Well I was just served today.  I called bk to see if they would let me settle outside of court, and no one would speak with me.  Now I'm scared that their going to hit me over the head in court with fees I can't afford for a loan that was only $150 2 yrs ago.

IF a lawsuit is acutally ever filed which from my experience working there, the majority of the times its not. Its just not worth the time. effort, and expense to sue in court on payday loans which usually are $500 - $700 on avg or less.  Granted the payday loan companies will do their best to collect and the paper may be sold to several different collection agencies before its eventually just written off.

I received a call from them as well. I work for a debt collection law firm and I have to take classes for my firm about what I can and can't say to ensure that I am not breaking any laws.  These people are breaking the law.  First off if we hired a process server to serve you the Complaint we WILL NOT CALL YOU and give you a heads up its coming.  Second we are not going to hire a process server because it COST TOO much.  Third if the process server has documents to serve trust me you will be able to look up the Complaint because its public record.  These people are liars DON"T fall for their mess.  IF you do owe the debt TRUST ME
they can't do anything to you UNTIL the law suit is filed in your county.  They are trying to scare you into paying back the debt...

That's funny!  Too bad we can't have a conference all with them.  I would really like to get in on harrassing them like they do us.  They give you a different story each time you talke with them.  They actually told me they were an attorney's office the first time, and then denied it when I called them back.  They need to study the laws a little better before they try pull their con job.

These people are nothing but collection agencies that like to call themselves 'firms' in the attempt to sound & scare you into thinking they are an actual law firm. These companies collect on payday loans. I know this because I briefly worked at one of these collection agencies. (Please dont hold that against me!)

I had a call this morning from 804-420-4833. I forget the name of the company she said she worked for but she refused to give me the name until after I asked her 3 times. She asked me if I had already been in front of a judge concerning charges of 'fraud' and 'breach of contract' that were 'filed' against me by a certain payday loan company.

Knowing what I know, I decided to have some fun with her so I called her bluff and asked her are these actual 'charges' or 'accusations' against me. She stated they were charges. In return I asked her if she was with a law enforcement agency or worked for the state attorney's office. Predictably she said 'no' to both questions. So then I asked her how can there be actual charges then?  She got irritated and said that if I didnt want to handle this voluntarily I would 'suffer the consequences' and then she quickly hung up. I just laughed because she knew I was on to her and she had no comeback to my rebuttals.

Look folks......its a matter of public record if you are being sued or if somebody has papers out for you to be served. All you have to do is look up your counties court website and you should be able to search both civil and criminal court cases by last name. And it will show you if papers are out being served or not. So before you panic do this first. This robo call is meant to make you think he is a private process server. Well first off a legal, private process server will NEVER call you to tell you he has papers for you! Thats stupid! And second the robo call claims its because of fradulant activity linked to your name. If it was indeed fradualnty activity concerning bank or check fraud, it would not be a private process server serving you your papers. This is considered criminal and you would be served buy your counties sheriffes department. As "sick of it" says above, question everything when you talk to them but admit to nothing and dont agree with anything. This is a scam and a bottom feeding collection company that uses illegal scare tactics. Dont let them scare you!

They are so stupid that they told me they had already sent my case when I kept questioning them on it.  Then they send me all around the office because they don't want to give me an address.  At the same time the robocall is calling me again on my cell phone.  What idiots!!  They aren't even good scammers. When I answer my cell phone they put me on hold because I question why they are calling me when they just told me that my paperwork had already been sent to the county.

What does that mean? Are you saying to ignore it and see what happens?  It is a little hard to ignore when they call everyday.  I have checked with the bank and the supposed people that gave me a loan, and neither have any record of anything.  Yet, according to them, it has already been sent to my county to have me served.  It makes absolutely no sense.  They are calling my elderly mother in law too, which it is illegal to give my personal information out to other people. The ridiculous part is it is a robocall, so they won't even respond when she tries to talk to them.  How is all of this legal at all!

Who served you?  Was it in relation to the phone call you received, or was it for something else?
The phone call I am receiving is for a company I have never heard of .  I contacted the company, and they have never heard of me either.  I don't owe them a dime, so this is a SCAM, just like all of the other phone numbers they have called from.
