I got that same exact call from Michael Fisher.  I was really freaking out bc I've never been a felon, however, I did my research with him on the phone and I didn't verify anything accept for my year of birth because he wouldn't tell me what company I owed and come to find out it was a cash advance place too, which I also called and they don't deal with anyone in Georgia.  It's elsewher.  I asked Mr. Fisher for Kenneth White's JD # he tells me first that he can't give that to me but hes in the office.  So I went to Georgia's Board of Attorney's and searched by name and company.  Nothing!  I told him what I found he said oh no he owns the company but he's an attorney elsewhere so I checked that states board of attorney's and nothing.  He gave me their website address but anyone can make a bogus website.  You pull up his number and it's listed as a cell phone.  Long story short I'm dealing directly with the cash advance company.  Now I can feel a little at ease.  I thought I was going to jail.  OMG.  Thank you I'm going to file a report with the Federal Trade Commission too.  I hope they catch these ppl.

There was a man and woman who couldn't get the name, claim number, or the amount of the debt in question or dates right. Receiver beware!!!! I asked where she was calling from. She had to get off the phone right away.

Who's Calling? That Debt Collector Could Be a Fake

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I got a call yesterday with a very nasty message left stating I was going to jail for a fradulent check I wrote June 2004. I called back and the lady Kerry Williams was nasty and ugly acting. I advised I had no clue of this and that I was recently discharged from bankrupcty and they can shove it. She gave me a fax # and when I called back today to confirm my fax was recieved she states they didn't get it. I advised I was not resending it and she can pull my case up online. They called me from 678-607-2695 my exhusband said he got a call a few months ago for the same thing.

I just got the same call today from Michael Fisher.  He informed me I had a bad check for $510.75, with fees I owed $710.75 dated back from June 17, 2006.  He had all my info, last 4 of ss, bank account numbers, check number.  He said that if I didn't have the money by 4pm that he was turning my file over to the DA's office for felony 1 check fraud.  Said the police might take it easy on me since it was my first offense.  I asked him to provide me by mail a copy of the charges etc, he said that since this was a bad check case not a collections that there would be no paperwork that I would just be arrested and charged if I wanted to wait for the DA's papers, that it was up to me to pay this by Money Gram By 4pm so this wouldn't happen.  When I called the original debtor, a cash advance place, she had no clue who this guy was and informed me to call and put a report to the Federal Trade Commission (877-382-4357).  They took a complaint said to ignore this company's calls that she was positive it is a scam.  After I calmed down I googled "Kenneth White and Associates", here are the links to other people's stories:  http://800notes.com/Phone.aspx/1-678-607-2699 and http://800notes.com/Phone.aspx/1-678-607-2717.  I hope this helps the next person in line.

Debt Collector
On 6/6/12, around noon CST, I received a call from a woman named Mrs. White (think it was her name) at my grandmother's home # 314-469-3274 (also where I live) but I use my cell# for everything. Anyway, Mrs. White first mentioned something about, "Mr. X, I'm calling in reference to a company that you defrauded." When I asked which company, she asked to confirm my last 4 SS# which she read to me. Upon confirming, she said that I wrote a felony check with the intent to pay and said, "You have charges pending against you with your local district attorney's office who will be filing a felony arrest warrant against you; and then your local police department will show up at your home and place of business to arrest you."

I asked which company the alleged check was written at, and I was informed "Quik Cash." I asked when and which location. She stated store #58. She said she was calling from KWAssociates. Again, I asked which year the check was written and she asked me to hold while she would have an attorney to talk with me. While waiting, I did a Google s search of Quik Cash # 58 and I could not locate a store # 58 or KW Associates.

A few minutes later a man got on the phone line and said, "Mr. X, my name is Andrew and I am calling about your pending felony charges files against you for defrauding a payday loan company and that you will be arrested by your local police department after filed by your local district attorney." I tested him and asked, "Which county am I in?" He then raised his voice and said, "Look you know which county you are in!" I stated that I could not find a store # 58 in my area and that I could not find a KWAssociates in Google, at which point he said, "Look again, we are there, under Kenneth White & Associates" which I did find.

He went on to say that I wrote a check in 2007 to Quik Cash. I said, ?I have not received any notification and yet after nearly 6 years, you are calling me?? He said that correspondents had been sent to me which I ignored. Next, he said, "You fraudulently wrote the check for $580 and after years of court and litigation fees, it comes to $780; how would you like to pay for that today?" I asked how there could be court costs if I have not had a court date and he said, ?This isn?t civil, it?s criminal and a felony and you need to pay it today or else have fun in jail.?

I stated that I was unemployed and did not have access to that much money." He replied back in a manner that sounded like those stories about loans harks who break knee caps for failure to repay loans ? and to be honest, I did feel threatened by his tone of voice, the fact that he kept raising his voice and talking down to me, and his threats to have me arrested and go to jail if I did not pay him!

"He put me on a brief hold and then said, "I have good and bad news for you. The good news is that your paperwork has not yet been filed with your district attorney's office. The bad news is if you don?t pay the $780 today, then you?re going to jail for felony fraud charges!" This was followed by, "It is noon and I will give you to 4pm EST which will give you a few hours to call your family and friends to come up with the money, or else if you don't call me back then those felony fraud charges will be filed against you and you will go to prison!"

I stated that store # 58 did not appear to be listed in my area let alone Missouri. I stated that I do not have a criminal background and restated to him that I do have a background in criminal justice and that I was quite sure that this was not the same as knowingly writing a bad check at a retailer, but instead that a payday loan would be civil charges because It is the same as defaulting on a LOAN. He raised his voice again and argued that, "This is criminal charges not civil; criminal not civil; once again, criminal not civil and yes; you will go to jail for not paying. Now I expect you to call me by 4pm or else!" I tried to talk sense to him but he kept talking over me. I asked which bank the check was from and he said, ?Regions Bank? which I did have around that time. I have been with a CU for the last several years but did not tell him that. I tried to explain to him that if I defaulted on a loan, then I would be taken to civil court and if a judgment was found against me; and then I failed to pay those fines, then criminal charges could be filed. He cut me off and raised his voice again, ?Look, Mr. Criminal Justice Man, you are talking about civil and I am talking about criminal charges which is something you clearly no nothing about. Once again, you have until 4pm EST or else the District Attorney in your county will file charges against you and have you arrested!?

I asked him, "Are you a collection agency?" Andrew stated, "No we are not a collection agency but Litigators with the power to file an arrest warrant for your arrest for felony check fraud. We are not a collection agency. Now, unless you want to go to prison for a felony I will expect your call by 4pm EST." (Yet, their own website states several times that they are a collection agency)

At which point, I hung up the phone on him.
____________________________________________

Next, I called one of the local Quik Cash companies in Saint Louis because I do remember using Quik Cash in the past but could not remember which location. For the last year or so, I was using ACE Cash and I was never had late nor did I have any NSF with them. When I called a random location from their website and I explained the issue. The supervisor at the location, Megan said that they used a collection company called Pro-Something (??) and gave me the number to the collection agency. Megan also informed me that she had never heard of Kenneth White and Associates and that there is not a store # 58 in the area. They were kind enough to check to see if I had a balance due;( I have a BS/MS in Criminal Justice, I had no reason to commit such a felony). She said that I did have check written for $560.50 at location # 25. I do remember that location but thought I paid for all loans borrowed. I am wondering if I accidently had a second check stuck to the one behind the used check and someone else used it. Quik cash corporate office no longer has a copy of my check to verify my signature. Anyway, I called #25and they said, it was written on 11/16/2007 and returned by the bank for NSF on 11/18/2007. I asked them if it was a criminal or civil offense and they gave me the corporate office and the # to the collection agency. According to both Quick Cash locations that said that I should ignore the joker who was calling and threatening me.

I did call their outside collection agency which was that Pro something (cannot remember name and misplaced my notes). The person that I talked with said that his company no longer had my account and that it was closed out. I asked if his company had sold it to Kenneth White and Associates and I was informed that they do not resell and had never heard of the company. I was also informed that if they are threatening me, then they are likely a collection agency using illegal practices.

Next, I called the corporate office at Quik Cash and asked about my account and what current records that I had? I was informed that they (corporate office) had never heard of Kenneth White and Associates and confirmed the name of the PRO something collection agency that they do use. I asked if a customer fails to pay on a payday loan with their company, is it considered criminal or civil; with criminal being that a check was written somewhere like Walmart, or Civil as if defaulting on a loan? I was informed that they only file civil charges even if over $500 in Missouri. In MIssouri $500 is a felony.

Next, I went down to the Saint Louis County District Attorney?s Bad Check Division in Clayton, Missouri. I explained the incident to the clerk and I was informed that it is not a criminal offense if the payday loan company considers it a loan default matter. Also, in Saint Louis County, the statute of limitation is: (a) under $500, 1 year and (b) over $500, 3 years. The alleged check was written in November 2007, which was about 4.5 years. The statute of limitation has been exceeded which is why Quik Cash is probably not pursuing this matter. It sounds like Kenneth White and Associates are searching for unpaid debt from 3rd party vendors. I did check their website and the phone number that I was called from is associated with the website (http://kennethwhiteandassociates.com/).

Complaints against this company and Andrew and Mrs. White

* Prior to acknowledging the name of the company they represented, Mrs. White began by informing me that I had fraudulently defrauded a company and that charges were being filed against me and that I would be arrested.

* According to Andrew, when asked, he denied several times they were a collection agency even though their own website states that they are a collection agency in multiple sections.

* Andrew, the alleged attorney also made several threats against me (felony charges to be filed, the police to show up at my job and home, the part about ?or else?, and causing me to feel unsafe)

* Not being aware that the statute of limitation expired

* Incorrect information about the store number (claimed it was 58 which does not exist according to payday Loan Company when it was actually store no. 25)

* Claimed the amount of the check was for $580 (actual amount according to Loan Company was $560.50)

* Claimed that the additional $200 was for court and litigation fees, when there has never been a court date or judgment

* They are attempting to collect on a debt for a company that has no idea who they are.

** According to the BBB, the company has an ?F? rating for similar complaints.

1. I filed with the Missouri Attorney General's Office
2. I filed with the FTC

I got this same message and called back to discuss the "fraud case"  The numbers I was called from was 678-607-2719.  He told me that he didn't have to give me the attorney's name but that the company was Kenneth White and Associates.  After being yelled at by both Mr. Hill and Someone claiming to be the assistant to the attorney I was hung up on twice.  I was told they didn't have to by law send me anything in writting.  The more information I asked for the more I was yelled at.  I was told I would be arrested.  I ended up filing a complaint with the Federal Trade Commission.  I was told by them that everything they said and were doing was 100% illegal.  I was also told to file a complaint with my AG's office in Washington State.  Beware!  You can not be arrested for it, per the Federal Trade Commission!

Just left this at another site, but I suppose it bears repeating:  For what it's worth, I've received four such messages in the past week (March 2012). "Andrew Hill" reads the same urgent (and ungrammatical) message each time, claiming there's some sort of fraud case. However, the name he claims he's looking for is not my own nor anyone's I know.   I actually phoned him back last week and told him he had the wrong name... He thanked me and immediately hung up. Yet he keeps leaving the same lame phone message...
