Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?
The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:
is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.
If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.
Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I got a call from this Stride guy yesterday stating that he is gonna serve me with court paper work...I then called my local police station and they had no idea what i was talking about...He also said there is bank fraud with my old Bank of America account..After digging on these scam artiest I have found out theyare just a collection agency..I called the Attorney general of NY state and informed them of what is going on with this company.. Good thing i record every call that i get...I sent the recording the A.G. ..he said that this company should have sent me something in the mail...I told him that they refused to send me anything (and I have that recorded also) The A.G. told me they are cracking down on these little scam places because they are not license to collect in the first place...The attorney told me as soon as they receive my recording they are gonna go to this place personal and shut them down!

I got a call from State Processor and she said that I need to call Daniel Clark and Cunningham about a payday loan I took out and if I don't call these people by 9:00 am then I will be serve papers and will have to go to court I told this person I am in a debt management program and they call call them and they told me they don't talk to 3 rd party person I think this is a scam and all they want to do is to scare me into paying the money even though I am in a debt management program they also said they will go to my job and serve me papers I really don't think they can go on my job to do this

I did some digging on this guy and his so called law firm....it is a collection agency that is not license to collect!!

That is not true about losing in court. A collector can garnish. But after all paperwork has been served and a court orders the garnishment. You don't have to be summoned to court to have a garnishment started. Many times you will not know and it will just happen if you ignore the calls. That being said.....this IS a SCAM. Read previous post.

First of all a legitimate company would not ask you how much you make so they can do a wage garnishment. They deal directly with your employer and the sherrifs office. I had my attorneys look these people up and they concluded this is a scam.

To "down with scam artists"..THANK YOU for your post..this Andrew person has threatened me as well to being served for something I don't owe. I feel anxious and can't sleep... this helps to know they can't do a payroll garnishment. HOW do we stop these people?

Today I recieved a call from this idiot Andres Strides with a very nasty voice. He stated to me that he was calling because I was in contempt of fruadulant activity of a pay day loan. I told him that I do not owe a payday loan from MESA financial because no money from this company was ever put in my account in 2010. I stated to him I have proof of this matter. He stated to me you have to pay the loan or otherwise you will be served by 5pm at your job. I told him go ahead I will wait to be served and will go to court and talk to the judge. I stated to Andre Strides through phone conversaton.What do you think that you are intimidating me over the phone. I immediately told him you are a scammer. If this is true send me a letter in the mail and he hung up on me.

Andres Stride - says he is with Woodforest Bank, butit is really a payday loan collection scam. Do not give them any info, demand they mail you a validation letter, because they won't. Did not notify me of the attempt top collect a debt, and misled me to believe my bank account had been hacked.
