11/27/2013 and Dave Tracey with PCS Courier for the county had called me and my mother work phone saying  he was going to serve  papers at my place of employment within the hour and if she or myself don't call back, then she would also be served papers to appear in court. My mother called them back, very upset and a female would not put Mr. Tracey on the phone, but begin to holler at her.  The never of these people..How can you lie and misrepresent yourself.

today is 11/22/13 I got a call from work that these people were asking me to call them or they would serve me between 4-5pm  the lady's name was terra collins, i called back and told her that she  had to make sure I was served after 7pm because I work nights, then she put me on hold and never came back, I called again to get who they were and she immediately transferred me to someone who said, " keep a valid id on you and we are in the process of retrieving the information' then they hanged up. so I will wait at work tonight and see what happens. they wouldnt answer any questions.

I also rec'd a voice mail from 855-239-9268 a couple of weeks ago. The person said his name was Dave Tracey from PCS Courier. He said this message is for _______ (he gave my husbands cousins name) and told him he was going to serve him papers at his home or his place of employment w/in the hour and he should make himself available. Then he said, as for you ___________ (he called me by my ex-husbands last name) you will also be served papers to appear in court and he would also be serving me at my home or place of employment. I had half an hour to call back and put a stop to this.  I figured it was a scam (especially since he connected me to my husbands cousin) and never bothered to call back.  I scribbled the number down so I could google it when I had time.  Surprise!!  Just what I thought...SCAM!!

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

Got the same message as others about a courier service trying to deliver court papers. They also called my mother and she freaked out becasue they said thwey were going to issue a warrent for my arrest but I got her calmed down. I will keep calling them back asking why I was not delivered the papaers. Scam  Do not give them anything.

yup, got a phone call today on my phone for my ex husband of 7 years from a lisa miles with pc8 court. I didn't fall for it and googled number instead. Said we were getting served at home or place of employment, for a court order, she also gave a docket number. I blocked that number on my cell phone!

Got a voicemail from this number saying they have a summons for me and that if I don't call back in half an hour they will show up at my house or place of work to present it to me. That I should have a manager present at work to act as a witness. They also said some other things that were threatening in nature, this crap has to stop

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

A women identifying herself as Tara called my job today asking for me and saying that I had to call back to 855-239-9268 within the hour or someone would be here to serve me with court papers.  My coworker told her I was not available and took the message.  She then asked to speak with our HR department so my coworker hung up on her. She called back over ten times but each time my coworker just picked up the phone and hung up on her. After reading your comments I am not even going to bother calling them back because I know it is just a bogus call from scammers trying to trick someone into paying them money that they do not owe.

This is the second time this number has called me. they call about two months ago and left message the they had court papers to serve me and if i didn't get in touch with them i would be arrested . i tried many times to call back. and know one ever answred the phone. i just got a call and the message this time asked me and my x husband to call back or same thing as be for we qas going to jail. i called back and this time a lady answered the phone by just saying hi. and i told he i was returning a call and she said that my x husband had comited fraud and i asked her how she got my number and she just hung up. I tried calling back many times and just a geniric voice mail box. so i left i message that they better never contact me again .

I call a call today said they were going to sue me and I was going to jail. They told me I had to pay today or someone would be at my house or work within 1 hour. I called them back and told them I know my rights and that by law they could not do that. I asked them what attorney they worked for and they said some bogus name. I tried to call them back several time and they kept hanging up on me after that and would not talk to me.

JUST WANTED TO ADD TO THIS i CALLED THIS NUMBER AND THEY PUT ME ON HOLD FOR 10 MINS THEN SUPPOSABLY ATTORNEY CAME ON THE LINE. i HAD TO KEEP ASKING WHAT FIRM OUR YOU  WITH WHO IS YOUR CLIENT AND WHAT IS YOUR ADDRESS. UNFORTUNATELY I HAD MENTION DELAWARE OR COLUMBUS. SHE GAVE ME A FALSE ADDRESS IN COLUMBUS OH NO SUCH RD NO SUCH ADDRESS NO SUCH LAW FIRM. SHE WOULD NOT ANWSER WHY ONE TIME THEY CALL AND THEY OUR PCS COURIER OF DELAWARE COUNTTY AND THEN THEY ARE BRECKINTON LAW OFFICES.  LIELIE LIE AND BEFORE THEY PUT ME ON HOLD I COULD HEAR OTHER PEOPLE GIVING THREATS ON OTHER PHONES.

Message left on my in-laws machine 3 days ago saying I was going to be served ay work or home within the hr. I haven't work for over a yr. and then they threaten Walter which is my husband name and my father-in-laws name at the end. I check with the courts too cause couldn't figure out what this was a bout. nothing called are local sherriff because they are using PCS Courier Delaware County.

Debt collectors can't issue warrants are not allowed to tell you that they can.  They make it sound scary because they want your money and don't want you asking questions before they get it. Do NOT give in to them!  Always get debt validation MAILED (not faxed, not e-mailed, not read to you over the phone, it must be MAILED!!) to you, don't just pay someone because they harass you.



What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:

you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

I got a voice mail message on my cell phone number last week.  The guy was mumbling and said he was with "PCS Courier Service" and has summons to appear in court for me and that I needed to call back in a half hour to have papers served to me privately.  The problem is, I didn't get the v.m. message for a week because my phone has been acting up.  Well I finally got the message last night, freaked out, and called the claimant's number back today (855-239-9268) and the guy was mumbling and when I gave him my name and the Docket #, he said he couldn't find anything on me.  Then he put me on hold, came back on and said, "I'm not sure what to tell you, maybe you should listen to your voice mail again and see if you gave me the wrong docket number."  So then he asked to put me on hold again and that's when I hung up.  I just search the county clerk of courts and the county municipal court and found nothing of the sort filed against me.  What the heck???  I'm starting to think this is a huge scam!!
