They stopped for a bit after they received a copy of the letter I sent to the FTC. They had previously signed for a letter I had sent stating to Cease and Demand. Now they are calling again. I have yet to receive a letter which is also a FTC rule. I am going to record future calls, plus caller ID. I really hope they continue, I could use a good law suit!

These people are total scumbags. They are REPEATEDLY calling my house for my brother who does not live in my home. I called them back and TRIED to give them his phone number and got into a fight with the guy on the phone. LOSERS.

Does anyone know how I can proceed with a legal action against them? They don't stop calling, my number is on the "Don't call Registry", this is NOT my brothers legal residence.

ANY IDEAS HIGHLY APPRECIATED!!!

RE: [insert account number or name of account or name of debt]:

Dear [insert collector's name or company name],

This letter is in response to your [letter dated xx-xx-2005] (copy enclosed) or [phone call on xx-xx-2005], concerning the collection of the above referenced [account or date].

I do not believe I owe what you say I owe therefore I dispute this debt. I am well aware of my rights under the Fair Debt Collection Practices Act (FDCPA) and my state laws so I hope to save both of us a great deal of time by letting you know that not only do I dispute the validity of this debt, I have also checked with my State Attorney General and verified that the Statute of Limitations for enforcing this type of debt through the courts in (insert your state or the state in which the contract was signed) has expired. Therefore, should you decide to pursue this matter in court I intend to inform the court of my dispute of this debt and that the "statute of limitations" has expired.

This letter is your formal notification that I consider this matter closed and demand that you, or anyone affiliated with your company, stop contacting me regarding this or any other matter except to advise me that your debt collection efforts are being terminated or that you or the creditor are taking specific actions allowed by the FDCPA or my state laws.

Be advised that I consider any contact not in accordance with the Fair Debt Collection Practices Act a serious violation of the law and will immediately report any violations to my State Attorney General, to the Federal Trade Commission and, if necessary, take whatever legal action is necessary to protect myself. Be advised that I tape record all phone calls and violations of the FDCPA can result in you or your company being personally fined up to $1,000 per incident.

They call at least once daily. A recording is left on VM saying they are "calling for <name> and to understand this is NOT a telemarketing call" They go on to say "<name> please call the firm of Stephens and Michaels and reference #<number>"

My first thought was this was a law firm it seems that is how they are passing themselves off as.

The account they are calling on was written off by the creditor many years ago and from what a lawyer told me a few years ago, it is out of the statute of limitations for our state. This was over 8 years ago and should have been off my report but because it was apparently sold to this company and they keep reaging it as new (according to my credit report), it may never come off. But it isn't affecting my score too badly - it's 750+. I guess this was sold to other as well  because 2 other collection companies call my home but they never say who they are calling for.

We've never had another account go unpaid so I am ignoring these and I couldn't afford the payment anyway. Mortgage and car payments and gas in this economy is enough!

I submitted a comment on this phone number earlier, and I just wanted to update the information that I found out. After a lot of searching (as well as calling), this company is apparently a collection agency from what I can gather. I don't actually owe anyone anything, especially considering I only have one tiny credit card (a secured card at that), so I can't confirm why they would be trying to hassle me. I hope this helps anyone out. This could just be one of those run of the mill companies who are looking to scam people.

Caller called and left a message, however they did not say who they were and why they were calling. My guess is either an annoying telemarketer or spam.
