They keep calling for my husband, on my grandmother's phone.  Something about a fraud charge.  I've called them back once, and just told them I was his wife. If this was legit, there would be no way, they could legally give out any of the info about my husband like that.  No one would be "serving" him over the phone.  This has been going on for a good couple of years.  If anyone is asking for post dated checks, that should tell you right there this isn't real.  Look up law on post dated checks.  If a company accepts one, they cannot do anything if funds aren't in there.  Post dated checks make a case null and void.  These people are bullies and complete idiots.  Don't give any info.

This is a scam.  They claim to have litigation pending and say you have committed fraud.  They get your social security # from the debt collectors.  They legally can try to collect the debt up to three times.  I had this for an old payday loan from 2007 and I paid it off.  They don't care.  They are liars and contacted my family members and tried to call my employment.  It is harassment at its finest.

This is FRAUD.  REPORT THEM.  Don't give them any personal information.  They are calling my x husband who I have been divorced from for 15 years for a loan I did 5 years ago.  They called his work.  It's crazy and harassment.  Report them to the local authority.  They collect on debts that are sold and have been paid off.  THIS IS A SCAM

These people call my job every day. I work in a chemotherapy and have told them daily not to call me at work because I have to be by my patient's side, my supervisor told them not to call me, and my human resourse manager told them that I could not get personal calls at work. Then they proceded to tell  the HR manager that it was an emergency. One day they called and said that they were with the local sheriff's department and needed my home number so they could call to ensure that I was at home so that I could be served papers. I cant seem to get them to quit calling my job. They have my cell number and told them if they would call me outside my work hours I would be glad to talk with them.

New Twists to Telephone Collection Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.

Callers pose as representatives of the FBI, ?Federal Legislative Department,? various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim?s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.

The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim?s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it?s the latter, the caller tells the victim that he or she is wanted for hacking into a business? computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.

The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim?s job. In another instance, a phony process server came to a victim?s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.

If you are contacted by someone who is trying to collect a debt that you do not owe, you should:

   Contact your local law enforcement agencies if you feel you are in immediate danger;
   Contact your bank(s) and credit card companies;
   Contact the three major credit bureaus and request an alert be put on your file;
   If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
   File a complaint at www.IC3.gov.

What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

  use threats of violence or harm;
  publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
  use obscene or profane language; or
  repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

  falsely claim that they are attorneys or government representatives;
  falsely claim that you have committed a crime;
  falsely represent that they operate or work for a credit reporting company;
  misrepresent the amount you owe;
  indicate that papers they send you are legal forms if they aren?t; or
  indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:

  you will be arrested if you don?t pay your debt;
  they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
  legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:

  give false credit information about you to anyone, including a credit reporting company;
  send you anything that looks like an official document from a court or government agency if it isn?t; or
  use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

  try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
  deposit a post-dated check early;
  take or threaten to take your property unless it can be done legally; or
  contact you by postcard.

Here are 20 other numbers they call from I know they are a scam I fight with them all the time I block number after number I changed my number and somehow they still got the new one they have been calling me since August 2010 If I block the # they call unknown. They call my parents house because it was my last known address.  You think they would get the hint since never give them any info and fight with them constantly!! They have threatened to have me served about 20 times have I ever been served NO lol!!!  They threatened my dad saying I was going to be arrested in 24 hours he told them bring it on did anyone come NO lol!!!  What a joke is what I say I just laugh and hang up they get so pissed they call back and leave a lame message that I am not intelligent because I am about to go to jail lol  OBVIOUSLY they are the unintelligent ones because they have nor will they ever see a penny from me and waste their time trying!!!  KISS MY A$$!!!!!!

I totally agree! This company continues to call me for my sister. I have never been in debt myself and dont appreciate the calls. I've told them repeatlly that my sister and I are estranged, I dont have her number or address (its unlisted and I really dont). They insist that I get her a message. I've told them not to call me and stop answering. Now for whatever reason, they call my mother. She tells them the same thing, now she stops picking up. The next time I am here, and I decide to answer, I will threaten and follow through with reporting them. They just dont stop No Matter What!

This is not a real company they are frauds that got your info from a credit report.  My husband is a real lawyer and unfortunately they called me over a debt that was actually already resolved first clue they were a fraud.  Second no one is ever served over the phone if you are going to be served it will be in person and the courts would never call to threaten you to be served.  Third they would never ask for your info over the phone and never be as unprofessional as these people get.  As soon as my husband the real lawyer got on the phone with them they got schooled and never called back!!

Received a phone call from them today.  As I have retained a bankruptcy attorney, I told the lady (Olive?) that information.  She said so?  I was going to file bankruptcy over a $280 debt?  I said that and many others.  And since I am now on SSDI, my income is very limited so it was the logical choice for me.  She said that my wages could still be garnished.  I said I had no wages, I was on SSDI.  She said I wasn't in 2009 when I obligated myself to this debt.  I said that is beside the point, as a creditor they were not legally able to garnish social security income (child support, federal/state taxes, and student loans only, and social security administration themselves).  And that I was willing to give them my attorney information.  She repeated that the file was in their office and she may just act on it.  Seriously?  This lady then argued with me about whether she was breaking legal debt collection rules, and I finally hung up.  Next call is to my bankruptcy attorney.

I got a call from this company telling me that they are a law firm, because I asked if they are a collectin agency, they said no.  They wanted 5 post dated checks and they wouldn't hold a judegement against me.  I said I don't feel comfortable giving my checking account information to anyone over the phone.  This is about an account that I said I haven't heard about or had received any debts on.

Stop the payments and contact your local enforcement agency.  What they are doing is illegal and you have no obligation to pay them.  Might want to notify law enforcement in their area as well.  It is a scam and someone can go to jail for that and it won't be you.

THEY CALLED AGAIN A COUPLE DAYS LATER AND I CALLED THEM EVERY NAME BUT THE CHILD OF GOD AND THE OPERATOR REPLIED " WELL GOOD LUCK WITH YOUR CASE" AND I REPLIED "NO, GOOD LUCK WITH YOUR CASE" AND HUNG UP MY PHONE. MORAL JUST CURSE THEM OUT OR GET SMARTED MOUTHED WITH THEM AND I PROMISE YOU THEY WILL LEAVE YOU ALONE. AND NOW THAT I HAVE READ THE ABOVE COMMENTS I DID  HAVE A PREPAID CARD THRU META BANK BUT THE iADVANCE WAS NO MORE THAN $50.00 BUCKS. AND THAT WAS OVER 2 OR 3 YEARS AGO.
