What a debt collector CANNOT do:

?Use deceptive practices. For example, threaten you with arrest or  trick you into paying for collection calls.
?Use obscene language.
?Call you at work after you tell them that your boss does not approve these calls.
?Deny you the right to receive a written notice (within five days after your first phone conversation) that would tell you how much you owe and the name of the creditor that says you owe the money. If you do not receive the notice within five days, call the collection agency and ask for its address and fax number. Then, send a letter to the collector noting its failure to send you the required notice. As a minimum, make a note in your file.
?Refuse to give its name and the name of the collection company when asked.
?Put a debt on your credit report if you file a dispute. It must validate the debt by obtaining a verification of the debt or a copy of a judgment from the creditor before continuing their collection efforts. The results of the investigation must be mailed to you.

They called my place of employment stating they were going to serve a warrant. A person by the name Alexis Wyatt with the El Paso County Legal Department. I don't have warrants or outstanding bills!

I received a call from this number saying they were Paul Kollins from Legal Services and that I was being charged for Check Fraud and that he was coming to my house or to my work to serve me the summons.. Scared me to death..   Please someone STOP these people... 1-855-215-4119 - I made the mistake of setting up a payment plan - because I DO owe this money from A LONG TIME AGO.. and then I made the mistake of giving them my CREDIT CARD number... oh my gawd.. now what do I do????   Now I have to cancel my credit card?  But they said they were going to COME TO MY WORK and SERVE ME PAPERS.. and if that happened at my work I would probably get fired... and I cried and told them I could not lose my job and PLEASE not to come to my work... it was just horrible.. and then to find out they are not even with the court system?  I am so upset.. now they have my credit card number... OMG.

These people been harrssing me at home and at my job. it coming to a point where i don't knw what else to do but probably go to the police or the attnory general office and file a compliant. A Chris Stricker called my mother yesterday and left a message on her voice mail and  stated there is a fraud aganist me and also left a case number. I will probably go to my law and expalin this to him and see if he can make these stupid good nothing individual to leave me alone for once. Chris Stricker also called my friends and told them they will be serve and it goes too far nw.

Got calls yesterday (and posted about it) from a Chris Stricker said he was calling from Santa Clara County Legal Services.....had a case pending was going to serve me at home and work....blah blah blah.....I called the courthouse yesterday and there is nothing pending against me and the case number this guy left does not even exist....told me to call 855-215-4119 to stop the process.....ok first off....I serve people paperwork in my line of work and YOU DO NOT CALL AND WARN THEM IT IS COMING BEFORE HAND!! second, if you said you were serving yesterday, where were you? I was at work and at home and so was my spouse.....nobody showed.....now this morning, Chris Stricker left the same message as yesterday on both my work and cell phone and then a MIKE ROBINSON calls my EX-HUSBAND and says there are check fraud charges against me....of course my ex emailed me and I had to explain all of this to him......we have been divorced for 12 years!!! THIS IS CRAZY......i did file with the FTC and they told me this was a scam.....my advice....if you feel like something is "off" when these people try to bully you into paying them money you dont owe, contact the court house in your county and head them off.....if you are law abiding, you have nothing to fear.....thats how I handled it.  It doesnt stop them from calling unfortunately, but it does give you peace of mind.....

ok....so after the message I received this morning I CALLED the courthouse in my county to ask specific questions.....talked to the clerk......no such case numbers in this county with the letter/number combo this Chris Stricker left....nothing filed against me anywhere in my county.....so I then CALLED the FTC.......gave all the information I had and added the following names and numbers to the complaint:

Received a message on my work phone this morning at 7:30.....Not sure if this is the number they were calling from, but this is the number they left saying I can contact the petitioner (855-215-4119) Some guy stating his name was Chris Stricker from my county's (and used my county name), said he was a process server and would be out to my home to serve me and if I wasn't there, he would be "escorted" to my job.  He left a case number, however, I ran all my personal info and that case number through my counties website NOTHING comes up on me and that case number does not exist.  I even did an internet search for all the same info, my name and the case number....again NOTHING.  When I searched this number, I was led to this site.....I will be filing a complaint with the FTC and the Attorney General....

This is all fraud.... I get the same call every other day.  They have my info correct, but never ever have I ever recv'd a payday loan.  I have had family members put me down as a reference, but these perople at this company say I am just as liable cause they used me as a reference... This is a bunch of crock and therefore you should just let them know they have the wrong number and they will remove it.  Otherwise, they are going to continuously call you at home and at your employer

Also got a call from someone claiming to be named David Dukett from this number.  Also threatened with a subpoena, but keeps telling me when it is going to be here.  Why would any legit server tell you when and where they are coming?  This is not my debt and they have even said it was not for me, yet still call saying I did not take care of business.  The only thing they are legally allowed to ask is if I know the person and if I have any contact info for them.  This has yet to happen.  Filed complaint with FTC and my State Attorney General.

I received a message from a James Foster from this firm stating I should have received some court papers and he wanted to go over page 15 (hearing dates and times) with me. He also stated he needed a statement for their client. The phone number he gave me was 855-215-4138. I'm very sure he is a scammer. Where can I report these people?

hey susie what happened to you happen the exact same way  a guy from wayman and foster at 85502154119 called last week told me i was being served at home never did i had to sign for it it should have came out a lady from this offfice told me they should have sent it out already i told  her i never recieved anything a guys calls me today oct 6, 2012 left a message i had enough chances im being served monday at 9am at my home but my suppose to be court date is oct 9 dont u think i would have been served by know hahaha i never had a checking account i did get a payday loan not a check debit card i was laid off during the time to pay it back tried on several attempts to pay but couldnt since i see so many people going thru these same people know im starting to wonder i was getting very nervous about when he said fraud pleas let me know were u ever served papers at your home, did u ever go to court i really need to know so i can rest my nerves please reply if u can thanks a million

Received a call today from Angela Trout at Legal Services regarding a check fraud case - at least that's what she thinks her name is! LOL!  Today's call:  "My name is Angela Trout, uh, sorry, (silence), yeah, my name is Angela Trout, I'm calling from legal services......". Unbelievable, trying to collect sums not owed......and can't even follow a script!  These people have called me from several different numbers - all with the same message.  I never return the calls.

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

i have been harrassed by thiese people for almost a year and a half i have had my house burglarised called continuously at early morning hours and even my daughter and friends have been harrassed at there residents they say they are wyman and foster law firm they refuse to let me talk and just keep insisting that  i owe them money and something about check fraud which i have not done i had a burglary for over 20,000 dollars of tools and jewelryafter the calls started and then on june 1st 2012 someone hit and ran causeing me apermanant injury to my spine L3 L4 and L5 thru S1 and totaled out my car i had recieved some threatening phone calls that if i did not call these people and pay them for some kind of fradulant loan that i was doomed and god have mercy on me it all started back in april 2011 idid not have rental insuraunce and i am now permanantly disabled i now am getting calls from another law firm named Lewis&McCarthy from new york the phone numbers are 716-332-2357 and716-332-2358 i googled there name and found there address to be 4927 southwestern blvd. hamburg,ny14075 and a phone number of 716-748-6135 i do not owe these people any money!

I received a voice mail from James Foster of Wyman and Foster Law Firm regarding a law suit that was filed in their office last week against my name and social security number.  The guy says he needs me to call so he can go over page 15 of some sort of docket I supposedly received at my home or employer. He says the packet would have had to be signed for.  I never received any packet.  He goes on to say the docket contains information regarding my upcoming hearing date and times and also a statement from their client.  He says he will be in hearings the rest of the afternoon and I should call back at 855 215 4138.  I called and the guy that answered said it was regarding check fraud.  I don't have any bad checks written and he said it was from a payday loan I didn't pay back.  This is a SCAM.  I'm turning them into the FTC immediately.

I received a call fromthis number from a guy saying his name is Anthony Barrone with Tony Legal Services. He said I was to be served papers as well as two others in my familiy for a fraud case and if not at home they would come to my job, Number one I haven't committed any fraud or neither has any of my family. I tried looking up the name of the company and phone number but could not locate it. I think this is some kind of debt collector and I don't appreciate being harrased, is theresome way to report these people cause they are calling my job and I don't need or want to get fired much less the embarrasment.

This is EXACTLY the same thing that is happening to me.  They have called family member and a previous employer, my Grandmother-in-law.  Trying to get them to pay the "bad check" charges for me.  I ABSOLUTELY do not have a bad check.  I have never used my husband's grandmother as a reference.  They told them that I would be arrested and thrown in jail.    Claimed to be Legal Services with my mom and told her they were trying to help me avoid court.  My mom thought they meant the state's Legal Services department.  That's what made he suspicious that the state's legal services would offer to take payment to settle a debt.  Said they were holding my mom, ex-husband (which shows how old their information is) and my sister (by her maiden name) liable as well.  My mom paid these creeps several years ago a "settlement" of 150 dollars without asking me first if I owed anything they scared her into it.  I tried back then to get her money back.  Filed complaints with the attorney general's office in my state but I couldn't get anywhere, my mom had me drop it.  I didn't hear anything from them for several years after that and now they are back at it.

A Mike Robinson from Ryman and Foster called my wife's cell phone, her job #, my house number, my oldest daughter and my mother in law leaving threatening messages about having charges pressed against my wife and some how my daughter for check kiting. He gave out my wife's social in the message he left on my mother in law's answering machine saying that if my wife did not call within a day he was going to file the charges.

I had to call my mother in law to convince her this is a scam, for she was going to call and pay whatever fees that my wife allegedly owes. They have my daughter linked with my wife on an account that has been closed since early 2011, and we only had the one account with this bank and it was just my wife and I on the account. When I called these jerks, I told them I was my wife's ex husband and had received a call from my daughter about this. The guy I talked to (not Mike Robinson) Mark something, gave me the name of the bank the check was written on, but would not tell me who the check was written to claiming Privacy Act laws. Then he proceeded to tell me my daughter may only be indicated as witness for the trial against my wife if she was listed unlawfully as a reference. If however my daughter knows about this fraud she would be charged as well.

While this Mark person was able to tell me what county these supposed charges will be placed, he couldn't tell me exactly what law was broken and what law or laws would be used when Ryman and Foster filed the complaint with the district attorney.

I am alerting my state attorney general's office about this and will go to one of my state legislators since I live a couple miles away from him and he serves on the same volunteer fire department as I do. I want to find these people and crush them like the disease ridden rodents they are (metaphor for put them in prison for a long time)

This caller called about my daughter and I on a "bad check".  we don't have any and he didn't have the county correct or anything for where we live.  I live in one state and she lives in another.  stated that I need to call Patrick Murphy with fraud investigateion at 855 215 4119.  Not going to do it.
