Received a call from Natasha Trent with Miller, David and Peoples@855-420-8308, regarding direct involvement in a case being filed . The only thing is , it was in my wife's maiden name . So even if valid it would have to be over 5 years old. We had no bills whatsoever linking the two names or adresses together before then. Since getting married I personally take care of all bills and would have not put something in her maiden name. So to have obtained my cell number and my wife's maiden name it had to involve some manner of information phishing. I returned the call and informed her that Noone by that name lived her and got a quick "thank you" and the phone slammed down. After reading up on complaint s and the BBC report it is clear they are nothing but scam artist.

I'll add that I do think it is admirable that you are trying to pay any outstanding debt and clear up your credit.  However the more you understand your rights, and the laws, the more empowered you will be if this scenario ever arises again.  Especially since there has been a dramatic increase in fake debt collectors/scammer and new legitimate but rogue start up debt collectors out of New York.  Fake and rogue collectors don't follow the laws meant to protect the consumer.

Also don't forget to file a complaint with CFPB, your state AG, and other agencies if you think any laws were violated.  It can potentially give our government what it needs to go after these people if there is enough outcry. Also in some incidents, a resolution can be reached in the complainant's benefit, I have had personal success with the CFPB.

Several agencies have specialized in fake magazine debt, not a one of them showing any respect for people's rights under consumer law. They should all be torpedoed like Kevin Luebke was two years ago.

Maybe the next time a stranger on the phone wants your money, you'll slow down your reaction time. Doing "the right thing" does not equal doing a stupid thing, like paying for some alleged debt which has not been validated. The hustle tactics you heard would signal to me that the collector isn't showing a strong hand, and is likely making illegal threats.

Dave you can cancel any payment arrangements that you made.  Just make sure you follow laws and can verify that the payment was cancelled.  I'm not sure how your payments were set up, so I'm working on limited information.

Also considering limited information, I'd suggest getting familiar with FDCPA, FDIC ACH revocation, credit card disputes, etc.  Depending on the type of debt several other laws come into play as well.  Is this debt actual enforceable legally in the manner the debt collector states?  Several debts are not - this is a violation of FDCPA.  Did you receive a dunning letter (validation letter?)  If you didn't the company should have sent you one within 5 days of contact.  Once you receive this letter you can ask for verification, ignore, or dispute.  Also many states require debt collectors to be licensed to collect debt from residents.  Have you looked into this company?  Are they really a legal firm?

I was just hinting at some FDCPA violations above.

If the debt sounds real/familiar, and you truly want to pay, then I'd say you can work with the company but do take steps to protect yourself.  Verify with the original creditor who the debt went to.  Verify that this company is legit: do a Business Entity Search, Check with the BBB, etc. If the debt is not legally enforceable, but you want to repay, guess what!  You control and dictate repayment options 100%.  All communication should be trackable and written.  Beware of "signing" anything from this company.

However my initial thoughts are that this is a fake debt collector or one operating outside federal laws, and you shouldn't pay a dime and file a complaint with cfpb.gov once you understand your rights.

BBB has seen a major increase in collection agencies starting business in the Upstate New York area over the past several years. In an effort to keep consumers informed about which collection agencies are operating in accordance with federal and state law, we have asked for specific information from all collection agencies located in our service area, including proof of licensing, bonding, and or registration required by NY state or other governments where the business is located, as well as proof of licensing required by any state in which the business operates. This collection agency has not responded to our requests. BBB advises consumers to be aware of their rights in regard to collections. This includes New York States law prohibiting any collection agency from collecting on Payday loans in the State of New York. The Fair Debt Collection Practices Act (FDCPA) outlines prohibited behavior when attempting to collect a debt, and outlines specific rights for consumers. There are penalties for agencies found in violation of the Act. BBB advises consumers to become familiar with their rights under the Act, which can be found at the link below: http://upstateny.bbb.org/storage/75/documents/debtcollection.html To file a complaint with BBB click the link below: https://www.bbb.org/consumer-complaints/file-a-complaint/get-started

That's fine Alisha,  but remember not to admit to any debt and don't give them any personal information.  Simply tell them that you are not aware of any such debt. They will more than likely Phish for additional information to make their story valid.  Be sure and ask for their company name,  regular Business phone # (Not the phony toll free number because they have to have a business phone) ,  their address both physical and mailing,  and  then ask for all the information they have concerning this alleged debt and who the original owner of the debt is, so that you can contact them for further information.  Tell them that you are going to need from them, written  verifiable validation of this alleged debt from the original owner of the debt and proof of their right to claim and collect so that you may review it and dispute it in accordance with your rights under the  FDCPA.  If the Debt is legit,  then more than likely is Past the statute of limitations in your state.  You can check that out if they give you something in writing.
That gives them 5 days to get it to you,   then you have 30 days to dispute it.  (they won't give any of this to you because they dont have it)
Nothing puts a stick in a scammer's spokes like an intelligent person who obviously knows their rights and plans to fight back.   .......good luck.

I was just contacted by Rebecca Weller (or Wells), couldn?t tell, she mumbled the last name and spoke quickly.  She left a number on my Voicemail so i contacted it.  After 3 attempts, the first two reaching a busy signal, I got through to someone.  I explained that I had received a Voicemail and was returning her call.  The lady who answered (btw there was ALOT of noise in the background) transferred me to Rebecca Weller.  She couldn?t recall my case, even though her message states that she is here to help me and that I am potentially being sued by Consolidated Readers Institute.  Once she regained her composure and memory, she explained that I owed CRI over $600 but she had negotiated it down to less than $200 as "services rendered".  She explained where she received my information, albeit the source is over 10 years ago and this is the first I have heard of me being sued.  Also that she has my SSN and my mother?s name and number.  She said they had sent a letter out twice that was returned, duh, I don?t live there anymore.  She refused to send it to me again but would email the information to me.  I gave her my email address (one that is soon to be deleted) and am anxiously awaiting her correspondence.

Upon researching this company?s name as well as the number I came across countless fraud attempts by this woman and her company.  Needless to say, without further evidence or something showing that I received any magazines in the timeframe she is referring by the company she is referring, she will get nothing from me.

got a call from the same number telling me i was part of an ongoing case even gave me the case number. told me i needed to call them right away. miller, davis and peoples. you could tell it was call center because you could hear all the other people who work there and most of their conversations aswell. how dumb do they think people are. using scare tacktics to get people pay debts or debts that are even past the statute of limitations. never ever say you make payment arrangements from a collection agency because then the statute of limitations starts all over. dont worry about the collectors as that is all they are no matter how annoying they get they do not follow the laws set upon them by the fcc and bbb. they will do anything to get you to allow that statute of limitations to start all over then your screwed because it becomes a legal debt again.

I got a similar call looking for my granddaughter. She wanted information and said I could pay the bill for her and she'd send something in writing we could stamp on someones forehead if anyone tried to bother us again. My granddaughter is disabled and I'm quite sure this is a scam based on Ms trents demands but how kind of her to offer payment arrangements to help us out of this ordeal. Very unprofessional and rude should be working at burger king in my opinion. Wont pay a dime!

Miller Davis and Peoples...girl that calls in Natasha Trent.  When asked if I can have the # to the firm...she says "This number is the number to my desk." When I tell her I want another # to call...she says the exact same thing.  They do have a website...but the lack of credentials or success stories...is very odd.
