We too got a call vut this time from david ross he yelled n cussed at us said that he was going to take our housw car money i looked online what was scary was he had my info but was calling for my husband he knew my balances on my cc n everything i asked for a letter he did send on however it was not professional the address at tbe bottom i goggled n it was a empty building.info@unitedmerchantassetrecovery.com

This company is now out of business.I too recieved a call from them and reported it to the better business. I just recieved an email from BBB with franklin mithchel associates response. The response said that they were no longer in business and i would not recieve any further calls.

My wife just called me, and said frankin, Mitchell and assciates called her they gave me a case number and when I called them they the phone ring 1 time and said the person you are calling in on the phone I called 10 time. after reading all your post what should I do? and help there number is 1-855-826-8568

they are now using another number. the number that contacted me was 877-861-3758.  be on the lookout for it as well. I got the same message as the ones listed above and have spoken to 2 different people. I am seriously concerned because they had my social security number for me to verify.

ignore them, the law states that if your request information regarding what they are collecting, they need to send your all the information they have. If they don't sent you the information so you may review it, then just send them a letter of cease call calls and that they are to only contact you by certified mail

I too got a call from a man who claimed to be an attorney. he gave me an address for Franklin Mitchell. and associates as 212 Walnut St Lockport, NY 14094. He demanded proof i paid off a payday loan from 2008-which i never took out, but know who did (done on my Computer-and have resolved the issue). They said i was going to be charged with bank fraud. I paid a bill to Todd Davis of  Southern Asset Recovery Inc.
P.o. Box 613 Stone Mountain, GA 30086 for $160 in February. This is the amount Franklin Mitchell. and associates wants again

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

***PLEASE BEWARE OF FRANKLIN MITCHELL & ASSOCIATES***. They are registered with the Better Business Bureau but are not accredited. I believe all the employees have fake names; Brian Micheals, Dan Gately, Micheal Fitzpatrick. I also believe they are a fraudulent company trying to collect money from anyone they can using intimidating scare tactics. They will use "big words" and terms to scare you into paying money you don't owe. I received a message from a process server who threatened to serve me at work or at home with a summons to appear in court. I called the company and started asking detailed questions about my supposed "case". They said someone used me as a co-applicant on an online payday loan. They could not provide me with a case number or any legal documents. I called the county where the hearing was supposed to be scheduled and the court clerk could not find my name in their system. I googled the address the rep gave me of Franklin Mitchell & Assoc and a picture of an empty lot appeared. The most scary part of the entire call was when the rep read my SSN to me. I think that is how they scare people into paying money. It's incredibly frightening when someone you don't know has your SSN. I have no idea how they got my SSN. If this happens to you, I advise you to ask a lot of detailed questions and DON'T PAY THEM ANYTHING! Chances are if you pay them money, you won't get it back. There are things I learned you can do to help yourself. Here are some things you can do. Obtain a copy of your most recent credit report and see if there is any suspicious activity. You can put a fraud alert on your credit with all three bureau's http://www.equifax.com/answers/set-fraud-alerts/en_cp Contact the Federal Trade Commission and file a complaint http://www.consumer.ftc.gov/articles/0277-create-identity-theft-report and then file a police report with your local police department. I can only hope companies such as these will get caught and innocent people won't be victims anymore.

Just got a call from Franklin Mitchell &A** stating they have a summons for me to appear in court but needs me to verify so they can have it send over. Got harass a month ago by the same people but this time a different name saying a owe a payday loan from ace cash express called company stating a don't owe nothing it's a scam I was scammed once before like this out of 300.00

I got a phone call from Franklin Mitchell and A** said I owed a bill I ask for a copy of the sign contract they send me a copy of credit report got me for 100.00 and stop payment and 520.00 try to get me for 620.00 I did report it to the ftc everyone I talk say it is scam

I keep getting calls from the same number but they will not give me any information about the debt i apparently owe , I wish someone could do somthing about this ,they keep calling my family and telling them im gonna get arrested and have no legal recoarse it is embarressing that i have to explain to them its a scam

i had a kelly king call me and tell me they were going to summons me to court. she told me that i owed for a collection bill. i have no idea what shes talking about. i called the company she said i owed. they didnt know who i was and i didnt owe anything. i told kelly the company had no idea who i was and now shes suppose to give me my money back. she said they have the wrong person. beware. they stole $800 from me. they say theyre with VIP LOAN SHOP, type: secured loan-return ACH. the name at the bottom of the letter is Rachael Daniels Director of Operations

Same messages that this Barbara left me and to contact her so the courier delivery can deliver this summons. I don't know whom they are representing and it is getting scary Also I went on line no such Frnakin and Mitchell assoc. I am reluctant to call and I got this advise from Lemberg& Assoc to ask to send the document and they don't  sen them he said to ignore.I don't know what to do.

"Barbara" said there was a civil lawsuit connected to my name & SSN something about a notary fraud.  I am to contact her before my scheduled court appearance in my jurisdiction on the 17th.  I just got off the phone with my court system.  I am not scheduled for any court appearances. And online- there is no Franklin Mitchell & Assos. She also called my mother's house, saying that she was listed as an emergency contact.  Who is selling our information??!  This is getting old!
