The number that calls here each day is 800-580-7611.  The recording said to press 1 if I wanted to talk to someone.  I pressed 1 and asked the man who answered, "What is FMS and why do you keep calling me?"  He disconnected me immediately.

FMS calls our house every day, often several times a day.  They don't identify themselves and I don't know who they are. When I anwser they say"if you would like to speak to a representative press1
" I don't understand this. If its so important they must call several times a day, why am I speaking to a robot?! And why would I want to speak to a representative when I don't even know who they are or what they want?

They don't sound very professional to me. They don't even call the people themselves they use a robocaller which they aren't supposed to use especially when they don't answer when the person picks up or presses one. After reading other posters responses to this company they sound like your typical zombie debt collector that needs to just disappear.

If they were they'd be required to send you something via mail. They also have to give you an address if you request it so you can send a cease and desist letter. I just got a call from them myself and I pressed one (shouldn't have) and they never said anything I believe the robo calls are in violation also.

I just called the 800 # back as they've been calling at least once a week, then hanging up. I got a live person who asked for someone not even living here. I explained I've had this number for over 12 years and never heard of that person, and he politely said they'd remove my number and stop calling. Just for what it's worth...

800-580-7611 appears on the callerID, and when I pick up the phone and say "hello", a recorded voice says "This is FMS. If you wish to speak to a representative, press 1. If not, this call will be terminated."

I do not owe any debts to anybody.

This calls happens everyday M-F, sometimes 2x a day.

they don't have the right to call you if you send a letter telling them not to call you. (certified mail, return receipt).  if they call you after they receive your letter you can put them in donotcall.gov  or file a complaint with the attorney general in your state.

Sorry, but the DNC laws DO apply to debt collectors as well as telemarketers:

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

again, incorrect.... donotcall.gov stop solicitation's made by telemarketers and marketing campains... DOES NOT APPLY TO DEBT COLLECTORS, debt collectors have a legal right to call you, all contracts signed by a consumer state that this will take place if you default on the loan... you can request a ceast and desist, but at that point the collector will probably turn it over to a law office where you will be sued, and if you do not comply, you will be garnished.... so in laymans terms..... PAY YOUR BILLS... all the effort people put towards complaining and preaching laws they know nothing about should be directed toward paying your debts

these people are actually very professional and do not break any fdcpa guidelines with call volume or recordings. consumers need to study the state and federal guidelines before judging a company such as fms, i did a little research on the company myself.... since opening in 1993 they have more that tripled their size and revenue, no major law suites ever filed on them, and they are trained by fdcpa experts contracted by the federal trade commission. so i call them myself, sd i needed to pay a bill, gave them my name but no ssn or verification info, they sd we can not release any info without it, i said what do you people do, they said handle business matters for clients, clearly protecting the consumers private matters. so before assuming a company is faulty... do your research

I GOT A CALL FROM 800-580-7611 AND WAS TOLD TO PUSH NUMBER 1 FOR A REPRESENTATIVE.   THEY WERE CALLING FOR SOMEONE ELSE, WOULD NOT IDENTIFY WHO OR WHY THEY WERE CALLING.  DOES ANYONE KNOW WHO THIS IS.

FMS Inc. calls my house every week morning at 8:am, and now I don't get a recording, I get nothing. They just call to wake me up every morning.They are calling for my husband, abd he is out of the house by 6:45 am every weekday. I told them that, and the guy got rude with me, so I ask him not to be rude or I'll just hang up, which he replied, "Go ahead, hang up, its all good", and now they call at 8:am, and say nothing, the guy calls just to wake me up.

Just received a call telling me to call them back at 866-674-0156 or press a number to talk to a representative.  Recording said "THis is not a sales call!"  So it sounded very important and of personal business.  
Obviously they are still at it as of July 2008.  Same message as posting by Sharon in 2007.

I live in texas and have been getting calls to our home phone number for a particular person - Kenneth Crenshaw - and have attempted to stop them.  Listened to the message long enough to get a 1-866-530-3819 number - they would not tell me who they were or what they do - I DEMANDED that they stop the calls to our home - it is REDICULOUS - we get these calls at least once a week.

A call stating that I owe a debt to JC Penny and I have never recieved a letter from Jcp about the debt.  They also state that they can't send out a statement due to it having to go through their lawyers. I stated that until I receive something in the mail I will not be communicating and they still haven't sent anything but continue to call and try to intimidate me with scare tactics.   Beware that I can't confirm if this is a reputable company or not.

Recording from company FMS, Inc.  telling me to push "one" to speak with a representative or call back at said number.  Sounds like telemarketer but it's not.  It's Financial Management Services, Inc. out of Tulsa, OK, a junk debt buyer (fms-collect.com).  They will not even identify the person they want.  I have had several calls from collection agencies for person who used to have my number.  Almost a year now. Doubt it's me unless it goes back to my divorce in 2001 and that would have been under a different name.  Violation of federal and state debt collection laws.  Failure to identify themselves by their legal name.  Calling with intent to harass and annoy.  Using deceptive means to collect a debt.  Had to hunt them down on the Internet.  Waste of time to report to Texas Attorney General.  Waste of time to report to Federal Trade Commission.  Get letter back stating they use such reports for information.  Maybe after a few million of us report them.  Initials (FMS, Inc.) sound similar to US treasury Department's collection agency (FMS) which might intimidate some innocents.  FTC should shut these suckers down for that reason alone.
