They first called my neighbor which I find is very unprofessional.  Told me that I had to pay did not care that the mortgage would not get paid that month if I paid them. Their deal was really no deal wanting at least $1100.00 up front that day.  Mr Nuchereno uses shame and fear to try and get you to sign up with their deals.  After talking to my lawyer he advises that you take care of your mortgage and ulitities first before dealing if at all with these idoits!

Debt Collector
Heys guys the bill collector is right.  If you owe the money pay it back. You know you owe the money, do not act surprised.  Why consult by asking questions about a phone number on a forum when all you have to do is return a call. That really do not make sense. Thats like my spouse calling me to tell me to call his mother for something. He has the same number in his phone.

Its funny guys I had this long response and I accidently deleted it. I was really venting. But Im going to shorten it up and give a little advice instead. (I am not an expert, just experience)

First of all I do not want anyone to get offended.  Alot of the ones complaining are the ones who owe money. Hey guys people make mistakes.  All you can do is try your best to fix it. It does not take that long. I owed credit card companies, cell phone companies and medical bills. It took me 3 years to fix it and I was able to buy a house and a car with money to put away every week.  I do not make alot of money at all. I did not work with a 3rd party debt consolidation company.  These companies will settle with you.  Believe me they do not enjoy calling you, your sister, you employer, etc. We do not like taking people's cars and homes. Its a job and everyone knows it happens. Its not a surprise that if you do not pay your car payment the car will get picked up. Or if you do not pay your mortgage or rent, your not going to get kicked out. You get back up and make a change.  I was young when I had credit cards, and not understanding about how it worked. It does'nt hit you until you can not get that car you want or can not get that apartment or even get a cell phone without paying a high deposit.

Now on a different note.  Do not live above your means. Do not go out and buy clothes that you do not need because you have $200.00 extra out of your check.

Scenerio:
Kim's pay date is the 1st and 15th
pay day March 1st= net pay check $600.00.  She paid out in bills that are due or past due $400.00.
Now she has $200.00 left (she buy clothes and shoes that she doesn't need in the amount of $135.00, no extra money on the side or in other accounts)
water bill due  march 7th= $50.00, she can not pay because she needs to put gas in the car until she get paid next week ($35.00). She had to buy a few groceries for the home because she ran out of a few things ($20.00).  Guess what she only has $10 in your pocket until the 15th. Her child walks up to her and say, "mommy, do not for get you suppose to give me $20 for my trip so I can go to the gift shop". Oh yeah im forgot about that.  Kim go out and borrow $100 from a friend. $50 for the water bill that past due a few days and $20 for the trip. The rest is just in case she need food of more gas. Now the 15th comes around. Her check is the same amount again. She has already planned to pay $500.00 in bills that are already past due. In bill she has to pay because its a cut off notice (electric $300.00). She is paying $100.00 towards a past due bill. Now I said she is paying "towards" a past due bill. The company is allowing her to pay a partial payment.  Now she has to pay her friend back the $100.  But guess what she only has a $100.00 to her name. She tells her that she will give her $50 now and $50 when she get paid again. She need that $50 to last her until she get paid again. Of course, that will be gone in a few days.  Now her friend is mad at her. Guess what Kim doesn't understand why. Oh yeah she is looking good in those jeans with no money in the pockets.

I'm sorry if that scenerio is not clear. I know that may seem extreme but people do things like this all the time and then blame it on someone else because that do not have money in their pockets .  Its a never ending cycle to some people. Its something I will never understand.

Hey just because you are approved it does not mean you can afford it. Creditors only go by whats on your credit report and what you tell them.  If you tell them you only pay out $900 (not including gas, groceries, etc) out in bills a month and you know that you pay $1300 plus the groceries and gas, you are only hurting yourself.

I'm just sick and tired of people thinking that creditors are wrong for calling them. We are doing our jobs. You know you owe the money. Do not wait until we pick the car up, garnish your check or pick your furniture up to return a call. Escpecially if we been calling for months with no response. Stop with the lame excuses. You really have to come up with something better.
Examples
"My phone was not working"...."I was out of town and I left my phone at home"
"I let my brother use the phone"... "I get your messages but I do not get off until after you close"

Ok guys, you at least know one person with a phone. You can convince me or the next person that because your phone was not working you have not talked to anyone on the phone for several months. The work thing is just retarded. I forgot people do not get lunch breaks.

"My mother died"..... "I saw on the news it suppose to snow" (customer lives 20 mintues from the office and it hasn't started snowing).

Guys we know when you hit ignore on you cell. Its not a secret.  It really does'nt help the situation.  Do not say you are going to pay only because this time you answered the phone by accident (you forgot to look at the caller ID).

There was this one customer we called for over 30 days. He never answered the phone or returned a call. I called hime using alternated cell phone.  He did not answer. He called back about 5 times and texted about 2 times trying to see who called him. He never answered or returned call when I called from the work number but when I called from a different he returned call. I did not answer. I wanted to see if my theory is right.

When you do finallly answer after 30 calls. Do not act like we suppose to know about your situation. For example you had surgery and could not work for 60 days and your short term disability has not kicked in. How do we suppose to try to work with you if you do not answer.

For the ones that are getting calls and they have the wrong number. Do not assume we know that. That number could of belonged to someone else 3 years ago and the collection company just found it but we do not know if it belongs to the customer or not.

Hey guys I wanted to vent some more but I'm getting tired. Its turning into rambling. Hey excuse the grammar and spelling.  I did not feel like proof reading. You know what I'm trying to say.  Hey guys I'm not pointing my fingers at anyone. I just saying just pick the phone up and promise you, the person on the other end is not going to jump out the phone and bite you. Hey like I said alot of companies are willing to settle out with a one time payment only. Some will settlement and take payments on that settlement. And some will not settle unless you make a one time settlment payment, but they will still take payments.  Do not wait until you are ready to buy a house and get disappointed and angry at the lender because they do not approve you. You did it to yourself. Hey get a job at a finance company or a collection company and you will understand what we are talking about. We are not talking aboout those people who are losing their homes and cars because they are physically unable to work and now have limited income.  I'm not talking about those people who lost their job of 20 years and is out there everyday and trying to find work, going to interviews and picking the phone up and telling them that you are doing your best and you understand what the outcome may be. I'm talking about the ones that borrow money(know they can not afford to pay it back or does not have the attention on paying it back) , apply for credit you do not need but want and live above their means and wonder why this 1-800-545-2638 is calling them every other day. And got a nerve to get mad.  At least when I used to get collection calls I did not get hang up or blame anyone for my debt. I did my best and eventually paid them off.

Im sorry, I know I said short, but actually it is shorter then the one I accidently deleted. hahahahahaha.

First of all...  "What debt collector agency company do you work for?" <---- what the hell did you just say because you just sounded real stupid right there, and secondly...  if your not the person accruing debt that you can't afford then that message doesn?t pertain to you dummy, its pertaining to the morons that use credit as free money to buy electronics, Christmas presents, accessories, ring tones, etc while thinking they have a lifetime to pay it back while they don't have a pot to piss in.  Its pertaining to the morons that claim they are honest but after they haven't paid their bills in 2 yrs they get mad at the people calling to collect on the debts that they put on themselves, screaming all sorts of profanities like you are ?ignorance my ass? or playing phone games....  so how many debt collector agency company bills do you owe 'ignorance my a**'??  You're not a victim...  YOU'RE A DEFENDANT, A DEBTOR!!  Most debtors borrowed money when they had no idea when they would get it all paid back.  Banks are business that put their services out to consumers to make finance more of a convenience to people of their country & when people like you step all over their business, banks become the victims & instead of suing your a**, they hire agencies to work out a payment arrangement, or cut the amount you typically owe as a courtesy.  You know what though, its people like you that are so hard headed, hide, cry like a little junior high school kid would & slam down the phone instead of taking responsibility for your negligence.  I don?t kick people when they are down, but I?m not going to powder your lazy rear ends either.  I try to educate people but I?m not given the time of day because I?m that horrid debt collector.  I?m that horrid person trying to collect money that was never yours to begin with.   If you don?t like the phone calls then just think about it, you put yourself in this spot so put your damn grownup pants on folks, take responsibility for your actions & DEAL WITH IT!!  I am not greedy, I pay my bills, I don?t spend more than I can afford & I do my job according to federal law, which is why I am not under that poverty line with the rest of you.   And ?ignorance my a**?, you?re right, every dog does have their day & I can?t wait for the banks to have their day with all of you because for the ones who scream profanities at me, hide from me, hang up the phone on me and especially the ones that tell me you are working, receiving unemployment, soc sec, or disability yet wont mail in 10 bucks to show you care about the mistake you made, that gives me all the reason to keep my head up my a** to those select ones, send all documentations back to the banks with all the recorded vulgarity from each call showing you have no care in the world what so ever for mistakes you made.  Best of luck everyone yet I hope those mistakes come back to bite you in the a** when you really want or need something.

collection companies respond moreso to calls not answered because it is so common for society to avoid the problems until it is at their best convenience, so per fed law & state laws, they will continue to try contacting until further notice is given.  For lack of better terms, you can't expect the calls to stop if dont report it as a wrong number.  This Bruce character could have used this number 7 yrs previous when applying for credit, your number will probably keep getting the calls until you report to the credit bureaus that its not his number.  Agencies get accused of harrassment for that and yes its annoying to keep getting phone calls for collections, but its not the company you should be mad about, it should be Bruce that you should be mad at.  Company is just doing its job!!  Call the number they leave and report it as a bad number, once you do that and if you keep getting calls from same place and same people, then there would be reason to complain to a message board.

Kelly,

Debt collectors are prohibited by law, to disclose the exact nature of the call with all the juicy details, over an answering machine.  That is a lawsuit waiting to happen.  Those people deal with the so-called consumers that hide from their debts everyday.  I really feel that if you or anyone else have no issue on paying your debts and someone knows you & any information about you or anyone else in the household, family or circle of friends, that should be immediate cause to find out exactly what the situation & expedite the matter appropriately.  Ignoring the phone calls doesn?t make someone go away nor is fielding calls for household members will benefit them in anyway possible.  After all, anyone calling you that need a return call in a timely matter is contacting you on information you have previously given up freely to gain access to the credit you racked up & didn't pay in the first place.

Kelly, theres no secrecy in what she left you on your answering machine, its a right to your privacy by the FDCPA, as well as saving a lawsuit on the company she is collecting for, on YOUR debt.   People, it is not a scam, we live in a complex world, with complex rules.  There?s a huge difference between companies that steal and the companies that are collecting on a debt YOU owe.  Companies or individuals of companies that steal will get caught & prosecuted eventually, but the companies that collect on the debt that YOU incur on yourself will report the debt in good standing if taken seriously by debtors.

These aren't goofy calls these are chances to reconcile the differences that have occurred on YOUR behalf, before it gets worse on you.  Debt collectors are not the enemy, they are the mediation people need to seek out before the matter gets way out of hand.  Debt collectors are the enemy to many American citizens because the citizens are faced with the confrontation of their mistakes and instead of owning up to their mistakes & handling it like the adults that they supposedly are, they get angry when they can?t handle things at their convenience.  It was so convenient for them to put down all the information, including where they work, phone number to where they work, maybe even phone numbers of references or guarantee the blood of their first born child just to get what a lot of people seem to think of as ?free money? but when it comes to paying back that money they find out is no longer ?free?, debt collectors are considered as desperate, dangerous low-lives (persay from another report posted on this website).

If you don't like constant goofy calls, DON'T ACCRUE THE DEBT!!  Don't sign a legally binding contract that states you are responsible for all money spent and all interest & late fees that are included during the term of the unpaid loan or credit card.  Don't live beyond your means & don't borrow anything you can't pay back.  Just think, you would be making the same calls to someone that borrowed money with "the best intent", anywhere from as little as $500.00 to $10,000.00 (and beyond) from you, and don't say you wouldn't because money is money and what?s yours is yours.  Either you wind up letting your money go in anger that you?ll probably never get it back or you take that person to court to guarantee your in some sort of way.  And also a friendly reminder, the ones that use the economy as an excuse of why you can?t pay debts is getting lame because unless you have been in a natural disaster where you lose everything & can willingly provide physical documentation to prove it, you should have no problem paying everything off in a short timely manner.  Everybody wonders why banks are getting all these bailouts yet consumers aren?t, well it is mainly because the banks initially took a huge risk by giving a large percentage of Americans the benefit of the doubt that they will follow through the terms they have committed to, to have access to extra money.  Instead, a vast majority of that percentage of Americans are dishonest & take advantage of this country & the services that have been provided then blame the government when budgets are cut.  America is it?s own worst enemy & American citizens have a terrible habit of blaming their defaults on anyone else but themselves.  With all that said, people need to grow up, stop with the excuses, stop the laziness, live realistically, stop milking the system, stop robbing Peter to pay Paul, stop living beyond your means, stop spending money you don?t have to get the things you can?t afford in the first place!

And Kelly, next time just make it easier on yourself & everyone else & just answer the phone & use the service you are supposedly paying for.  It?s kind of goofy that you seem so secretive to hide from something you put on yourself.  If you aren?t going to use your phone, maybe it is in your best interest to disconnect & take the initiative to use that email of yours & contact your creditors & explain why you are a disservice to them instead of wasting your time approaching, complaining & contradicting yourself to pointless websites that will get you nowhere I will add, about how companies contact you on legit debts you may owe.  Or you could just put that extra money you put towards a phone you have a hard time using towards your debts that your not against paying yet seem to have difficulty putting the luxuries last..  just a suggestion J

Do be careful about posting e-mail addresses on web pages and giving out any information to callers that say they are creditors. I have no past due debt and had them call and the first thing they asked is what is my date of birth to verify my identity?  That is an attempt to gather information for which they could steal your identity and then use your credit card info to run up bills on your account. I spoke to my credit card company who said my account was current, that they never gave my account to be collected on to this company. READ and REMEMBER THIS: My credit card company also said when they do turn over accounts to collection agencies, they would never give them the account holder's date of birth or that type of personal info such as maiden name, age, etc; they only give info about the debt itself. They said this firm calling me and trying to get such personal info was attempted fraud.

Anyone can get a toll-free number and use it to gather information to take advantage of you. If someone calls saying they are collecting debt, tell them to send you something showing proof of the debt in the U.S. Mail.  If they ask your address, tell them to send it to the address they supposedly have on file, don't give that out, it tells them more about you.  Chances are they will not send you anything.  Stolen account information gets sold, others try to gather more info on you to scam you.  Protect yourself. Think of your phone ringing and your answering machine messages like you do your front door. You don't have to answer it and just because someone knocks, you don't let them in if you don't know them. Protect yourself!

Bud Says                         Consumer Comments Below

Creditor's Interchange is located in Buffalo, NY,  and they have a large collection operation across the river in Canada where the wages and worker benefits are even smaller.

VERY aggressive debt collectors who lie, threaten and do any illegal act imaginable to separate you from your money. These are nasty, desperate conmen,  and should NEVER be trusted. They have posed as bankers, lawyers and other professionals to scare consumers into believing something bad would happen, if monies were not immediately forthcoming.

In reality, these low-lives of the collection industry are nothing but a fraud! Any debt collector from Buffalo, New York is desperate, however Creditors Interchange apparently is hiring the WORST of the WORST! Stay far away -- they are desperate and dangerous.

CAUTION: I recommend you NEVER disclose your bank account or credit card information to a debt collector, as you risk them emptying your account, or maxing out your credit card. If you feel they are reporting on your credit bureau files in error or need assistance in dealing with them, email  the details w/your location.  Assistance and referral to a consumer legal specialist may be available.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.

The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.

Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.

Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?

If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:

Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:

you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:

give false credit information about you to anyone, including a credit reporting company;
send you anything that looks like an official document from a court or government agency if it isn?t; or
use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.

Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:

Social Security Benefits
Supplemental Security Income (SSI) Benefits
Veterans? Benefits
Civil Service and Federal Retirement and Disability Benefits
Service Members? Pay
Military Annuities and Survivors? Benefits
Student Assistance
Railroad Retirement Benefits
Merchant Seamen Wages
Longshoremen?s and Harbor Workers? Death and Disability Benefits
Foreign Service Retirement and Disability Benefits
Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

We've gotten repeated calls from this number, extension 4158, asking for a Bruce so-and-so whom we've never heard of.  We've had our current number for 6 and a half years so very unlikely that they have a current case with someone whoever had this number.  First few calls were obviously automated, but the most recent message left on our answering machine, sounds more like a real person left it, but I supposed that could be simulated by a machine.

Mr Nuchereno calls me. Threatens to attach my 92 year old mothers assets. Call back number is 800-545-2638 (different than where he called from)
Just googled creditors interchange. Be careful boys and girls! Many thousands of complaints, lawsuits filed against them, the worst BBB ratings possible, sanctions from many state AG's and tons of references of them stating 2 or 3 times the amount actually owed as they did with me. Further, theres many statements of debtors paying a lot of money to creditors interchange and that money never being applied to the debt. Simply get their address, write them a short note to never contact you again for any reason. Be sure to give your name and ci reference number. Go to the Post Office, spend a few bucks to require a signature for delivery. One more call is all they're allowed then they can only contact you by mail. Its Federal law and if your smart and keep track of everything they say and do, you might easily cause them to pay off your debt for you! Their Penalty for screwing up and violating ANY part of the Fair Debt Collections Act. Check it out! Valid in all 50 states!

I received a phone call from a female,'kate' saying that she needs to get in touch with me in a timely matter... or she will have to make my discissions for me.... First, when you call me you need to let me know who you are... and for what debt you are collecting on. I am honestly not against paying on my debts, but why all of the secretcy... just let me know what they are, with all of the details... I hate goofy phone calls that literally give you no information, except to call them back...I am not really good at answering my phone, the best way for you to get hold of me is by email... my email address is kjherrick@charter.net If this is a real call you can email me, if it is a scam... don't both bother. Kate next time leave the company that you are calling from
