You need to state that you are recording the conversation.  If they refuse to accept payment their done.  You simply need to ask "Are you actively refusing to accept a payment of good faith?"  If they answer with anything other than "NO" they have violated the FDCPA.   Then file a counter suit and contact your state attorney general and file a complaint.

They are violating TCPA laws. Look up the TCPA and you'll understand how much they are truly violating laws that are there to protect the public.

This is Johnson Mark, LLC. They are a law firm that collects debt for junk debt buyers. They violate the law all the time. I am in the process of filing a class action lawsuit against them for violating tcpa and other laws.

Each time they do this, it's a minimum 500 dollar fine per violation, up to 1500 dollars per violation. They do it willfully with intent so we'll be shooting for the higher amount.

About 8 or 9 months ago, my client was involved in some business dealings with a local drug dealer whos name is Mark Johnson.  In a nut shell, my client ended up owing Mr. Johnson a small sum of money.  In an attempt to continue working for Mr Johnson, my client offered up collateral with the sole purpose of convincing Mr. Johnson that the debt would be paid.  Once the debt was paid, Mr. Johnson agreed to give back the said collateral.  My client paid $20 once every day, cutting the debt in half in just a weeks time.  Unfortunately, due to personal difficulties, no more payments have been made.  The result is that Mr. Johnson continues to keep the collateral.  
Now, here is the funny part.  For the last two weeks, my client has noticed that a caller with the name of the local drug dealer whom he owed money too, have been showing up on the caller ID..  My client just tonight decided to call the number back which he got voicemails.  No messages were left.  Next came a google of the number.  Finally this post.
Hope it brought a good laugh.  I know my client isnt laughing.  lol

I received a letter from these people, address PO B)X 7811 Sandy Utah, phone no. 801-285-7811- claiming I owed money to a DME LC and they had been retained (calling themselves attorneys) to collect the money and charge me attorney fees also.
They are listed in one place as having 35 specific collection complaints, and 8 other harassing phone call complaints.  They are also listed in Utah, Oregon and Idaho at least. Secure search turned up a "Johnson Mark LLC complaints" list a mile long on mcafee-secure yahoo search

I sent a copy of their fraudulent letter to my attorney for reference and information.

Aaron Heaps lives in Holladay, Utah. He works for Johnson Riddle & Mark LLC.
This p*&$e of Sh*t has been harassing me and after paying them for over ten months on a debt he has finally sent a garnishment to my employer asking $493.78 a month to pay off $5173 due when I clearly remember him giving me a balance of $4250 when the payments started. Obviously he has inflated the debt, when I was late one payment, he made true to his threat of sending in a pay garnishment. And now the new balance skyrocketed to over $5000! This man has no scruples and is greedy as they come.

I saw this number on my Caller ID a few days ago.

Caller ID says Johnson Riddle, leaves no message and calls always when im not home.

This is a law office/collection agency out of Draper Utah.

Here is my problem: The keep calling for someone that obviously had the same number as I do. My number now belongs to the company I work for, and despite me telling them that every time I call, they continue to call to ask for the person that owes them money.,

Maybe we should all pool together and mind this Aaron Heaps and harrass him and his family so he wishes he had never worked this BLEEPING company.  Looks like they have offices in OREGON, IDAHO and UTAH.  With a little detective work I think someone could find him and publish his Phone number and we can all take turns calling him at home of course.

Totally Legit. My boyfriend just got served. Old Capitol One Debt!!!!

I have received many calls . It is for a legitimate debt. I am unemployed and my previous employer scammed several employes and paid wages from a personal account. I have tried to work with this company and they are refusing any payments other than in full. I do not even have a checking account or credit card anymore. I have no personal belongings anymore and "rent" a small basement bedroom in trade for babysitting a friends children and doing odd jobs in the neighborhood. I have a dead car that has been parked for over a year. I told them to take it. THey said they will not accept any form of payment other than cash. I have no living family. They inferred I am lying to them and that i do have ways to pay them. They also claim to have served me and I have a court date. I have never received anything stating that information. I called them and they say I signed for it and missed my court date and now have a bench warrant.

Yes, Aaron Heaps is s*** as is everyone else in their pathetic organization. They were failed ambulance chasers turned debt collectors.

Wow. They are good to work with? I owe them money from a recent debt. They got a judgement against me within only a couple months of receiving it, then. They then too their court order and stole all the money from my fathers checking account because my name USED to be on the account. That is right, they ripped off all his social security money of him and my mother. And NO, my name has not been on the account for a while. Their response...'Well, we have our money now, so you go ahead and do whatever you think you need to."
His bank has written official letters to them explaining their error and they have ignored them. Yes, they will rob a family member to get to your debt.  They are criminals.

This Aaron Heaps is an idiot, I payed them religiously on a hospital bill. This idiot dug into my account and found an old credit card bill that had been sold for pennies on the dollar umpteen million times, served me with papers and doubled the amount. I tried to explain I went through a career change starting at the bottom again...they don't care!
I can't wait till I meet Aaron in person to thank him, I hope his wife and kids are present when I thank him.

Just called, left message.  Looking for someone else not I.  These people have called 6 times a day or so.  I have put my number on the do not call list with these people before under a different rep.   Seems like they get new people to call everytime even though I put my number on do not call.

I received a phone call from 801 - 285 - 5700 today, yet when I answered the phone they hung up.  I have received a lot of these phone calls in the past 3 weeks or so.  Every time I go to answer the phone the call hangs up.  I am not answering anymore, it is too annoying when the caller always hangs up on me.

Today I got another automated phone call from this phone number so I decided to call them back again.  A friendly voice answered "Johnson, Riddle, and Mark" on the other end and this time I decided to be friendly and get right to the point.  I told the girl that answered that an automated computer had called my cell phone again and it was asking for someone who wasn't me.  She asked me for the cell phone number that was being called and I gave it to her.  Then she confirmed that the number was associated with "Norman Avant" and I reiterated that it wasn't me.  She was very pleasant and said the phone number would be removed from that name.  I don't have any reason to doubt that it will be removed.  I certainly hope so.  It was a much better experience than yesterday.  Maybe they were really busy yesterday and on other lines and that's why I kept getting their voice mail.

I have received 3 automated phone calls from this phone number over the past week to my cell phone and it was always asking for "Norman Avant" (or something like that).  It said that if I wasn't "Norman Avant" I should press "0".  I figured it was a scam so I just hung up.  When I got another call today I decided to call them back and a lady answered saying it was "Johnson, Riddle, and Mark".  I started telling her what was going on and she immediately transferred me to a voice mailbox.  I didn't want to leave anyone a message so I hung up and called back.  Again, I got their voice mail.  I've called several more times but each time I got their voice mail.  It would be nice if I could figure out a way to talk to someone and get them to stop calling me since I'm not the person they're after.  I even tried pushing "0" the last time they called but after a few clicks nothing happened.  I'm not worried about them trying to collect anything from me because I don't owe anybody anything.  But it does frustrate me that they keep calling me on my cellphone and using up my minutes.

For months these bill collectors have hounded me unmercifully at home and at work.  I have offered numerous times to pay as able and have always been refused by J.R.& M.   These people were anything but helpful.  They continue to harrass me and have threatened law suits. Phone collector who calls himself a para-legal called Aaron Heaps and he says his company will settle for nothing less than 100%. Perhaps it is the economy that is causing this company, that propably works on a commission percentage basis, to become desperate and rude in their attempts.  Calls this firm  left on my answering machine stating they are attempting to collect a debt is a type of disclaimer, but it does not negate their responsibility to not broadcast defamation about me.

They are a legitimate company, I have worked with them before and I am working with them now.  They take over the past due accounts with my local hospital before they are sent to collections.  They are actually very good to work with and I have never had a problem with them.  I pay what I can and they accept it without argument.  If only all collectors were as accommodating as them!

If they are a legit legal firm they would know that they can't go and broadcast someone's name and they have their machine go ahead and say that it is debt collection call.  Then these "Unknown Name" that shows is another problem.  

Don't they realize that answering machines will pick up the entire message.   Like Duh-huh!

They need to do their research too, and then they could save a lot of time for the people that the ring up with wrong information.
