I had never heard of them before today when we got a message from them.  The message was garbled and cryptic.  It started with just a person’s name - who's name I don't know - was it the person they were trying to reach or the person calling?  Then they said something else that was unintelligable.  The next part was strange.  Unlike the first several sentences - they very clearly asked that we call back 1-800-44-2295 ext 112 and enter a code #######.  They did not say who they were.
I told my wife that it sounded fishy and to not call back from our home phone.  We called back on a cell, entered the extension and got a rude woman who instantly knew we were calling from a cell phone.  She was not happy about that and demanded our home number.  We asked what company they were and she refused to answer and demanded in a loud voice our home number.  We demanded right back that she identify herself and company.  She hung up on us.
They obviously were running some kind of phishing expedition scam.  If they really wanted to contact us with legitimate business, they would have identified themselves.  They did not have our names, just a phone number.  Had we called back from our home phone, they would have realized they had a live one and we probably would never hear the last of them.  We have great credit and I am not worried about some sleazy credit operation.  My advice to anyone that hears from them is to hang up right away and not get caught up in their extortion.  Ask for information if you want, but don’t give them anything.  Not a name, not a number, no bank information.  Remember, they called you and it is their job to give you information if you want it.  I read on the web about this company where they refused to send things in writing.  I never pay anyone anything unless I see it in writing.
Trust me, If you really owe money and someone wants to get it from you, there are plenty of more legit ways to do it.  Cold calling people, refusing to identify themselves when asked and then hanging up on the person are not among them.

they called my house when I was out of town saying that I need to call the above 800 number and have my attorney or myself speak to them. I was told to call the extension 132 and talk further with her.

They left no indication on what it was regarding im going to call to see wtf this could even be about but from what you all are saying it sound like fraud. Ive had this telephone number for 2 weeks how did they get it that quickly and if they can find that out why haven't they sent me any detailed letters describing the case.

Another WNY bottom feeder that pays his collectors $10/hr. to call and threaten legal actions on purchased debts with attempts at extorting funds. A debt collector who identified himself as ?Mark Zito at ext.#111? had the paperwork ready to be sent via Fed-X directly to a Texas courthouse, where he wanted us to believe that court actions were imminent. Mark?s attempt at extortion were defused when told he was a liar, then a check revealed that owner Brian Peunic has not yet filed his Surety Bond in Texas, which makes him illegal to collect from Texas residents.

Extortionist Zito bragged that SC Associates (Southern Capital Associates, SCA) purchased some of their debts from Platinum Investments, which means that they are worse accounts than previously thought. A check of court documents lends credence as four suits have been filed recently against Southern Capital Associates in federal court alleging threats of immediate legal action if payments were not sent to them. (Pacer) Peunic settled them and must expect a lot more as it appears the money he has already spent on legal fees has not taught him how to collect debt legally. Again, the good news is that he IS paying, so legal actions against his organization could prove fruitful for those who have a valid claim. Check your state records to see if they are licensed or bonded for a potential claim against them. Contact me for referral to a local consumer law professional.

Apparently debt collector Brian Peunic has been too busy to read the law because threatening consumers with legal actions and collecting where you have no license and/or bond is illegal and the extortion threats we heard from collector ?Mark Ziti at ext. 111? may get you sued by consumer law professionals. Unfortunately Peunic?s methods are typical in what has become known as ?Buffalo Style? debt collections, where collectors use harassment, intimidation and threats to scare consumers into paying.  These type debt collectors pay very little for old, mostly worthless accounts, much of it out of statute, void of all validation. If you find them on your credit files, you may have additional claims against SCA under a federal law called the Fair Debt Collection Practices Act (FDCPA).

Our advice to anyone contacted by this organization is to stay far away from them. They are NOT licensed or bonded, have NOT responded to debt validation notices.  They are members of the American Collectors Association, which means they do have insurance. Save your money as you will get nothing in return for sending it to SCA.

I can't BELIEVE these people! They have broken just about every law in the BOOK!

Ok..calm down. It is ILLEGAL for them to falsly state that they are a LAW FIRM filing a suit. It is ILLEGAL for them to use THREATS. It is ILLEGAL for them to collect a debt greater than owed. It is ILLEGAL for them to threaten to send a SUMMONS to your work.

Check out this website and relax.  You have rights and you CAN sue them.

Debt Collector
I have been repeatedly receiving phone calls from this so called agency regarding my daughter. We have told them that we have NO information regarding her contact information...yet they call again and again.

We are being harrassed.  My husband spoke to someone yesterday at this agency and they actually GAVE him my daughter's new work number,so it's not as if they don't know where she is.  The person also told him that my daughter should "live up to her obligations and pay her debt".

When *I* talked to the person earlier today, he was very rude and told me to GO TO HELL when I demanded that he cease and desist all further phone calls and that I DO have his number and will be recording all future phone calls from this company.

These are clear state AND federal laws against this people. Debtors can be sued and contrary to what some creditors might believe...we DO win. I'm living proof.  I've taken these jerks to court before and I'm going to do it again.

A debt collector CANNOT call a third party MORE THAN ONCE *unless* they have reason to believe that you have more information. They must specify WHY they beleive that you know more than you told them as well.

A debt collector CANNOT repeatedly call a third party. It's considered harassment.

A debt collector CANNOT use profane language.

A debt collector CANNOT state the nature of the phone call. He cannot even indicate that the person he is trying to reach owes a debt.

A debt collector MUST give you his name and the company that he is representing if asked.

A debt collector CANNOT ask a third party to leave messages for the debtor to call them.

There are plenty of laws and this company blatently disregards each and every one of them.  If you are being harrassed by this company, keep accurate records of each phone call. Time, date, what was said, name & address of the company, the name of the person calling.

You can file a complaint with the Federal Trade Commission
and your state Attorney General's office.

This web site should help:
http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre18.shtm

This website has letters that you can send to these jerks demanding that they stop contacting you by phone. Keep copies of your communications, send them certified, and you can use this as evidence in court.

My son received a call from a Brian Mulvey (sp?) (1-800-440-2295. ext:115)  re: his credit debt. After some googling, I found this site.  My question is this: Is the credit card agency required to inform the debtor that his account has been turned over to collection? And if so, are they required to supply the debtor with the NAME of the collection agency, along with contact information (i.e. phone number, address, contact person)?

Hey Debt Collector! I get called all of the time from collectors looking for my Ex Husband who I divorced 4 years ago!  I pay my bills and have good credit, but get debt collection calls.

Anyway, I got a call from (716)558-7200. He asked for my ex husband. I told him we've been divorced for 4 years. He asked for a number. I asked what it was about. He didn't want to disclose that information. I told him I wouldn't give him the number then. He asked to leave a message, which I took.  He asked for my ex to call 800-440-2295, extension 111, James Miller.  I think he said the company is Southern Capital of Western New York.
So, "debt collector" even people who pay their bills get the calls.

I've been getting automated calls from them for months asking to speak to someone who has never been at my phone number.  I finally gotted pissed enough to start talking to people instead of just hanging up.  Yesterday the smart a** said he was his own supervisor when I asked to speak to one.  Today I demanded information:
James Miller
S C and Associates
1-800-440-2295
When I asked for a supervisor I got a Mr. Walker who after some not so gentle prodding, said he was taking my number out of his system.  We will see.
