I've been getting a recorded message every day from 716-565-1020.  Message is from a Daniel Lynch of National Action Financial Services and requests me to call 866-265-5244.  I called that number today and spoke with someone.  They asked what number was being called, I gave them my home number, and they said they were calling for <name I can't pronounce>.  I told them that it was a wrong number and I have received other calls from other collection agencies for this person.  We joked about it and he removed my number from their list.

Dave, good luck. If they think you owe money, or can be bullied into sending them money when you don't owe them a penny, they will keep calling your number until hell freezes over.

Just hang up when they call. Don't talk to them, don't acknowledge you owe any money, or could owe them or anybody else any money.

Bill collectors are getting more like scam artists these days. They'll take money anywhere they can get it, and from anybody. They can't do anything to you unless they actually sue you, and take you to court to get a judgment against you.

Never pay on a debt to these companies without advice from your attorney, and NEVER give them your bank account number for an "authorized" withdrawal from your account. They may clean your account out.

If you are actually sued, BY ALL MEANS, GO TO COURT AND DEFEND YOURSELF! They can get a default judgment against you if you don't show up, and that's even if you didn't owe them anything.

Check the statute of limitations in your state before going to court. That's your best defense for an old debt you may still have. Debt collectors are trying to reinstate old debts by taking a chance in court that the debtor may not show up to defend themselves. If they get a default judgment on an old debt, they can have the court enforce it.

A while back, when economic outlooks were better, National Action Financial Services LLC, or NASF, joined with an entity named SITEL, who claims to conduct business globally and was a very profitable customer service outsourcing company (the phone rep whom you can't understand) until the global economy tanked and the conglomerates outlook became less rosy.
SITEL, not educating themselves adequately on U.S. consumer protection laws and underestimating potential liability, began ratcheting up pressure on the NAFS collections operations to increase contributions , who then leaned on consumers too aggressively which won them at least one hefty fine in 2007 for illegal collection practices.
SITEL has not been overly generous in sharing their results since 2006, and there’s speculation that it is experiencing some losses worldwide. The fine that their collections side was penalized was absorbed and doesn't seem to have dampened their over-aggressive confrontational style. It is unlikely, given their worsening financial status, that SITEL will back off their over-zealous behavior very much for the reason that improved earnings from the collection operations are now so urgently needed, and foreign owned companies are notoriously slow to learn about American culture as well as applicable consumer law. They will likely have to take a few more significant legal hits before stepping back and rethinking the risky NAFS model.

Every time they call file a complaint with the Do Not Call List, Federal Trade Commission and other agencies.  If they get slightly threatening then file a police report and contact your state attorney general along with the New York state attorney general.

For each call you get post on one of the many forums complaining about NAFS.  The more complaints that are filed the easier it is for lawyers to file a class action lawsuit.

This is a lowlife collection agency trying to skip trace other lowlifes.

They use a number of phone numbers and several different names in an attempt to weasel and scare you into returning their annoying calls.

Fair Debt Collection Practices Act, 15 USC 1692. NAFS is required by law to send you a letter within 5 days of initial contact with specific information therein, including the name of the original creditor, the amount of the alleged debt, etc. If they do not do this, they have violated the Act and are liable for up to $1000 to YOU. Also, within 30 days of being contacted by them, you should send a verification request letter.

Within 30 days of being contacted by them, you should send a verification request letter (there are tons of examples of these on the internet) to their address - 165 Lawrence Bell Dr., Ste. 100, Williamsville, NY 14221-7817, and you need to make sure you send it certified mail, return receipt requested. This way, you will get the "green card" back showing exactly when they accepted the letter, and by whom. Make sure you put in your letter a "cease and desist" clause - in other words - tell them that they may not contact you again until they have verified the debt. (and spell out as many things as you can that they must verify - see examples on the internet) IF they contact you with anything other than a letter stating they are taking further legal action, or a verification of the debt (which they undoubtedly will not be able to provide), they have violated the Act again & are liable for another $1000. Also, if they fail to provide debt verification within 30 days of receipt of your letter, they are violating the Act again - and, yes, it's another $1000. Every single contact they make with you (other than verification) is a separate violation and constitutes another $1000. Also, if they do not remove the unverified debt from your credit report (all 3 agencies), it's another violation, and another $1000. Lastly, you can get them for more violations for harassment, unfair practices, and false or misleading representations, amongst other things (such as contacting/harassing your relatives, neighbors, etc). Each violation is worth up to $1000. The key is: TAKE ACTION & DON'T SIT BACK! You must send the letter, keep very detailed records

Dear Sir or Madam:

The Fair Debt Collection Practices Act (section 809) states (among other things) that you have five days from the date of initial telephone contact to provide me with written validation of the amount of the debt owed, the original creditor to whom it is owed, and a statement of my rights to dispute the debt within 30 days of receiving written notice.

I have requested written validation from your office three times, and have been refused, ignored and once even laughed at. It is also worth noting that every representative of your business with whom I have spoken (a total of 5) have been unprofessional, rude, sarcastic, condescending, and verbally abusive. I have been laughed at and called names, ridiculed and even hung up on. And after researching this company at the Better Business Bureau and other various sources, it seems that this is a common business practice for your company.

I demand that you STOP contacting me by phone at home, work, or on my cell phone, since not one of your employees seems to have any idea how to behave in a professional or even a mildly polite manner. From now on, you will contact me by mail only, beginning with the above documentation that you are bound by law to provide. If you cannot or will not provide some evidence that this is a valid collection attempt, and provide me with an address to which I can send payment, I don't know what makes you think you can collect money from me at all.

I have already filed a complaint with the Better Business Bureau and will be happy to contact the New York State Attorney General and Federal Trade Commission if the telephone harassment continues.

Thank you for your immediate attention to this matter, I will be watching for your reply by mail.

The board had already suspended the memberships of collections firms Capital Management Services and National Action Financial Services because of an unusually large number of complaints that exceeded even other collectors. But both firms resigned from the bureau prior to a vote on expulsion.

They call all the time and it is always a recording with a number to call and a person to speak to. I always just hang up on them or delete it from the machine. The problem though is I am an overnight worker and for these a***oles to call all day everyday gets a little annoying. What can I do to stop them. I know this is a phony call and probably from a debt that is past the Statute of Limitations
