This is a SCAM.  The time barred debt is 6 years in my state.  We received a phone call from Davis and Associates telling us that we owe on a credit card from 2001.  They called my husband at work threatened to sue us and serve him papers at his place of business.  The caller is extremely rude and talks very fast.  She doesn't let you get a word in or ask any questions about this suppose account.  She states that letters had been sent and she doesn't have to discuss it any further.  She said she would settle this outrages account for only $1000.  Contacte dthe FTC and the Attorney General's Office in my state.  spoke with a person at the AGO and he stated that this is all a scam and not to give them any information.  He also stated that any legit debt collector cannot threaten to sue you or call your place of business once you have asked them to stop. He suggested that we write them a letter as well but when we called back to get an address they would not give us one.

Debt collector can be sued for pull credit report with out authorization. If you haven't restarted the SOL  remember to sue.

So the  only job you can get is working for some bottom-feeding zombie debt collector and you're diss'ing  people in trailer parks?    You'd have to climb a lot of rungs on the evolutionary ladder before you can look down on ANYBODY.

In my case all avobe, but what really terrified me was when they start giving me details about my currents credit cards accounts like, all the credit cards that I have and stuff like that but For the credit card that I'm sueded for,I've never had an account with that bank and they said that I owe money since 2005 so if this is a scam how the hell they got all my financial info and if its real debt collector why that debt never showed up on my credits reports and get denied on my current credit cards

IT DEPENDS ON THE STATE. BUT MOST ARE STANDARD. NO ONE CAN COLLECT A DEBT OVER 10 YEARS OLD AND THAT IS ONLY IF A COURT JUDGEMENT WAS MADE AGAINST YOU FOR THIS DEBT. IN TENNESSEE AS IS WITH MOST STATES THE STATUTE OF LIMITATION FOR FAIR DEBT COLLECTING IS 6 YEARS MAXIMUM UNLESS A JUDGEMENT WAS ISSUED THEN IT IS 10. UNFORTUNATELY, THEY CAN STILL CALL YOU ASKING YOU TO PAY AND THREATEN YOUR CREDIT. THEY ALSO CANNOT PUT THIS DEBT ON YOUR CREDIT. THEY WILL TELL YOU THAT YOU ARE MISTAKEN BUT I HAVE DONE THE RESEARCH. JUST GO TO YOUR LOCAL GOVERNMENT WEBSITE AND SEARCH THE FAIR DEBT COLLECTING ACT.

Same thing as every one above.  They even gave our new address and said they've verified employment.  Said they've sent us stuff in mail six weeks ago - NOT received anything.  Statutes of limitations has run out on any debt needing to be collected after 5 to 6 years --  these guys are calling for thing well over 10 - time has run out.

Definitely sounded threatening.

Does anyone know if a debt collector can file a "civil complaint" on someone that defaulted on a debt over 10 years ago?

Got a voice mail from this number saying a "civil complaint" had been filed on me and me or my legal representative needed to call them before further action?? Said they were Davis or Davison and Associates.  What the heck?

They said they were National Process Servers.
