I just received a call from someone stating they were from a lawyer's office. I called number back after I listened to the message and very politely asked for the name of the company and the guy said this is a lawyer's office so I asked for the name again and where they were located. I couldn't understand the name but he said they were located in Washington. I asked to speak to a supervisor and he hung up.  Why have the nerve to leave a threatening message if you are just going to hang up when you get a call back? I tried calling back several times after he hung up and got a busy signal. Interesting...

Debt Collector
Received a call from Mark Smith (sounded like a very thick middle eastern accent-sorry, I am no specialist in this area) who claimed to be from an attorney's office in Redmond, WA.  The "attorney" would not provide me with a street address, said he would try to work with me to resolve the matter before legal proceedings were filed. At first he would not even give me any information regarding who was filing suit and on what grounds, only that I was going to be served and arrested within 30 days. He claimed that I borrowed $8,000 from a payday loan company (actually it was only $100) and that they would settle for $5000 today. When I told him that my loan was paid on time and that I had no intentions of paying him or anyone else $5000 for funds that I've never borrowed, he told me that I should hire an attorney and they would see me in court.  After the phone call, I was a little shaken, but suspecting a scam, I went online and googled the number and this came up:  http://consumer-law.lawyers.com/consumer-frau ... Collectors.html
I called the number back several times only to be received with hostility. I informed the "attorney" that I suspected a scam and was filing a report with the FTC and Attorney General's office.  The supposed "attorney" stop answering the phone when I called (it rang like 25 times,  what professional office does that? ) and eventually the number only comes up as busy.
Thank God for google and sites like these, because even though I suspected a scam in progress, now I know for sure.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

  This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

? filed under: Press Release

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

I same thing happened to me last night. When i asked to speak to an attorney he put me on hold. When the "Attorney" came on the line it was the same person identifying himself as Travis Hall. First he said he was an attorney then he said he was a paralegal. Then he wanted me to go to Wal-Mart and purchase a money card that had no paper trail. i believe when he calls back tomorrow i'll have the sheriff's department answer the phone. I told this "attorney" to call me back at a specific time. I will be at the department waiting for this idiot to call back. What really got to me was the fact that he was actually trying to read me my rights over the phone as if I WAS being arrested.

I too, received a call from 425-880-2789. A "Steven Foster" left a threatening voicemail on my phone saying he was from a Law Firm (which - no offense intended) he stated in such a heavy Indian accent I never could make out the supposed firm's name.  He threatened me stating that they were going to sue me over my "social security" #.  When I called back I immediately asked to speak to a "supposed" attorney whose name was "Daniel Cooper".  I plainly stated that i did not appreciate the voicemail I was left and who was this? The moment I mentioned I was reporting them to the BBB - he hung up. I am Highly concerned because I ask how did these people even get my phone #.  Be very aware.  I have reported this to the Better Business Bureau and will be reporting this matter to several other agencies'.

This same phone number has called me now for weeks. They finally left me a voice message, a threatening one, very vauge but to the extent that I better have an attorney and fast. I took a break during my work hours and called as I was concerned as to what it could be. They answered the phone, this is the Attorney's office. I asked who the attorney was..... got no response.They then proceeded to tell me that I failed to pay back an application fee of $250 and that I have committed a criminal act against my social security number and have also committed fraud. I asked who was suing me and why this is the first call. They  They were extremely rude and extremely aggressive. I said send it in writing and they said not to worry that the Sheriff will be at my door Monday morning with the papers and to arresst me. I'm fuming right now. I have filed a police report and I hope that whomever is behind this gets some major time in jail. I cannot believe this happend to me. Please people beware! Something needs to be done about this. I was in tears and went to my boss a complete mess because I actually believed that I was going to get arrested.

Received a voicemail from this number today. Called back and was put on hold before being transferred to someone else. This gentleman had a very heavy Indian accent and read me some type of document and asked me to not ask questions until he was done speaking. Once I heard that this was in regards to a payday loan, I began to ask questions. I was told that I owed $489.50 and had to send $200 today or else I would be arrested at my place of employment tomorrow. I almost gave in and sent $50 to make sure I wouldn't be arrested tomorrow, but then I got very suspicious when I was asked to go to a CVS or Rite Aid to put money on a "pre-paid debit card" and to call them back once I had the card number so that they could get a payment plan set up. Once I heard this, I hung up. I called Speedy Cash (where I have a loan that I defaulted on back in 2009), and was told that all I owe is $118.00, which is a lot less than what the scammers tried to tell me I owed. BEWARE OF THIS PHONE NUMBER, THEY PORTRAY THEMSELVES TO BE REPRESENTING PAYDAY LOAN COMPANIES, WHEN IN ALL ACTUALITY THEY ARE NOT REPRESENTING ANYONE BUT THEMSELVES. DO NOT SEND ANY MONEY. ITS A SCAM.

I missed a call  on my cell phone from this number and they quickly called my job. When I answered, the gentleman by the name of Alan Woods ( ironically heavy middle eastern accent ) stated he was going to read me an affidavit and I shouldn?t interrupt him while he was reading it. Apparently I am being served a subpoena and have a warrant for my arrest for a pay day loan I never paid back. Although I do have outstanding pay day loans, all are in payment plan form and have not been defaulted on. This guy couldn?t tell me the date the loan was originated, let alone the name of the company that issued it. All he said was it was a company named ? Cash US ? and they also do business as other entities such as speedy cash, advanced America, etc. I was told I would be issued a subpoena and a warrant for my arrest Friday. After about 30 mins on the phone ( since I do have pay day loans ). I told him what I can do in terms of paying back. Told me he would be able to offer a OCCR which I guess is some kind of payment plan but he would have to verify it with his 3rd party ( which was the so called loan center ). He called me back about 20 mins late and left 3 messages and when I finally called him back he said ? what  happened, I have been calling you and you haven?t called back?. He went on by saying they are willing to work something out with me, but I needed to pay $ 1300.00. After I laughed, I told him there Is no way in hell I could get that kind of money. He then asked for at least half of it. Told him there is no way, especially since he called me last minute and was unable to verify loan date and company. We hung up after he said I would get arrested by Friday ( which legally they can not threaten you with this type of action, nor do they give you a heads up on a warrant ).  I verified the last 2 years of my banking activity and did not find any loan deposits that I have not already accounted for. I called him back and let him know that I didn?t find any loan information so I needed his name , address, and case # which he was unable to give me. Once I told him I contacted the Attorney General, he proceeded to wish me good luck and hung up fairly quick. Ironically, I just got another call from 845-445-2833 which Ive noticed that people have said is a similar situation in terms of legal action. Hmmm.  Im getting arrested ladies and gents.

This same number called me about an hour ago, left a threatening voicemail so I returned the call, but not before doing some research. This number reverse directories to a Quick and easy towing company, address 15100 SE 38th St, Bellevue Washington, 98006. The caller was Indian in decent and said his name was Brandon Jennings and he was a lawyer from a company that he could not pronounce so I was not able to understand what he said. He threatened me with 30 days jail time downtown if I did not return his call to pay a debt that I knew nothing of. He actually allotted himself to be recorded with this threat, and a threat to have my wages garnished or to be arrested while I was at work. When I returned the call, he put me on hold, put me on speaker phone and proceeded to record the call. He made a statement that he had to read my charges without interruption abd then he would answer any questions after he made his statement, he read very fast and again I could not understand what he was saying with the echo the recording device created. I stated that this is not a known debt, I Ann aware of his scam, and if he calls me one more time from the number of "" from the stress of "" I was going to lodge a legal complaint to his local authorities and then he hung up on me. Don't pay this company a dime. It's a scam.

It's a scam. Here's some info for you:

http://www.jsonline.com/blogs/news/230218921.html
http://www.scambusters.org/debtcollection.html
http://www.usatoday.com/story/money/business/ ... -scams/2619187/

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.

If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.
