed to pay them $389.84 today.   come to find out another lady i work with had this exact same thing happen to her this yr and the calls continued for months. I did contact the Police Dept. to report this  they said they were calling from Hudson Law office TN 37620   her name was April  phone # 423-375-2461 ex 361

One important thing to remember if these losers have any of your personal information such as your social security number, date of birth or drivers license make sure you register with identity protection notify the credit agencies as well as your banks!!

I too received several phone calls from a man with a heavy accent stating that I need to call him back or there will be trouble to pay. He also said that the best thing that he could do was wish me luck on whats coming my way. Then another man called my job from Dan Hudson Law office stating that I will be arrested for fraud and stealing money and that my job and my home will be raided, and at the same time the man was calling my cell phone. Some how they had my personal information already and the man kept telling me that I need to confirm the info and I hung up on him. He then called back and stated that he has all of my personal information including bank account numbers to my bank and my routing number as well as my ss# and that he could do whatever he wanted. I then hung up and contacted my local police department who then informed me to contact the state attorney general. The man called me again and I answered to tell him to stop calling me and he just starting laughing and stated "Now you wish that you answered my calls" and then he hung up in my face.

Just got a message from this people saying the same thing that it is an important message that i need to call them back.if I dont want problems. I dont know who these people are or what they want but I am calling the police to report this and somebody has to deal with this assh..... My husband just  informed me that he too got a phone call saying that there was a criminal suit against him for stolen money.  They told him that he needed $7000 to retain a lawyer at which point my husband hung up on them.   They called back and he also had a hard time understanding them due to a heavy accent.  They threatened that he better pack his bags and leave tonight because they would be here to arrest him.   SERIOUSLY????  What are these morons thinking?

They just called me at my work.  He had my name and SS# and asked me if that was correct.  I told him not to call me at my place of employment.  He proceeded to tell me he needed my attorney's information to file legal papers against me and inform the police department.  Little does this *%&$^ know but I've worked in the legal field for 20 + years IN COLLECTIONS and know this is not legal nor legitimate.  I have filed a complaint with the Federal Trade commission and the FCC.  I suggest you all do the same. He claimed the name of his firm was "Dan Hudson Legal Associates"  I googled it and there IS a Dan Hudson attorney but works for another firm.  Collections is not a part of their practice FYI.  So looks like these a holes are using some attorney's name to sound more legit.  I have considered contacting the attorney and informing him.

These people keep telling me they are filing a lawsuit against me  for a loan i supposedly took out in october. But never repaid.  They hung up on me when i started asking  questions. So i called back. To be told  that he would not speak to meand thathe had fwent forward with the lawsuit . They hunv up on meagain.  Thencalled back and. Told my husband that i would bepicked up at 11am tomorrow  .  And hung up again.  So. I called thepolice.
